Court Issues Non-Bailable Warrant Against Mallya

Hyderabad, Oct 12 (IANS): A city court Friday issued a non-bailable warrant against business tycoon Vijay Mallya and five others in a cheque bounce case.

The 13th Metropolitan Sessions Court issued the warrant against crisis-hit Kingfisher airlines in a case filed by GMR Hyderabad International Airport Ltd (GHIAL), which manages the Rajiv Gandhi International Airport here.

The case was filed in August by GHIAL after four cheques of Rs.10.3 crore issued by Kingfisher towards user charges bounced.

The court issued the warrant after Mallaya failed to appear despite summons issued to him. The liquor baron reportedly sought exemption from personal appearance as he was abroad.

The respondents in the case include Kingfisher, its chairman Mallya and CEO Sanjay Agarwal.

Kingfisher had issued cheques to GHIAL towards airport user charges which include parking, landing and navigation charges.

The crisis-hit airlines faces similar cases in Mumbai and Delhi after the airport operators moved the court over dishonoured cheques.

    Vijaya Mallya - When U were just 22 yrs old boy, U went to your family temple near Bantwal with Ur father Vital Mallya. There the Priest asked you both to donate one ceiling Bell for the temple. U suddenly jumped out and told Ur secretary to donate 100 bells on Ur behalf. But Ur father Vittal intervened and told U that the Priest has asked for only one Bell and also this small temple requires only one bell, and U should not be extravagant anywhere whether it is temple or business, do only what is quite necessary and give only what is required.
    Had U remembered this sane advice of Ur father, today U would not have been in trouble.

    Dear Daiji readers, please note that King Fisher is an Limited Company. Mallya had sold part of his share holding with huge profit while listing the company. After listing the company healong with his management enjoyed all the facilities from the company. The loss is for common share holders who bought the shares at higher price and also common citizens who has shares of banks who gave huge loan to the airlines.Now company will be bankrupt and Mallya need not pay anything from his pocket even though he has Billions of personal wealth. This is Indian corporate law. Poor readers are sympathising with the businessman without knowing such things. Most of the Limited company management is same. With share holding of 10 to 50 percent they are enjoying all the facilities.

    Among the country’s three listed airlines also, Kingfisher CEO Sanjay Agarwal’s pay package was the second highest in the last fiscal ended March 31, 2012, as per the remuneration details provided in their annual reports. But when it’s come for normal staff there is no pay.....

    KF's CEO reportedly one of the hoghest paid CEOs in airline industry. If he could not bring the Airline out of trouble all these years, Mr. Mallya should think of revamping his management team including replacing CEO. In many companies CEOs work for their own perks and benefits rather than in Co's interest. As long as the Co's profitability and liquidity is good these CEOs keep on increasing their pays. Once the Co is into trouble they will not even know about what to do. It is disgusting that the crisis was dragged to this level instead of being addressed at the initial stages itself. There looks to be serious flaw in planning, forecasting and monitoring at the macro level.

    We done Mr Mallya, You will get 10 year term. Our indian well learned lawyers will do the orgivement that cheque is theft from your custody law is logically adequate wine. The section 138 will settle is 90 days but after judgement the Criminal apheal should not settle in 90 days it will get more 5 years this is indian law

    Risks, cheque bouncing is part of business Part of ups and down Don't worry too much on this. Still airline running thier business. It is you n me need to worry when when we are not in business and no other income and cheques starts to bounce. Normally business person has portfolio they don't put all eggs in one basket.

    Non bailable warrants are just for namesake and invoke fear. Person can easily get warrant in court , even for non bailable offences . Difference betwean bailable and non bailable , in previous police themself can issue bail orders. It vl b cake walk for malya. Eg: violation of child marriage act is non available , but one can get bail from court with the surity of amount. If u have money , u get bail.

    Mr. Mallya is really facing the toughest crisis of his life! He has done his best to keep the airline afloat, but things took a change for the worse and irreparable! Now no businessman would sell an 'inherited business' on which his existence depends and pump the entire money to bail out KFA with no guarantee of any profits for another 5 years!! I agree with Dr. Kamath-Mumbai views! When the going was good there were 1000s of freinds and well wishers to fan him today when he is in deep trouble, the same people are not even ready to take his name!!This is the harsh reality of life which one has to experience, coz to talk it is easy!! As they say "Success has 100 fathers, failure has none"!!

    I think nobody has a right to talk about anybody's personal life! All businessmen are almost the same, but VM is open & flamboyant, not secretive!

    I hope and pray something works out and both he and KFA are bailed out soon!!

    I have no even slightest doubt in mind that sri Vijaya Mallya business tycoonwill bounce back to normalcy sonner or later as the situation in KFA is of technical nature only.As rightly asserted by Dr.Kamath, rich businessman like Mr.Mllya is an assest to any state.He is pride of our state in particular and country in general.Thousands of people will continue to earn their bread through his various business ventures through out.Bad times will turn into favourable very soon.
