Mumbai, Apr 19 (PTI): India's image today has taken a beating with a growing perception abroad that its a country of crimes and rapes and the liberal and secular people are not safe here, the Bombay High Court observed today amid a nation-wide outrage over the Kathua rape-cum-murder and the Unnao rape cases.

A bench of Justices SC Dharamadhikari and Bharati Dangre went on to say that the rest of the world was hesitant now to engage with India over educational or cultural issues due to the current state of affairs here.

The bench made these observations while hearing pleas by the kin of slain rationalist Narendra Dabholkar and Communist leader Govind Pansare. They had sought a court-monitored probe into the killings.

"It is unfortunate that today, the image of the country is such that those living abroad feel only crimes and rapes happen in India.

"Anywhere we go (outside of India), we have to answer a barrage of questions. People are under the impression that liberal, open-minded and secular people cannot be safe in India and that they are bound to be attacked. The image of India is suffering due to the acts of a few people," the bench said.

Senior counsel Ashok Mundargi, the lawyer for Maharashtra CID (Crime Investigation Department) probing the killing of Pansare, told the high court that there was little hope now of achieving anything substantial from any further field probe.

"Field probe including raids at possible hiding places will not lead to anything anymore. Our only hope is scientific probe and evidence from call detail records, forensics etc.," Mundargi said.

Additional Solicitor General Anil Singh, representing the CBI probing Dabholkars killing, echoed the same view.

"How do we then take the case to its logical conclusion?" the bench asked.

"Can we allow for the case to reach a dead-end when similar crimes are on the rise?" it asked.

The bench said while it was not critical so far of the ongoing probes by the two agencies, it could not allow them to leave everything to the mere hope that the absconding accused persons in the two cases, tired of hiding or fearing threat to their lives, would turn themselves in one day.

"Why dont you take steps to completely strangulate the organisational backing that the accused persons must be receiving?" the bench asked.

It also directed the agencies to seek help of expert interrogators in the case.

The bench warned that if the agencies failed to make any progress by the next date of hearing, it would be constrained to summon the senior officials concerned.

Continuing with its observations on the state of affairs in the country, the bench said the rest of the world was now hesitant to engage with us over educational or cultural issues.

"No international body wants to be a part of our educational and cultural projects. Investors show interest at first but pull back later on. We are very sorry to see this. Do we (India) want to live in a cocoon?" the bench asked.

"No institution in the country, including the judiciary, is spared from this," it said.

Recently, the brutal rape and killing of a minor girl in Kathua and rape of a teenage girl allegedly by an MLA in Unnao in Uttar Pradesh had triggered a nation-wide outrage.

Dabholkar, who championed the anti-superstition cause through a social movement in his life, was shot dead on August 20, 2013 in Pune while on a morning walk.

Pansare was shot at on February 16, 2015 in Kolhapur and had succumbed to his injuries on February 20.

A high court bench had last year observed that the killings of Dabholkar and Pansare were "well planned" and the perpetrators had an organisational backup.

    You and I left our country decades ago for greener pastures, I am afraid you have not lived among our citizens in India in a long time, I admit, I have not either. The issue is not just about the crime in India, it is hopelessness, lawlessness, unemployment, poverty, disparity, discrimination, lack of basic needs such as a roof over the head, clean water and clean air and I can go on. It is a miracle we are still a largest democracy in the world. As long as the minorities and the poor masses are not assimilated into the society, our country will be a powder keg. Statistically crime in US and Canada may surpass that of India, I bet the Western countries do not foster the kind of religious disharmony among their citizens as we are witnessing in India.

    I get your point. I was only talking in terms of comparisons of crime rates. I have regularly followed crime rates in major countries, and have not taken account of other factors which I had not raised in my comment; you seem to be reading into them. While I left India over half a century ago = probably before you were even born - I have kept in regular and close contact, often visiting my extended family on important occasions, some times more than twice a year - and have led fully a third of my life in India. If I do not have the day-to-day living conditions in India, and you admit you too do not = I hesitate to comment on other factors and confine myself to what I can confidently write. Mohan

Have you read yesterdays news that BJP has the maximum number of law makers who have proven cases of crime against women and that too at 12 numbers( congress 4)!!!???. What does this say!?. Ok leave that aside, why were BJP ministers supporting rapists and not the victims both in Kashmir and UP!?. Why is it that these days we hear maximum number of BJP people involved in crimes against women!?. Hope you remember what all happened during BJP rule in Karnataka!?     If the political, social and economic unrest continues at the rate at which it is now in India, we soon will be a failed nation. The have-nots and the minority population will not be able to endure social injustice, poverty and disparity forever. We will soon be joining bankrupt nations such as Zimbabwe, Congo and Sierra Leon. Unless there is improvement in law and order, as bad as it sounds, military governance may be inevitable. Our foes especially China and Pakistan probably relish our failure. How can we protect our nation in the presence of disarray, disunity and chaotic governance?

