Supreme Court Upholds Kasab's Death Sentence


New Delhi, Aug 29 (IANS):
The Supreme Court Wednesday upheld the death sentence of Ajmal Kasab, the only Pakistani terrorist caught alive after the 26/11 Mumbai strike that claimed 166 lives.

"We are constrained to hold that the death penalty is the only sentence that can be given in the circumstances of the case," the apex court bench of Justices Aftab Alam and C.K. Prasad said.

Kasab, one of the 10 Pakistanis who sneaked into Mumbai on the night of Nov 26, 2008 for a terror siege of the city that ended on Nov 29 afternoon, had moved the apex court challenging the death sentence by a trial court, which was later upheld by the Bombay High Court.

The court rejected Kasab's contention that the Mumbai terror attack was a war against the government of India and not against the Indian state or its people.

The court said the government of India was only the elected organ of the state and the repository of the sovereign powers.

Having said this, the court added: "Primary and foremost offence by the accused (Kasab) was waging war against India."

The apex court did not accept Kasab's plea that not providing him a lawyer soon after his arrest vitiated the entire process, including his trial and consequent conviction and sentencing.

It also noted that efforts were made to provide Kasab a lawyer but he refused it every time, saying that he did not need an Indian lawyer.

The court also rejected his plea that when he agreed to have legal assistance, his lawyer was not given sufficient time to prepare his defence.

The judgment said that the time given to Kasab's lawyer was "sufficient".

The court also rejected Kasab's plea that his confessional statement before the police was not voluntary.

The judgment said: "Confession was very much voluntary."

In a concurring judgment giving additional reasons for upholding Kasab's death sentence, Justice C.K. Prasad said that it was crystal clear from the oral and documentary evidence that the conspiracy for the 26/11 attack was held by Pakistanis in Pakistan and executed in Mumbai going by the devastation caused.

The court also upheld the acquittal of Fahim Ansari and Sabauddin Ahmed who were accused of providing topographical inputs to Kasab and his accomplices prior to the 26/11 attacks.

The Maharashtra government had challenged the acquittal of Fahim and Sabauddin by the Bombay High Court.

The Bombay High Court had upheld Kasab's death penalty Feb 21, 2011.

Kasab was sent to the gallows by a Mumbai trial court May 6, 2010. Besides other charges, he was convicted for waging war against the nation.

An apex court had reserved the verdict on the conclusion of arguments that spread over nearly three months, starting Jan 31.

Kasab and his nine associates who had sailed from Karachi reached Mumbai after they hijacked private Indian ship M.B. Kuber and killed its navigator Amar Chand Solanki.

    Understandably most readers would like to see Kasab hanged, but this guy was just a brain washed foot soldier. Hanging Kasab is a small part of the issue, but bringing his handlers in Pakistan and around the world to justice should be the main issue. The handlers of these 10 foolish men who planned and uted the attack are living happily in Pakistan, and could plan further attacks in India.

    Thus the main challenge to the Indian government and people should be to extradite their handlers, bring them to India, try them in a court of law and only then justice will truly be done.

    I do respect your obvious choice of bringing Kasab to his death. He surely deserves it. But don't you think by doing this we will destroy the ONLY lone terrorist who has plenty more to spill! Time will show us that by keeping him alive Indian agency has got more info than ever. At the same time, SC must have definitely looked into the cost of having Kasab alive. But let’s not forget that acquiring secret information isn’t economical!!

    Unfortunately now the Microsoft company has to change the names of their two new softwares developed last year. Because they had named these two softwares as "Kasab & Afjal Guru", since these two Softwares were developed so meticulously that never get 'Hanged'. The Microsoft had named so thinking that Kasab & Afjal Guru will never be Hanged by Indian Govt under any circumstances. But MS may be proved wrong atleast in one Case out of two.

    Mr. Kasab's death sentences has to be in accordance to the Islamic Shariah Law. Because he is from Pakistan.
    According to sharia law his head has to be chopped in front of thousands of people in a big ground. As per quran " a person kills an annocent, it is an equallant that he killed entire human being".
    Let us see his death sentences to be carried by our court as soon as possible.

    From terrorist point of view,he wages Jehad to die and become martyr so that he will get Jannath as promised. They do all these things ultimately to reach death only.
    Giving death sentence will make him as well as entire terrorist community happy and he will be remembered as a hero. Instead make him to suffer and rot in jail till he dies naturally.

    Hang him fast. Are we waiting for another attack? Our judiciary system is hopeless. These kind of crimes should be dealt with in a swift manner and not to prolong this issue further. No mercy should be shown towards these terrorists. One more is Afzal Guru. Both should be hanged together that too infront of public.

    This is a big disaster for India. Why Indian law keeps him in VIP treatment here. He had given a top class security which lost crores of india Treasure. This is the right time for us to wake up and protest to close the chapter. At least we can utilise the fund which is spending behind him for Development of poor villages. This can be a good reason for protest instead of Home stay attack or pub attack.

    No doubt this verdict is very much predictable due to grave crime involved but will India ever put those death penalty awarded convicts to gallows? I doubt, during Kasab’s life time he will never face gallows in Indian Soil since there are 50 convicts awaiting gallows before Kasab’s case comes for ution. Many applications still pending for mercy at Presidents Palace Office for approval. Some even die naturally before their ution dates fixed.
