Mangaluru: Case filed against MCC officials over fatal stormwater drain incident

Daijiworld Media Network – Mangaluru

Mangaluru, May 25: A case has been registered at Urwa police station against officials of the Mangaluru City Municipal Corporation (MCC) following a tragic incident where an auto-rickshaw driver fell into a stormwater drain and drowned.

The victim, Deepak Acharya, was driving his auto-rickshaw, registration number KA-19-AE-4260, near Kottara when he fell into a drain passing under Tiruvu Road near Yamuna Paradise Apartment. The incident, which occurred amid heavy rainfall, resulted in Deepak's death.

The case against MCC officials alleges that their negligence led to the fatal accident. Hema, Deepak's sister, accused the MCC of causing her brother's death by failing to construct a proper wall beside the drain. "Due to the negligence of the Mangaluru city corporation, they failed to construct a wall beside the drain. Due to the heavy rain, the drain was overflowing onto the main road, making it difficult for vehicles to distinguish between the road and the drain," she said.

Hema further lamented the loss, stating, "The MCC claimed the life of my brother. He was the breadwinner for our family and took care of our mother. He took a shortcut to reach home due to the heavy rain, but unfortunately, due to MCC's negligence, he lost his life. We learned about his death around 3 am."

The site of the incident lacked safety measures, with no wall constructed around the drain, and no barricades or warning signs were put up to prevent such accidents. In response to the incident, MCC officials have taped off the entire stretch near Kottara Chowki, covering the drain. Additionally, a section of the wall attached to the drain collapsed near Mahesh College in Kottara Chowki.

Many many loopholes in Mangalore Corporation Office, regarding almost in every small matter to big. While issuing licence for trade, renewals ( lot of time taking in to months), tax payments issues like jan. Feb, march, still system not updating, issuing unnecessary penalties for closed shops, their sign board penalty (when trade licence not renewed means everything is closed, go to inspection before penalising for sign board renewals and double penalty for closed shop, this is just like gundaism) And inspecting officials RI are very very rude Ravxxxx not ready to talk. If we talk, talks like talking to enemies.

dishonesty and lies are norm. People are become used to it , may because they are become helpless, lazy and also due to fear of muscle power . Those who profess ( dishonesty and lies way to live), may be because they feel that it is short cut to earn quick money or only way to survive due to competition .

The case should be filled under the non vicarious liability according to Hon. Supreme Court judgement JT 1993 (3) -SC- 33 ,where the concerned MCC official/ s are personally held responsible. Only if there is personal punishment things will improve, otherwise compensation etc will be paid by MCC as a corporation, from our taxpayers money.

Om shanthi to Deepak's soul. When deepak was going home everyday that way, why deepak and other drivers and residents of that area couldn't bring the issue of constructing wall, to the notice of the MCC or to the concerned MLA's or to the corporators? Everyone is behaving like they dont bother about issues which may help the thousands. Its like praying for rain only on thyself.

If those responsible officials do their work honestly, they could have saved one life. Instead of this work they ride market roads and SBI areas to catch footpath vendors, that too at festival time only. What a shame.

Mangalore City Municipal Corporation has become very corrupt. I had a similar incident near my home few years ago. None of the MCC officials work honestly; this is my personal experience. There's no one to ask them.
