Mangaluru: Court awards imprisonment, fine, to seven murder attempt accused

Mangaluru, Dec 13: The fourth additional district and sessions court here has come out with a verdict in a case of murder attempt against two persons, because of personal and family enmity. Seven persons named as accused in the case have been handed down five years of imprisonment and Rs 15,000 fine each.

The persons who have been pronounced guilty in the case are JCB Siddique (36) , Sulaiman (33), Siraj (31), Abdul Gafoor (36), Harris (34), Abdul Sattar (28), and B T Farooq (30). They were charged with attempting to murder Abdul Hakim (27) and Abdul Ashraf (35).

Hakim and Ashraf were walking from near Karvelu junction in Uppinangady on February 23, 2014, when these seven accused who came in a Maruti Omni car and a two-wheeler, intercepted the duo, rained expletives at them, and hit Ashraf in the chest and Hakim in his left hand, with a sabre, causing deep injuries. A case of illegal assembly, rioting, abuse, serious injury and murder attempt was registered in Uppinangady police station.

Judge of the court, Nerale Veerabhadraiah Bhavani, who held hearing in the case, found the accused guilty of crimes referred under sections 143, 147, 148, 341, 504, 326, and 307 of Indian Penal Code and prescribed that the sentences for these offences will run concurrently. All the guilty have also been imposed with a fine of Rs 15,000 each. Out of Rs 1.05 lac fine, Rs 10,000 would be retained by the government and 60 percent of the balance is to be disbursed to Ashraf and the balance to Hakim, the judgement stated. If they fail to pay the fine, the guilty will have to remain behind the bars for six more months.

The charge sheet in this case had been filed by Uppinangady police sub-inspector,Jagadish Shetty. 21 witnesses were examined. Public prosecutor, Harishchandra Udayavara, presented the case on behalf of the prosecution.
