Prison Term Soon for Sending Porn MMS


New Delhi, Oct 11 (PTI) : Soon, sending a pornographic multimedia message and emails may land you in jail for a maximum period of three years.

The Union Cabinet, at a meeting chaired by Prime Minister Manmohan Singh, approved amendments to the Indecent Representation of Women (Prohibition) Act (IRWA), 1986 which also proposes to slap hefty fines on persons found guilty of such acts.

"The amendments broaden the scope of the law to cover the audio-visual media and material in electronic form," an official statement said here.

The amendments were necessitated as the current act covers only the print media.
The changes also enhance the amount of fine to be slapped against persons found guilty of such acts from Rs 2,000 to a minimum of Rs 50,000 going upto Rs one lakh for the first conviction.

In case of repeat of the offence, the imprisonment may extend to seven years and a fine between Rs one lakh and Rs five lakh for second conviction.

Police officers not below the rank of Inspectors are authorised to carry out search and seizure, in addition to State and Central Government officers authorised by the State or Central Government, it said.

These amendments seek to ensure that more effective protection is provided against indecent representation of women by covering newer forms of communication like Internet, multimedia messaging, beyond the print and audio-visual media, it said.

"This would aid in addressing the problem of increased objectification of women thereby ensuring dignity of women," the release said.
The IRWA was enacted with the specific objective of prohibiting the indecent representation of women through advertisement, publication, writing, and painting or in any other manner, the official release said.

However, over the years, technological revolution has resulted in the development of newer forms of communication such as Internet and satellite based communication, multi-media messaging, cable television, it said.

It has, therefore, become imperative to widen the scope of the law so as to cover such forms of media, on one hand, and to strengthen the existing safeguards to prevent indecent representation of women through any such form, the release said.

Extensive consultations were held with stakeholders including lawyers and civil society organisations on the draft Bill, before its finalisation, it said.

    After the Law comes in force-
    Don't lend your phones, sims & any gadget that is capable of sharing these to any friends as it might land you in big trouble.
    Hackers have used others IPs even in case of terror attacks, just think what might happen to illiterates(computer) should they be used as smoke screens?

    Heinous crimes against women like brutal murders, gang rapes, molestations, forced abortions & child abuse in many cases go unpunished. The criminal justice system in India is slow, weak and corrupt because of which justice is either delayed or denied. Not sure what the point is in having new laws when we do not have the appetite or an efficient mechanism to enforce existing laws for much more serious crimes.

    this is funny.... this law is made only for the common man.... these ministers can afford to hav fun with 101 kps n so therz no need 4 them to watch porn.
    Banning porn sites or prostitution will create more problem to the decent innocent women, as there would b so many desperate guyz around them with evil eyes... Number of rapist will only increase..

    what if girl sends the porn , she is punished too?. How one can trace the origin of MMS , in cluster of cell phones. Porn is available internet and its a good business amounting to billions worldwide. Far western countries legalised it. I feel as long as demand strives , supply persists. This law only vl make police wallet fatter. @ Lydia lobo , Punishment for rape already in place , @ R . Bhandarkar , chautala made valid comment . Khap panchayat should have right to decide ....... Its been already 15 in some communities . Have u visited countries like brunei and yemen?

    Porn MMS can be d and ignored just like a wrong number or missed call, but how to or hide the unavoidable streams and oceans of such information in the WWW and vast electronic media?
    Who can punish, control and stop that?
    Human conscience only can decide and control that. When human looses senses, he commits in human cruel crimes, which we see and face today.
    Who are the poor victims? How can we handle the situation and solve the crisis?

    Interesting that the amendment has come to the IRWA act has come at a time when 'Rape a day' has become the 'Order of the day' in Haryana and it's former Deputy CM comes out with a solution to marry off girls at the age of 15 to prevent it! Come to think of it , these amendments may look strong on paper but when it comes to enforcement many 'loop holes'
    are detected by 'brains' who are paid just to thwart such laws! No use -this....
