Drunken Driving by Mangalorean Woman Kills One, Injures Three

Mumbai, Nov 4 (Agencies): A 35-year-old woman was arrested for allegedly ramming her luxury BMW car into an autorickshaw under the influence of alcohol in suburban Mankhurd, injuring four persons, including a woman, seriously. One of the four injured died in hospital later.

According to police, BMW driver Aarti Shetty, a Mangalorean, who was driving the car at a very high speed, lost control and rammed the vehicle into an auto rickshaw, injuring its occupants Mohammed Ali, his wife Mobina Zahir Ali, son Mohammed Raza and auto driver Nasir Sayyed early morning on November 1.

Mobina Zahir Ali died at the civic-run KEM hospital here at about 2.15 AM, said S G Rajput, Senior Inspector, Mankhurd police station.

Shetty was under the influence of alcohol at the time of the accident which took place on Sion-Panvel Highway in suburban Mankhurd, police said.

Shetty, who was going towards Navi Mumbai at around 4.30 am, did not stop her vehicle even after hitting the auto and tried to flee from the scene only to hit a dumper parked on the street.

Shetty has been booked under sections 279 (rash driving) and 338 (causing grievous hurt by an act endangering life or personal safety of others) of the IPC and section 185 (drunk driving) of the Motor Vehicle Act.

Shetty, who was granted bail, has also been booked under IPC section 304 (culpable homicide not amounting to murder), police said. However, the offence under the section 304 was also bailable, police added.

Shetty, wife of a logistics businessman, was also undergoing treatment for injuries at a private hospital.

    Whether Mangalorean or Madrasi, inspite of several drunk driving cases taking several innocent lives, there is no let up due to laxity in our laws. Put this woman in jail till her end. Such severe punishments only will deter drunken driving. I am sure, she willbe let off easily.

    Common man at the mercy of spoilt and rich as usual. Drunken driving is not new to city of Amchi Mumabai. Lady belongs to a rich family who are loaded with cash. There is definite bias in granting bail. Judiciary has no eyes ! Media and Public need to act NOW. Yes punishment will take a long time and it will be ridiculous.

    All the comments are against rich. This is good. But those who comment should also think of ways of how to reduce inequality. 80%of world's wealth is in the hands of 2% people. These 2% form laws, break laws and amend laws to their like. Please ban liquor or all alcoholic drinks. Please vote a party which promises ban on alcoholic drinks, Gutkha, cigarettes etc. The present system of selfish world can be compared to a man who has fallen into a cow dung pit and tries to clean himself without actually coming out of the pit!

    I totally agree with R N Pujari's views!! This party appears to be very rich and influential and all this hoopla of the incident will be over just as the Salman accident case which recently was opened up by YP Singh on how it was suppressed!!

    Incidentally in another case, read on MUMBAI: NRI beauticianNooriya Haveliwala was on Thursday convicted by a special NDPS court for mowing down two persons, including a policeman, while driving her SUV under the influence of alcohol in 2010. She was awarded 5 years in jail by the court.

    The court also slapped a fine of Rs 5 lakh on Haveliwala.

    The court, however, acquitted her of the Narcotic Drugs and Psychotropic Substances (NDPS) Act charges.

    The NDPS court judge I M Bohri will pronounce the quantum of punishment later in the day.

    Nooriya was taken into custody soon after the court held her guilty under section 304 (II) for culpable homicide not amounting to murder, Motor Vehicles Act and Prevention of Damage to Public Property Act.

    It is the prosecution’s case that on January 30, 2010 Nooriya rammed her SUV, killing two people and injuring three others. She later tested positive for drugs and alcohol.

    Also a couple of years back another person Alistair Pinto was sentenced to imprisonment even after he knocked on the doors of the apex court!!

    It clearly shows rules for the rich and the commoner are different and we are just mute spectators!!!

It seems to me that she preplanned and drunk on purpose and drove rashly to hit that Auto and Kill them. I am not saying that she did a right thing, but we are human's we all commit mistakes. Paying SR 100,000 or even a millon will not bring the life back. She was drunk, careless and driving rashly which is her fault, she should be punished for that.     Its the hightime to make atleast IPC sec 304 non bailable or make it bailable under surity of 'blood money'. Govt should consider seprate legal provision for these case , amounting to atleast seven yeras in jail . The mockery of justice is that minor offence like domestic violence or PCMA 2006 are not bailable , but killing someone is bailable. One can shout at wife and got to jail but kill someone and get bail..........//Just letting off so easily will make this middle aged woman serial offender of this crime , may cost more lives. Most of times if victims r poor they settle for certain amount money but stedfast one fight with the case in court. If the person is died , amount equal to his\her whole life income should be given to dependents. If person is crippled or handicaped , all his medical expenses and his life time regular expenses , also above normal expenses should be born by convict. ..... ....// If some one believes law is not doing justice and 'payback' for loss of dear ones. Take a old truck and hit on the convict , hit them hard ( organized crime) And get bail on the same counts. MUNICH JUSTICE!// .......... also avoild midnight or early morning walk or bike riding specially on posh places like carter road , link road , or even certain places near to pub or studios etc , it can cost of ur life. And those want to do racing and wheeling there is better place do it , away from public.

    BMW driver is Arati Shetty, wife of big businessman. Drunken driving is culture. Where are the Mangalorean culture buffs ? No comments or sermons from any of them ?

    It is not this culture or that culture, it is the person and person only. so we cannot blame Mangalorean culture or American culture. It is a wilful mistake.

    Hence two principles which all of us have to observe,

    do not use mobile while driving
    do not drive when drunk.

The end result is, family members try to spend this easy money in wrong ways, drinking, driving, show off, bad company etc. This appears to be one such case. Moral of the story is, if you have wealth, do not try to display it or waste it on family members. If you dont have means to spend it, give it to charity.