    No doubt that liberal, open-minded and secular people are bound to be killed. Thats no big deal for BJP. The only concern they have is whether they can win elections and stay in power. International warning are hypocritical as they will do all that needs to be done for their own advantage and not for the welfare of our people. If criminals can contest and win elections and we support them we are still an uncivilized country in terms of politics.

    If at all people want BJP to be in Power, I remember the era of Atal Bihari Vajpai, Look at the Ministers he had and now look whom we have now, People who think that our country can be run on the basis of religion, then please we all have to look at Pakistan and its stage today in the current world. And sorry to say even Pakistan is showing fingers at us and killing our soldiers.

    I still request all our friends and fellow countrymen that let us not divide our selves on the basis of religion and unnecessarily have a divide that cannot be joined at all. If BJP is responsible for the current situation that India is in, we all have to force them to change their policies or vote them out. After all, they are public servants.

    The good image created by India since 1985 to 2013 is totally undermined by the current administration of the autocratic rule of the twin brothers Modi-Amith Shaw, and their blind followers.

    The UN and the IMF (International Monetary Fund) have warned Modi in the strongest language, their concern of the plunging of India into total break up of the rule of law and safety of the women. This is indeed a grave national tragedy and shame created by the current rulers.

    Who is responsible for such situation, who is governing India and 22 states as reminded on a daily basis by Feku and DAKU.

    This is a bald statement of the HC that does not compare the crime/rape rates of India with major countries such as the US and Canada, on a per capita basis. What is the basis on which the statement was made? I concede that crime/rape rates have risen dramatically in India, especially in certain states and in mega cities, but is there a statistical analysis on the basis of crimes per 100,000 (lakh) of population in a country of 1.2 billion inhabitants?

    The report comes amid countrywide outrage over growing rape incidents, such as in Unnao where a BJP lawmaker is an accused.

    At least 48 sitting MPs and MLAs have declared cases related to crime against women, with the ruling BJP having the highest number of such politicians at 12, a report by Association of Democratic Reforms, a non-profit election watchdog. The report comes amid a nationwide outrage over rape incidents, including in Kathua in Jammu and Unnao in UP, where a ruling party lawmaker is an accused.

    “Out of 1,580 (33%) MPs/MLAs analysed with declared criminal cases, 48 have declared cases related to crime against women,” said the ADR report.

    Giving party-wise details, the report said that BJP had the highest number of MPs and MLAs , that is 12, followed by Shiv Sena (seven) who have declared cases related to crime against women.

    Among states, Maharashtra has the highest number of MPs and MLAs (12) who have declared cases related to crime against women.

    Modi, during his campaign in Hardoi, UP, who had thumped his chest while announcing that even BJP legislators and those in the NDA will not be spared if they are found with criminal antecedence.
    In 2014 Modi said"I have decided that when a new government is formed after May 16, I will set up a committee to find out what cases are pending against whom. Lok Sabha candidates submit in their form during filing nominations the details of cases against them. I will not discriminate in it. I will not spare even the BJP and NDA candidates.
    "I will ask the Supreme Court to hear the cases fast. Those, who have committed crime will go to jail and their seats will go to candidates with clean image. No accused will dare to fight polls. Who says that this cleansing cannot happen? I have come to cleanse politics. It is necessary to free Indian democracy from criminalisation," he said.
    Four years into the government instead of becoming saviour now turned to be worst nightmare.

    It is true that India's image abroad is not getting better than what it was ten years ago, and that is mainly due to the fact that India is known as a country where rich is getting richer and that the poor is getting poorer. The only explanation that we all can render to this anomaly is the fact that our population is ever increasing every passing day everywhere in India and that we are losing the control over all the negative impacts that we are experiencing and there is more negative that is evident and not much positive to boast. This situation can be changed by none other than we Indians ourselves.

    We have to somehow create a new movement all over India that when our literacy rate is gradually progressing, our employment status is progressing and the economy is getting better everywhere. When people get more educated, we have to find more jobs for our people, and more jobs obviously will bring better economy and better standard of life.

    When we neglect the poverty amongst the poor people, there is bound to be hatred between the rich and the poor, and obviously this hatred will create more crimes and more frustration. When our jails are getting overpopulated, even the police force finds it difficult to control the crime.

    Each and every Indian therefore must appreciate the "cause and effect" situation when the rich is getting richer and poor is getting poorer. People have to somehow survive, and many uneducated people find it easier to create crimes and end up in jail. Our society has to change the basic concept of life by helping people and take time to listen to their grievances. We have to give a hope of progress to poor people than neglect them. Our Temples, our Mosques and our Churches have to preach and practice more by helping and uprooting the causes of poverty than amassing wealth and then blaming the government for demonetizing the currency.

    There are more ways to help poor people, and therefore the rich people must help poor.
