Bengaluru: Soujanya rape, murder case – Court finds flaws in probe, calls for action

Bengaluru, Jul 2: The Children’s special court opined that the investigation is not properly done in the rape and murder case of 17-year-old girl Soujanya. The court gave its opinion after accused Santhosh Rao was given an acquittal .

The court said that the samples collected by the doctors after the rape were not complementary to the case. So suitable action should be taken against erring officials.

This case was registered in October 2012 and Beltangady police investigated the matter. Later, the case was handed over to Special crime department of CBI Chennai in 2013. It submitted its report in 2016. In the order of June 2016, Justice C B Santhosh noticed that there were no suitable witnesses or evidences to connect the accused Santhosh to the crime.

The justice pronounced that the prosecution had failed to prove the accusations and asked the district legal services authority to provide compensation to the parents of the deceased Soujanya.

The justice said, “Accused Santhosh is not connected to the crime at all. He is falsely accused. In the DNA report also there is no positive evidence against the accused. Semen marks or the hair of the victim girl were not found on the cloth of the accused. The mud that was found on the confiscated items and vaginal swab were the same. But they were not found on the clothes of the accused."

“The surprising fact is that no evidence was recovered from the spot where the crime took place. If the rape had occurred at the said place, what prevented the investigating officers to call the team of experts to the spot to find footprints or hair of the people who were actually involved in the crime?"

“Prosecution could not verify the last seen ideology and there was no evidence that the victim girl was dragged into the bushes and raped.”

The judge also said that when there were no clues from the investigating agency about the accused and vaginal swab report of experts was the best evidence to connect the criminals with the crime. However, forensic experts did not collect the vaginal swab properly. Vaginal swab should be packed after drying. But the doctor had not done it. That is why there was no positive results in the DNA test as fungus developed in the evidence that was collected.”

In 2016, summons was served on suspected accused Mallik Jain, Dheeraj Jain and Uday Jain. However, high court quashed the summons after hearing their appeal.

    culprit has been protected by powerful people. They are protected by the State and Central government. Only miracle should happen. If not the case is a closed matter. Innocent was arrested and the real culprits left out.

    Santhosh also has to be paid full salary plus compensation for the mental trauma. This must be deducted from the salaries of the officials and they must be sacked from the services form the date of murder.

    Its time to put GOD to test,All interested people go to nearest religious places of all beliefs and ask god to put the murderer in same state as the victim in same place within a week.Instead of dancing in front of LAW & Government & Forensics.

    The courts didn't find evidences from the arrested accused, without proper evidences court cannot convict wrongly arrested person's. An innocent girl Soujanya was raped and thrown out, her body was found. Then who murdered the innocent Soujanya?! What the law enforcement is doing/hiding evidences?!

    So do they reinvestigate the case now and enquire the 4 accused ? It will never happen as all the political parties are same in terms of protecting the accused in this particular case, they doesn’t want to go against them.

    The Court should reveal the name of the incompetent doctor who did the post-mortem. Why the samples were not collected? Why the post-mortem was done after hours? Mangalore has Forensic Medicine experts attached to teaching hospitals. Why their help was not asked? Looks like a systematic cover-up/derailment of the investigation from day 1. The question is who is the powerful person/institution behind this? The doctor and other Police officers should be arrested and they should spill the beans. What happened to Soujanya and her parents should not happen to any other girl.

    Instead of disclosing the nameof the persons involved arrest all officials and doctor involved and punish them as criminals for life imprisonment with 20 years no bail. Once this is done the future persons who are involved in these types of cases will take their job serious
