Karnataka cabinet withdraws consent to CBI inquiry against DyCM D K Shivakumar


Bengaluru, Nov 24 (IANS): The Karnataka government has decided to withdraw the permission granted for a CBI investigation into the disproportionate assets case against Deputy Chief Minister D.K. Shivakumar.

The decision was made during a cabinet meeting chaired by Chief Minister Siddaramaiah on Thursday.

Minister of Law and Parliamentary Affairs H.K. Patil, speaking to the media, said that the cabinet has approved the withdrawal of the decision for a CBI probe against Deputy Chief Minister Shivakumar.

"The previous Chief Minister had given oral orders for a CBI investigation against Shivakumar. According to legal procedure, they should have obtained consent from the Speaker. Without obtaining the Speaker's consent, the former CM had orally ordered a CBI probe. Considering the opinions of the former and present Advocate Generals (AGs), this decision has been made. The earlier decision to hand over the case to the CBI probe was deemed unlawful as consent from the Speaker was not obtained," he said.

"The former AG had opined that the case was not suitable for a CBI probe. The previous BJP government, disregarding this opinion, had given consent. Based on the former AG's opinion, the current AG, Shashikiran Shetty, also gave his opinion," Patil added.

The Congress government argued that to date, 577 cases of disproportionate assets case have been registered in the state, and not a single case has been handed over to the CBI. Local police have conducted investigations in these cases.

Reacting to the cabinet's decision, Leader of Opposition R. Ashoka said: "The case is before the court, and it (the decision) is against the law. An appeal was made against handing over the case to the CBI. The decision to withdraw permission for a CBI probe against Shivakumar before the judgment is given is incorrect. Whenever there is a change of government, everyone will do the same."

    Central Agencies are abused to target opposition leaders, parties, people and voices, that speak and highlight Modi led BJPs monumental failures. Every alternative day there are some raids, while the real corrupt, criminals and frauds walk free. Whats worse is when the align with BJP every sin, gets washed away. Since this is the case, all indian people stand with congress and its leaders in solidarity. Withdrawl of case from CBI is welcomed by people across the state and country.

    Political vendetta from BJP, Brhasta Jumla Paapies issued a letter from BJP gobernment to CBI to inquiry against DKS. Now congress withdraws the letter issued to CBI. Very simple case. Previously DKS was asked by the BJP, Brhasta Jumla Paapies to join BJP and he declined. So they filed a case against him.

    In normal circustances, we would certainly questioned the propriety of the cabinet decision to withdraw permission to CBI to investigate a case against one of the state ministers. But going from the track record of CBI during the last 9 years, CBI has been clearly serving the interest of rhe ruling party at the Centre and has been probing cases only against the non-BJP politicians while closing their eyes on the crimes of BJP politicians. Given this overtly partial attitude of CBI, the Karnataka Government has done right in blocking the activities of CBI in Karnataka. This is the right step especially when the General Elections are on us in a few months. This step was necessary to ensure a level playing field for BJP and the non-BJP parties in the forthcoming elections.

    How do we gauge a modern day politician in India?... This comment is across parties and general in nature... We are ordinary people and find it difficult to manage or live without greed even for money less than a crore... What should be the mindset of these top guns with whom 1000s of crores of wrong money falls at their feet at their disposal?... Not calling DKS a saint among crores ... Same case is true or more true with bajapa guys and HDK is the emperor of all... But it may be quite hard to beat now almost retired oily oily from our own tulunadu.... Corruption and money laundering is an integral part of party management and can not be dispensed with....

    When Manmohan Singh was Prime Minister, on allegation corruption cases were probed on his own cabinet colleague sports Minister Kalmadi and alliance partner DMK Minister Dayanidhi Maranas well. But nowadays mostly the probe is on opposition party leaders and Minister. Allegation were leveled against Ajit Pawar also but ever since he joined the Govt, the matter is is back burner.
