New Delhi: AAP accuses EC of ‘discrimination’ after it recommends disqualification of its 20 MLAs


New Delhi, Jan 20 (NIE): Aam Aadmi Party (AAP) on Saturday accused the Election Commission of ‘discrimination’ and said the poll panel had no right to recommend disqualification of 20 AAP MLAs in ‘Office of Profit’ case as the Delhi High Court had said they are not Parliamentary secretaries. Addressing a press conference, AAP national spokesperson Sanjay Singh asked, “How could the Election Commission recommend disqualification of the 20 AAP MLA as the Delhi High Court had said they are not Parliamentary Secretaries?”

“In other states, wherever the Parliamentary Secretaries were appointed, they were given the status of minister of state and all facilities were given to them. However, this was not what happened in Delhi, even then discrimination is happening with us,” he added.

The poll panel on Friday recommended to President Ram Nath Kovind the disqualification of 20 AAP MLAs on charges of holding an ‘Office of Profit’. The 20 AAP legislators have been accused of being unconstitutionally appointed as Parliamentary Secretaries to aid various ministers of the Delhi government.

Lauding the Election Commission’s recommendation, Delhi BJP chief Manoj Tiwari had said it was a “moral defeat” for Chief Minister Arvind Kejriwal and he should resign.

Reacting to Tiwari’s remark, Sanjay Singh said, “Manoj Tiwari should ask for the resignation of the Prime Minister as it was during his (Narendra Modi) government in Gujarat that Parliamentary Secretaries were appointed and they were given the status of deputy ministers and were provided with all the facilities.”

“Those who will fight against the system, corruption, they will face the same situation.It’s not a new thing, but in the end, truth will emerge as victorious,” Singh added.

AAP leader Gopal Rai, who was also present on the occasion, alleged that Chief Election Commissioner A K Joti, who will retire in two days, took the decision of recommending disqualification of 20 AAP MLAs under pressure.

Meanwhile, Sharad Yadav today said the disqualification of AAP MLAs by the poll panel was undemocratic. “Disqualification of AAP MLAs was undemocratic as they were not even heard which is against natural justice. Constitutional bodies in d country are being misused now a days.Appeal to public to deeply think about which hands d country will be secured in future,” Yadav said on Twitter.

The latest development means the AAP MLAs are set to be disqualified, which could pave way for a mini Assembly election in the national capital. However, the threat for the party is not immediate as even after the disqualification of the 20 MLAs, the party continues to enjoy a majority in the 70 member house. The AAP had secured 67 out of the 70 Assembly seats in 2015 assembly elections.

    The Delhi High court refused to grant any interim relief for the 20 AAP MLAs facing disqualification. A bench hearing the move expressed displeasure over the conduct of the MLAs too.
    The appeal in the High Court was scheduled for an urgent late evening hearing. The AAP MLAs had pleaded that they were never given a chance to clarify their stand before the EC. However, Justice Rekha Palli, during the hearing, repeatedly pointed out that records showed the MLAs had refused to participate in the proceedings before the EC. She said she was not inclined to give any interim relief to the legislators as they had not cooperated with the election commission in its proceedings on the issue:
    “You don’t have a stay from the high court but you tell the EC that it should not touch the matter as the high court is seized of it. Your conduct is such that you do not care to go before the EC. Who stopped you? The high court did not prevent you from going before the EC,”
    The court further remarked that they have “tried to use the pendency of their case in the High Court as a shield”. With this, AAP’s public claim that they did not get adequate chance to put their case across to the EC, stands debunked

    Congress all the time was accusing EC for favoring BJP while they were losing the elections. Now they have joined with BJP praising the EC for wrongly acting against AAP which is doing a good work in Delhi . So people should understand that there is no difference between BJP and Congress in their motives.

    India Foundation has a Foreign Contribution (Regulation) Act (FCRA) license, the four ministers who are on its board violate Section 3 of the FCRA Act, 2010. “Section 3 of the Act prohibits a political party, political leader, member of any legislature and journalists from accepting foreign funds.
    With which authority is your trust registered?
    Who are its trustees?
    When did the India Foundation get its FCRA registration for the first time? The FCRA site says it was “renewed” in 2017.
    If the India Foundation got registered with FCRA for the first time in 2017, did you receive FCRA ‘prior permission’ for foreign contributions/donations in the years before that? If so, could you provide details of that?
    Before AAP, the BJP and Congress had perfected the Art of Profiting from offices of profit. This arbitrary dismissal of elected government is political vendetta. Is EC works for BJP or it is autonomous body?
    Let's AAP take 'India Foundation' to EC.

    In UP and other BJP ruled states thousands of cases against ministers and politicians are squashed and given clean chits. Here 20 MLAs of AAP being disqualified is very rediculous. This is mere speculation without any basis and evidence and just revenge politics by BJP. I am sure all this BJP drama will end as 'Coronary Artery Insufficience' and disapproval of charges as simply media campaign.
