Mangaluru: Reasons for acquittal of pub-attack accused to be analyzed - police commissioner

Mangaluru, Mar 17: “Public prosecution department has been instructed to analyze the reasons that were responsible for the acquittal of all the accused in the infamous pub-attack case and submit the report,” said T R Suresh, commissioner of police on Friday, March 16.

Third JMFC court in city, on March 12, had acquitted all the accused in the pub-attack case saying that they are innocents due to lack of evidence.

Police commissioner informed that the prosecution department will conduct an inquiry as to whether there is any error or oversight that has happened from the end of the police department during the registration, investigation and charge sheet filing of the said case. He said the prosecution has been asked to submit the report on the same.

Based on the report that will be provided by the prosecution, a decision will be taken as to making an appeal in the high court questioning the judgment given by third JMFC court of Mangaluru.

    It looks like the entire Pub attack incident was tailored to protect the accused and fool the general public. There was no need for defense lawyer to come out and explain to public why the prosecution lost the case. The defense lawyer is playing safe by speaking from both sides.

    There is a saying which says "Picture speaks thousand words." The prosecution/court should have summoned the photographer and taken his/her testimony. Assuming that the victims are dead due to beatings, the case can be thrown out of court, declare all the accused innocent, simply because there was no testimony from the victims? Law makers should revisit the current court procedures.

    The reason for acquittal of these criminals was poor charge sheet deliberately filed by police under instructions from then BJP government. We remember Somasekhar commission under BJP. No point holding any enquiries as nothing will come out of this.

    If the video recording of the 'pub attack' is not an evidence for Judge Manjunath who gave verdict acquitting all the accused, what if terror is going to attack on the same pub caught on the CCTV and cameras is that not enough to prosecute the accused?

    In my view like Ramachandra mutt disciple murder swami acquittal, Namo Naresh getting bail before naroc analysis is clear proof that some powerful local Congress leaders secret understanding with this fanatic organisations. If is the ruling Congress 'soft approach' has brought this day they are reduced few states.
    If no accused coming forward clear says that they might have life threat when law enforcement can't provide their security and for court their absence in witness box means lack of proof.
    By all means Mangalore has lost credibility to become 'smart city' with this incident when the whole world is watched.

    These qualified IPS officers,Lawyers, Judges, Media and other intellectuals are analyzing why accused cannot be guilty in this incidence only because of lack of evidence? What is the live video? Why they were arrested only those people who were seen in the CC TV and others on their statements? If this would be in any developed country by this time criminals would have completed their punishment and come out from jail. In our country only acquitting took so many years. What a shame.

    Appreciate concerns of police commissioner as a reciprocation to public anger that criminals have walked free despite video clips of heinous attack on pub goers that to young women! Every one above desired age by law has every right to visit the pub, restaurant or any entertainment place they wish! When we go to a bar / restaurant / shop we will not ask for their licence ...do we??? Not even one out of thousand. There are government appointed institution and inspectors to check the same!
    Pub attackers must get punishment and jail for at last one year so that future gundas of such type may think twice before attacking any women! I pity those people and political party supporters approve such third grade rowdy behavior!

    Trial by activists and public cannot influence trial by Courts. On the contrary it is counterproductive. Hard documentary evidence has to be produced in Courts. Was any medical examination done to prove grievous injury in the first place?

    Ganapathy belongs to a Police Department who has to save life, committed suiside. He killed himself. He had many ways to prove that he was facing harrasement.

    In Pub attack girls were iltreated, that too outside girls who came for studies. Parents after this attach took children to their place though they paid huge fees for education. Group of boys attacking girls what a great crime. What a great shame on these boys.

    At the same time name of our District also spoiled due to these boys.

    Dear Christine, educated Girls are ill treated, Their Parents have sent them to study here in Mangalore, not to do research in a Pub, where you find these spoiled brats smoking , drinking and dancing. Their Parents were ashamed so they did not bring them to the witness box, that is how the the vigilantes were acquitted.

    I agree with you Bharath 1953. Being girls they should not do that. They came for study they had to study.

    But do you know very well the boys who went to attach girls in the pub are clean hearted. Came from good family. They are not drinking alchohol and not smoking. If they are so good why they judge other people. Why they went to see them. Who given authority to beat young girls. Why they bother about others.

    Command them to correct whole Indian girls and boys. Let India become people who are all good people.

    Failing to indict a criminal the sitting judge sends a clear message that he/she is in power and are above the law, it is because of these criminal that so many girls were beaten in public and put to shame everything was caught on camera is the court blind, the people who are saying that there is no evidence.

    problem is with investigative agencies and the prosecution team. Proescution along with investigative agency should make a water tight case. Here both work in difference directions either due to the order of the political masters or the influence of defense team over the prosecution team. Same is happened in 2G scam and the telephone exchange (Maran Brothers) in CBI court. Judge during pronouncement of judgement said that he was waiting for the evidence to be submitted by the prosecution. Why can't the judge highlight or pass a remark during the proceeding instead of acquit them due of lack of evidence.

    An analysis, regardless of who conducts it, is merely an academic exercise.

    Other than an output of a report, it has no impact on the law and order situation.

    The bottom-line here is that the criminals have escaped, despite committing various crimes.

    According to the Bristish laws, which Indians have adopted, a crime committed by someone is automatically considered a crime against the society and the state, and not against the party affected.

    So, the affected party (victim) does not have to be present to decide if the crime has taken place or not.

    An analysis is best left to the media. Police will be wasting their time on such an exercise.

    New Rules of Admissibility as per Anvar P.V vs P.K.Basheer & Ors
    As stated before the Supreme Court in Anvar has now overruled the position in law as in State v. Navjot Sandhu. The Court has now held that any documentary evidence in the form of an electronic record can be proved only in accordance with the procedure prescribed under Section 65B of the Evidence Act.
    To reach this conclusion the Court reasoned that Section 65B of the Evidence Act has been inserted by way of an amendment by the Information Technology Act, 2000.     The Court further goes on to hold that provisions such as Section 45A of the Information Technology Act, 2000 which provide for the opinion of examiner of electronic evidence can only be availed once the provisions of Section 65B are satisfied. Hence compliance with Section 65B is now mandatory for persons who intend to rely upon emails, websites or any electronic record in a civil or criminal trial to which provisions of the Evidence Act are applicable.
