Liquor ban: Nothing wrong with denotifying highways inside cities, says SC


New Delhi, Jul 4 (Deccan Chronicle): In a move where the Punjab government observed a law saying restaurants situated within 500 metres of National Highways can serve liquor within their premises, the Supreme Court on Tuesday said there is nothing wrong with denotifying highways inside cities.

Following a Supreme Court order, thousands of pubs, restaurants and bars have been forced to shut down, saying that liquor cannot be served near national and state highways.

The SC said that the purpose of the ban was to ensure that people do not drink and drive on highways, a report in The News Minute read. “There are no such issues when the roads are within the city,” the apex court said, while adding that denotifying such roads may have intelligible differentia.

The court made the observation while responding to a plea filed by Arrive Safe Society, a Chandigarh based NGO. The NGO alleged that the Chandigarh administration had issued notification to denotify roads to bypass Supreme Court’s order, the report added.

The NGO had moved the SC after Punjab and Haryana High Court dismissed its plea stating that the administrtion had not voilated any law by issuing the said notification.

The apex court had meanwhile ruled that states were not wrong in denotifying highways within the city to avoid shutting down of liquor shops and restaurants and hotels serving liquor.

Meanwhile, states like Karnataka have already approached Centre asking to denotify national highways passing through the limits of urban local bodies.

    I am sure....this Judge too is thinking like us.... what may come....but bur & restaurant should not be closed for any reason. What is the guarantee that there will not be any accident if driver is not drunk???

    Do they have any idea, how much losses incurred by those shops who already shut down? or moved to another place?

    If the rational behind such rule is to make the drivers not drink and drive, then the rule should be applied to all the roads. The current rule does not make any sense at all.

    If the SC really serious about discouraging drinking and driving then raise the fines. I think the drinking and driving offence must be fined at rs.100000 and a month in prison. Apply this rule and then see how many people with drink and drive.

    I think the intention is to introduce sufficient difficulty to reduce the number of potential drunks. Casual drinking usually will not warrant time spent searching for a bar against time to destination. However maybe actual drunks will find it too difficult to find their way back to the highway after a pit stop/search.

    ...This is India. Then what is ban. Why only punishing bar owners who opened shop near NH..this opened another good option for corruption. Now ministers will start collecting money from bar owners as denotification charge. Crores will change hand for sure.

    Many businesses that too very good businesses are forced to shut down...
    Make a committee... Talk to all stakeholders...
    Where possible and eligible allow businesses to survive...
    This is a one way judgement after effects of which has forced the Supreme Court to rethink...
    Just imagine what is the point in closing down pubs on and around Brigade Road in Bangalore...
    There may be numerous other places of real joy...

    So, the moral of the story is- Drink within the city and then drive on the highways! This makes a total mockery of the ban,! How is this going to make highway driving safe, if you already have drunk drivers sitting at the wheel; this is something no sane person can understand. I would have thought that the states would have the health and safety of its citizens at heart, but they seem to be more interested in finding ways to bypass the ban so that finances and revenue collection is not affected. What a state of affairs?

    Very sad to see SC getting too involved into all of this . there are major reforms in judicary millions of cases , property realted , divorce related which is literally taking years and sometimes one generation has gone by just visisting the courts ...soomone drinks within 500 mts or outside is just a very minor discussion point and has no meaning at all ...
