New Delhi, Mar 1(IANS): Alleging that "prosecution is under pressure" from Delhi Chief Minister Sheila Dikshit, Delhi BJP leader Vijay Jolly Wednesday moved a Delhi court to oppose the police decision to withdraw the case against Dikshit for allegedly violating the Election Code.

Jolly moved his application in the court of Metropolitan Magistrate Sudesh Kumar, requesting that he should be allowed to intervene in the proceedings as one of the complainants.

The magistrate listed the matter for March 5 because the concerned additional chief metropolitan magistrate (ACMM) hearing the case was on leave.

The court was hearing an application of complainant and Samajwadi Party candidate Om Prakash that Dikshit had violated the Election Code of Conduct during the poll campaign of November 2008 by using loudspeakers without permission.

On Feb 6, Delhi Police moved an application for withdrawing the case, saying that no loudspeaker or other accessories were seized during investigations.

Jolly, who had contested against Dikshit in the 2008 Delhi assembly election, opposed the withdrawal of the case by the police.

Jolly said: "The prosecution, under the influence and pressure of the accused, who is the chief minister of Delhi, has moved the present application for withdrawal of the case. This is against natural justice and fair play, and it is also a violation of the directions issued by the constitutional body (Election Commission)."

He told the court that police officials were eyewitnesses to the use of loud speakers and loud hailers by Dikshit Nov 14, 2008, without the permission of the Election Commission.

He requested the court to take action against erring police officials, who did not seize the illegal equipment at the time of its use.
