Government Seeks Gag Order on Swamy for Speaking on 2G


New Delhi, Jan 21 (IANS): The government has moved the Supreme Court for an appropriate order against Janata Party president Subramanian Swamy for publicly speaking on 2G spectrum matter, which is before both the apex court and a special Central Bureau of Investigation (CBI) court.

The government, in its application, annexed the newspaper extracts which have verbatim quoted Swamy making defamatory allegations against Congress chief Sonia Gandhi, Home Minister P. Chidambram, and former Tamil Nadu chief minister M.Karunanidhi in the context of 2G scam.

The affidavit was filed by Sita Ram Meena, a director in the communication and IT ministry.

Noting that Swamy made defamatory allegations when the apex court and the special CBI court are seized of the 2G matter, the application said the sole object of the said speech was to "malign and lower the image and prestige of public servants holding important offices in the union government and in parliament".

The court was told this in the course of the hearing of an application by the Centre for Public Interest Litigation (CPIL) that allged that union Law and Justice Minister Salman Khurshid was interfering in the 2G trial by making statements giving clean chit to the companies facing prosecution.

CPIL counsel Prashant Bhushan drew the attention of the court to "how important facts were being omitted and the minister was giving unsolicited opinion". In this context, he referred to the CBI investigation of Loop Essar and Sistema Shyam Telecom.

Contesting the claim by Bhushan, senior counsel K.K.Venugopal gave three reports in a sealed cover by the CBI and the Enforcement Directorate on their investigations and said that court could go into them and see the "extent of investigation that has been made in each of these cases".

Given the paucity of time, the court adjourned the hearing and said the matter would be listed for the hearing next week. The date for the hearing would be given on Monday or Tuesday.

    when we look back at the truthfulness of our fore fathers before the entry of the invaders and compare with the present I feel like cokkiting suicide which is not advised as per our ehics.     *The Union Cabinet in 2003 had authorized the Telecom Minister and the Finance Minister to jointly decide the pricing and mode of allocation of the 2G spectrum, which also implied that if they could not agree on these, they should go back to the cabinet.
    *The Ministries/Ministers directly involved are i.e. Ministry of Telecommunications and Ministry of Finance, whereas other ministries indirectly involved are the PMO, the Cabinet secretariat and the Law Ministry. In other words the file in which the decision taken by govt. with regard to allocation of 2 G spectrum to the private Firms initiated by Telecom Ministry , moved to Finance Ministry, the PMO, Cabinet Secretariat and the Law Ministry. Hence all are directly/indirectly responsible.
    *The issuing of licenses occurred in 2008, but the scam came to public notice when the Indian Income Tax Department was investigating political lobbyist Nira Radia. Subsequently CAG in its report estimated the loss of revenue to the govt. at the tune of Rs 1,76,379 crores. Much of the credit of bringing this whole scam into the public light (by pursuing it in the court of law) goes to Subramanian Swamy who is the chief petitioner for this case in the court of law. Dr.Swamy first filed complaint before PM, Dr Manmohan Singh, naturally there was no action from PM, than he filed petition before Supreme Court. The Apex Court only directed CBI to file FIR and investigate in to the matter.
    *As on 08.01.2012 the CBI only investigated/ examined, A. Raja the Minister of Communications and Information Technology, M. K. Kanimozhi Rajya Sabha MP, Siddharth Behura former Telecom Secretary, RK Chandolia Raja's private secretary, Gautam Doshi Managing Director of Reliance Anil Dhirubhai Ambani Group, Surendra Pipara senior vice- President of Anil Dhirubhai Ambani Group and Reliance Telecom, Hari Nair senior vice-president of Anil Dhirubhai Ambani Group, Sanjay Chandra Managing Director of Unitech Wireless Ltd, Shahid Balwa DB Realty promoter, Vinod Goenka DB Realty promoter, Sharath Kumar Managing Director of Kalaignar TV, Rajiv Agarwal and Asif Balwa (younger brother of Shahid Balwa) chief utives of Kusegaon Fruits and Vegetables, Karim Morani Cineyug Media and Entertainment Ltd’s Director. The CBI has filed final report on above accused persons in the Trial Court and Court framed charges against them. Where as the CBI going soft on companies like Essar, Loop and their promoters by not slapping corruption charges against them. CBI also going slow against the former Union Minister Dayanidhi Maran after registering FIR.
    *The persons required to be interrogated/investigated in this 2G scam are P.Chidambaram, the than Finance Minister, present Home Minister, D.Subba Rao, the than Finance Secretary, present RBI Governor, Dr.Manmohan Singh, the most ineffective, inefficient, puppet PM of the largest Democracy in the World, TAK Nair, the than principal secretary in PMO, presently Adviser in PMO, Pullak Chatterje
