SC Strikes Down Haj Subsidy, to be Eliminated Within 10 Years

New Delhi, May 8 (PTI): The Supreme Court today struck down the government's policy of giving subsidies to Haj pilgrims and directed that it be progressively "eliminated" within a period of 10 years.

"We hold that this policy is best done away with," a bench of justices Altamas Kabir and Ranjana Prakash Desai held. The bench also directed the government to reduce to two the number of its representatives in the Prime Minister's goodwill delegation.

It said it will look into the functioning of Haj Committee of India and it process for selecting people for Haj pilgrimage. The apex court was hearing an appeal filed by the Centre challenging a Bombay High Court judgement which had directed the Ministry of External Affairs to allow certain private operators to handle 800 of the 11,000 pilgrims earmarked under the VIP quota subsidised by the government.

The bench while hearing the plea of the Centre had expanded the purview of the plea and decided to look into the legality of the government's policy on granting subsidies to Haj pilgrims.
During the hearing in the case, the Centre had defended the policy of giving subsidies to the Haj pilgrims and had said it had framed guidelines so that people get subsidies only once in their lifetime.

In an affidavit, the Centre had told the court that it has decided to restrict Haj pilgrimage at government subsidy to Muslims only as a "once in a lifetime" affair as against the existing policy of "once in five years".

It had said the new guidelines have been framed to ensure that priority is given to those applicants who have never performed Haj.

The government, however, had refrained from disclosing the amount of subsidy being incurred by it for 2012, saying, "The exact figure in respect of the travel subsidy to the pilgrims going through Haj Committee of India for 2012 will be known after the Hajis completed their Haj journey and return to India."

The apex court had earlier expressed its dismay at the practice of sending official delegations to accompany the pilgrims and had asked the Centre to furnish entire details regarding Haj subsidy, as also about the criteria adopted.

"These goodwill delegations need to be scrapped altogether. They are no longer relevant. Even a team of 9 to 10 persons is not required," the bench had observed.

The bench had also pulled up the Centre's practice of "politicising" Haj by permitting official delegations to accompany the pilgrims, for which the government offers huge subsidy, saying, "It's a bad religious practice."

    Haj has to be performed with own hard earned money after paying all loans. Should not keep any differences with any one. Cannot do haj with borrowed money or subsidy. The obligation is not fulfilled.

    It is not reasonable to expect people from far away lands can perform hajj without some financial help. hajj subsidy should be offered so that people can perform sacred hajj visit. it is important that younger people be also given priority, people enrich spiritually after performing hajj, these very people will uplift the society and hold everyone together and will lead to harmony. But before becoming a haji, you would need to qualify by doing noble deeds for improvement of society.

    For different religious followers,
    they have their sacred places to visit, and if financially capable to fulfill that spiritual obligation, that is a very satisfying spiritual experience of life.

    This must be undertaken by the rich
    people of each religion in helping the less privileged believers. The government has to keep away from financing such issues which will create greater confusion.

    Please Note that, Wakf Property income is own source of income of Indian poor Muslims, and just managed by Govt and Govt have to distribute them for their life dream obligation in the name of subsidy or whatever.

    I believe it’s not worthy to ask subsidy from government but to generate own source of income to offer Haj.

    Very good decision by SC but same time poorest of poor will suffer most. Every Muslim at least once in a life time should visit Makkah & Madeenah as per their religious belief. Congress Government started Haj Subsidy with good intention as well as hidden agenda to garner the Muslim vote bank too but it went way weird since system has been misused by powerful Muslim Politicians and Leaders by offering the subsidy system to their friends and relatives only. And now ill works of few people will be borne by all Muslim community which is not a good sign for Indian culture

    The government's policy of giving subsidies to Haj pilgrims are diverted by various Govt and private agencies and finally the benefits to the Haj Pilgrims is a peanut.
    The Govt should also stop providing funds to so many loss making companies and several welfare programs that are a Big White Elephants on Tax Payers.
    The department of public enterprises ––the nodal body for policy formulation for state-owned firms –– has listed 46 central public sector enterprises as sick and loss making. Another 26 subsidiaries of these firms are also included the list. These include National Aviation Co, National Textile Corp, British India Corp, Cement Corporation of India, Indian Drug and Pharmaceuticals, Konkan Railways Corp and MECON.
    Much before the Parliamentary Standing Committee on Finance (SCF) could publish its report there have been continued opposition against the Aadhaar project run by Unique Identification Authority of India. There is not even one kind of encouraging word mentioned in the SCF report on how Indian society can use Aadhaar to deliver several welfare measures approved by the parliament to the poor. This is because the political class (which prepared this very report) is the biggest beneficiary of black money generated by diverting PDS kerosene and residential LPG as well as from the misuse of several welfare measures like Mahatma Gandhi National Rural Employment Guarantee Act (MNREGA), Below the Poverty Line (BPL) schemes and the like away from the true beneficiaries.

    Operation of Haj Flights by Air India.

    hri Ajit Singh, the Minister of Civil Aviation informed Rajya Sabha today in a written reply that NAS Air, which was the ed airline to carry pilgrims from Srinagar on the basis of the tendering process, had entered into an agreement with Air India to carry pilgrims on the Srinagar-Delhi-Srinagar sector at the fare of US D 450 per pilgrm. Air India was paid by NAS Air for their services.
    The Minister further informed that the airline chosen to operate Haj Services was on the basis of tenders in which Air India as also other Indian airlines were invited to participate. The lowest tenderers for each sector were chosen as per procedure.
    During the years 2007, 2008, 2009, 2010 and 2011, Government of India has spent an amount of approximately Rs 477, Rs 895, Rs 690, Rs 600 and Rs 605 crores (excluding service tax) as subsidy on air travel of haj pilgrims, the Minister said.

