Cabinet Passes Bill Granting Wife Right in Husband's Property

New Delhi, Mar 23 (PTI): A Bill seeking to give a woman a share in her husband's property was approved by the Union Cabinet today.

Apart from giving women the right to their husband's property, the Marriage Laws (Amendment) Bill, 2010, also aims at giving rights to adopted children on par with biological off-springs.

The cabinet meeting was chaired by Prime Minister Manmohan Singh.

The Marriage Laws (Amendment) Bill, 2010, was introduced in the Rajya Sabha in August two years ago and then referred to the Parliamentary Standing Committee on Law and Justice and Personnel.

Supporting the Bill which sought to make "irretrievable breakdown of marriage" a new ground for grant of divorce, the Standing Committee had in March last year opposed doing away with the prevailing waiting period before moving a joint motion for annulling marriage.

Partially accepting the recommendation, the government has now decided the cooling off period will be decided by courts.

According to the redrafted Bill passed by the Cabinet, adopted children will have rights on par with biological off springs of a couple in case the parents go for a divorce.

The government has also accepted the recommendation of the parliamentary committee that women should have a share in the property of her husband in case of a divorce but the quantum of share will be decided by the courts on case-by-case basis.

According to the Cabinet Note, while a wife can oppose a husband's plea for a divorce under the new "irretrievable breakdown of marriage" clause, the husband will have no such rights to oppose if the wife moves the court on the same grounds.

    This amendment violates the basic rights of all men to acquire and live in his own property. If it is a women right to share her body and mind with a person whom she likes, it is a man’s right to share his hard earned property with a person whom he likes.For the purpose of divorce, he cannot sell his property and stand on roads and slog for the rest of life in a uncomfortable home with the available money.

    Why should a husband share his property with a wife who is not interested to share her life with him. If a wife doesn’t want her husband, then why does she need his property alone.

    This is anti-male law which is passed by incompetent lawmakers without much thought. When a law is passed, it should consider both the sides of a coin & it should be neutral to both the parties. If it is one-sided, then it shows the incompetence of the person who drafted it.

    Just to own a Rs.40 lakhs flat, men become indebted for life by taking a loan and work as slaves in private companies day and night sacrificing many things and spending sleepless nights. When men puts so much efforts for years to acquire an asset, these people just come and walk away with hard earned property very easily. They don’t want to work hard but rather sit and enjoy on somebody else hard earned money.

    This law is basically framed to harass men and to make men as slaves of women. Apart from being a slave in the company, they also want to make men as a slave at home also.

    Already so many laws were passed against men and they still being misused by women. These law makers are crossing their limits & if men keep quiet generously, they misuse it and start passing as many laws as they can according to their own will and wish. Unless men stand united and fight against these incompetent law makers, feminist evils and women activist, this will continue forever.

    This particular law is so biased against men. Any woman can marry a rich man stay with him for sometime and than ditch him, go to court, part with his hard earned wealth, marry some one else & live lavishly with poor ex-husband's money. Women can oppose husband's plea for divorce where as men can not do so. There is no equality. This is injustice.

    UPA has not killed any Mumbai attackers. It is our army who killed terrorists in battle.

    This Law is good for the Lawyer where they also can Extract money along with the Party filing for Divorce.One of the Victims of the false Dowry Act. Where had to pay hughe amount to Compromise and get Divorce. Thank God this law came after I got My divorce.Otherwise had to spend all my hard earned earning to Share the Property.God only save this Country and Mankind.

    Sonia Gandhi need to introduce one more law to protect terrorists to keep them as reserve to exchange, when ever our flights are hijacked. I am sure all BJP politicians starting from Advani to modi will adopt one foreign terrorists. Local indian terrorists they like to kill in encounter. Similar to what Butcher Modi did in the past. Even can burn in running train like Godhra.

    Stupid Law.It will only encourage bad wives to do more bad things to their good husbands.The law should also give equal rights for husbands in wife,s property.In todays world there is no love but only selfish mentality prevails.If that was not the case these type of laws need not be implimented.

    This is family business and any law that would protect the civil rights of women are welcome. Wife will have a share in husbands property is alright. But how about the citizens share in our national wealth... Why the politicians are looting our country and hoarding ill gotten wealth in banks outside our country. Neither these funds are available to our country for its development nor we can own it...Foreign countries are developing by using our funds hoarded in their banks..Why not immediately bring a anti corruption law or strong lok pal bill that paves the way to punish our corruput politicians and bureuacrats......The countrys wealth is its citizens wealth and it cant be consolidated in few hands by illegal means... Kranti is the need of the hour...May the politicians greed for more wealth rest in peace....

    Govt will soon pass RESCUING TERRORISTS bill. They are already rescuing terrorists, only bill has to be passed..

    The Bill is going to say "If anybody wants to adopt terrorists, they will be given benefits from Govt like insurance, monthly income, free travel in air/train, a congress MLA/MP ticket".

    Sonia Gandhi has already adopted Kasab and taking these benefits from Govt. She is planning to adopt more in future.

    This is bill is being passed for "CONGRESS MINORITY VOTE BANK"

    This is a very good news for 'Home makers' who in case of home break are left on the streats. It is not the only earning man brings in wealth but the home makers safe guards home and takes care and brings up the siblings. The property as a whole belongs to both the spouses so shoud be shared by both equally in case of unfortunate separation. And this should be extended to all communities, castes and creeds as women anywhere face the same situation.

    Very very good. Even Non working house wife taking care of children, eventhough husband is earning for the family, she deserve a share along with children. Rather I will say, husbands should keep all their property in joint name of their wife. Ardhangin should have exactly half share. She too should be secured of her future if anything happen to her husband or even if she is divorced! Thanks to Mrs. Sonia Gandhi who take care of woman of India.

    Both husband and wife should have same rights, if this law is passed people will go for live- in -relationship rather than have marriage. Just imagine a case where wife is mentally sick, some poor guy to pay half of his wealth to part away from this problem.
