HC quashes criminal case against two charged with raising 'Jai Shri Ram' slogans inside mosque


Bengaluru, Oct 16 (IANS): The Karnataka High Court on Tuesday quashed the criminal case lodged by the police against two persons in connection with allegedly raising "Jai Shri Ram" slogans inside a mosque.

The single division bench headed by Justice M. Nagaprasanna, looking into the appeal petition by the accused persons, while passing the order, mentioned that it was not understandable how the raising of "Jai Shri Ram" slogans would hurt the religious feelings of any community.

The accused were charged under the IPC Section 295A for allegedly raising 'Jai Shri Ram' slogans in a mosque.

They were also booked under Indian Penal Code (IPC) Sections 447 (criminal trespass), 505 (statements conducing to public mischief), 506 (criminal intimidation), 34 (common intention) and 295A (outraging religious feelings).

The bench noted that the complainant in the case had himself said that Hindus and Muslims were living in harmony in the concerned area.

Permitting of further proceedings against the petitioners would become an abuse of process of law, the bench underlined.

Referring to the Supreme Court order, the bench said any and every act will not become an offence under Section 295A of the IPC.

The police had charged that the accused persons had barged inside the mosque on September 24, 2023, at about 10.50 p.m. and raised slogans of "Jai Shri Ram". They were also charged with threatening.

When the complaint was registered the accused were shown as unknown persons and later the accused were taken into custody.

However, challenging the allegations against them, the accused filed an appeal before the Karnataka High Court and quashed the case in this regard against them.

The bench also noted that the complainant mentioned that Hindus and Muslims lived in harmony in the area and also claimed shouting "Jai Shri Ram" slogans would flare up communal tension.

    This is one debunking judgement that may not be palatable to even right minded Hindus... Raising slogans of other religions in different religious premises is absurd and atrocious... let the fellow dare to go to Golden temple in Amritsar or any Sikh holy places and try whispering even... Judge has shown that even judges can be fanatics...

    Lot many court orders come these days, with lack of application of mind. Really Sad. No matter how much harmony people live together, but in 1.4billion people are people with sadistic mindset, playful mindset and hateful mindset. These kind of court orders, just empower these crazy people. Is it all right? Just imagine in a middle of aarthi, or church mass or friday prayer, just to incite the believers, mischief mongers, chant whatever they wish. Go to any Pro BJP facebook posts, you will find a narrative which is like empowerment of hindus. Is it really? Or it is vote bank politics.

    Logically, Justice M. Nagaprasanna is right. The police presented the case in a wrong way. They should have charged him with IPC 153A, IPC 296, which would have been apt and accordingly judge would have set the verdict.

    Very unfortunate on such a verdict -- can lead to chaos in future --some judges look for elevation the supreme court -- nothing new in this --however -- religious freedom and violations are start of many a trouble -- break downs in society -- --as though this was the only place to say or shout jai Shri ram - needless- provocation --- it is obvious --

    Typical fanatic mindset. No one has the right to trespass others property. Also nobody has the right to hurt others feeling, provoke them which is against the core sentiment and belief on owners property. Do I have the right to sell or market beef or pork products in other owned land who are against these food habits. The judgement itself is biased, encouraging fanaticism. Every coin has 2 sides.

    Is it not offence to enter at night and slogans at other religious places.? Will Hindus will tolerate if same thing will be done by Christians or Muslims at Temple.? For Muslims it won't hurt but for Hindus it will hurt Judge Saheba.? I think Judge has misunderstood the case..

    We should know the intention behind raising any slogans. Here in this case, what was the need of raising slogan "Jai Shri Ram" in the Mosque Premises that too around late night ??? I request my muslim brothers not to follow these type of act "to raise slogan "ALLAH HU AKBAR" " in any other religious places and at the night time. It may disturb our fellow human beings . So pls avoid it