    Landmark judgement. Big blow to the politicians who capitalised on the releigious sentiments of the people on what is rightly called Vote bank Politics. Further, if it is to appease the minorities, event he christians should have some subsidy to visit the holy places. In a democratic set up - all are equal. High time reservations for SC & ST's also removed. The earlier the better.     New Delhi: The Ministry of Civil Aviation has shortlisted two private carriers to operate the flights for Haj 2011.

    “Saudi Airlines and NAS Air have been shortlisted for this year’s Haj operations through tendering process,” said a ministry official.

    While Saudi Arab’s national airline Saudi Airlines had quoted the round trip fare per pilgrim between $ 1,050 and $ 1,200, NAS Air had quoted $1,300-1,500. Air India — the lone Indian bidder which used to ferry Haj pilgrims till 2010 — lost out for the tender by quoting $ 2,000 return fare per passenger.

    The two airlines had operated Haj flights from India last year too along with a third carrier, Alwafeer Air.

    The Memorandum of Understanding with these carriers is likely to be signed within a week, the official indicated.

    Meanwhile, the government’s Haj subsidy bill is set to reduce further as the total bill for ferrying 1.25 lakh Haj pilgrims this year is expected to cost the Centre under Rs 500 crore as against Rs 575 crore in 2010.

    Haj Subsidy has always been a support for vote-bank politics as alleged by sangh-parivar. It has been a bail-out for loss making National carrier AIR INDIA. Muslims are not desperate for this subsidy with a restrictions to travel only by AIR INDIA. It is cheaper for Haj Goers if Govt. eliminates Haj subsidy and allows other airlines to accommodate the haj-goers. Btw, Why eliminate in 10 years why not earlier??

    The so called subsidy is a cunning drama by the Government run Air India. No subsidy nor charity to the pilgrims given by the Government. Instead its a master pal to loot the Huj pilgrims. Please note following facts .

    1. 11,400 pilgrims allotted through Government run Huj committee. All these 11,400 pilgrims are leaving India within a short period of 15 days. Air India getting this booking directly from the Huj committee thus saving 8to 14% commission normally it pays to its travel agents across India.
    2. Air India collecting the Air fare from the pilgrims 3 months in advance and later finding the cheap and sick flights from backward Europian countries for operating in India on favour of Air India.
    3. Huj pilgrims are the main source of Air India s income. It would have bankrupted long back if the freedom of choosing the flights given to the pilgrims or any private flight operators.

    HUJ SUBSIDY IS A POLITICAL GAME. NOTHING DOING WITH THE PASSENGERS. YOU CAN ABLE TO FLY NEWYOK UP AND DOWN PAYING ONLY Rs.37000 , its 14 hours flight but you need Rs.29000 to fly Up and down Dubai its just 3.5 hours fly.

    AIR INDIA FOOLING PEOPLE. ITS SOMETHING LIKE LOCAL CITY BUSES. NO FIXED TARIFF. RATES WILL BE FIXED BY THE CONDUCTORS.

    PLEASE COMMENT ON THIS AND GET AWARENESS ON THE SO CALLED HUJ SUBSIDY.

    Very good decission by the supreme court and its a land mark decission in the best interest of Indian Muslims...God doesnt burden his servants beyond whats given to them by Him. Only affordees perform hajj and poor remain home. If you dont have money, please dont go to hajj. Why to seek Gods pleasure from tax payers money. Hajj needs to be done by a muslim spending from his legal, pure, pious and clean earnings....One cant perfom hajj from the monies earned from alcoholic business or from monies earned by illegal means..God knows whats the source of such money...Performing hajj is not the ultimatum, but it should be accepted by God...... Being a proud citizen of India, I welcome the decission and the judge who passed the decission is muslim...otherwise whole of my community would have cried foul against the judge as biased and communual...One cant beg and perform the hajj. Let the haj be for seeking the plesure of God and not for any show off...haj is madatory for a living muslim adult during once in his life time. But I have seen many a muslims are performing hajj more than once. If they have funds they can perform umrah many times and for hajj they can send less previliged so that God is pleased with both the financier and the performer.. Will anybody think.. Only want to show off their wealth...Hajj performed by difficulties earns more blessings than hajj performed with all luxuries, comforts and easeness..

    We welcome the SC decision. Subsidy for Haj Pilgrim is just eye wash and using religious sentiment by political parties. First of all Haj is compulsory once in life time to those who has sufficient fund to bear the expenses of travelling. So it’s clear that no Haji demand for subsidy. Secondly if a Haji travel through a private travelling agents he is getting better facelities than through Government agency for the same money which he pay to Haj committee. We prefer to travel by Jet Airways (private ) than Air India (with subsidy for same rate). So my request to all brothers and sister of my beloved India , please understand the above point and accept SC decision in positive way instead of making another big issue. May Allah bless all our Haji’s to perform their Haji with Halal resources.

    Goodwill Hajj delegation is only comprising of Politicians and powerful people which is uncalled for and loss for exchequer.I am of the opinion that this SUBSIDY issue is always a cause of contention and tool of attacks on Muslims by Sanghparivars.I welcome the decision of SC, timely and meaningful.
