Gang-rape Case: Accused Moves SC for Shifting Trial out of Delhi


New Delhi, Jan 19 (PTI): One of the six accused in the December 16 gang-rape and murder case has pleaded before the Supreme Court for shifting the trial outside Delhi saying that free and fair hearing is not possible here because of strong public sentiment against him.

Mukesh, who has been charged with murder, gang-rape and unnatural offences, submitted in his petition that in view of regular agitation, police and judicial officials are under pressure to pass an order according to the demand of the agitators and fair hearing is not possible.

"The sentiment has gone into the root of each home in Delhi by which even the judicial officers and state are not spared and in these circumstances, he cannot get justice in Delhi at all," the petition, filed through his advocate M L Sharma, said.

"The case has been assigned to the fast track court which is going to start from January 21 and due to media reports and agitations conducted by the media and others and due to political statements and personal interest shown by the chief minister as well as various cabinet minister, judiciary is under pressure to work against the petitioner. Therefore the petitioner has filed the petition for transfer," it said.

"Due to media trial and day-to-day agitation, the subject matter has gone into the root of each house in Delhi. Petitioner's counsel is also under serious threat and even in the court room he has been declined to be heard properly," the petition said, pleading the apex court to transfer the criminal case Mathura in Uttar Pradesh.

    Every criminal deserves fair jutice. Media and public are like a witch hunt , trials cannot be influenced by such kind of things. Its a democracy and lawyers have equal rights to defend them . I feel amnesty international should intercede as his about human rights too.

    @ kevin , mangalore , texas . Yes , even dreaded criminals deserve fair trial. Even kasab did. I defend all my comments , whether its been endorsed by others or not , does not matter. And about the case about mumbai , yes even 90 something gradpa also has right to elope . M not agist and not socially conditioned like majority. We only create morals and some peaple have different yardsticks. Lastly i just don't comment to provoke or to get comments ( i have better job to do ) , its not troll , my name is full , u can check my credential elsewhere on the net. If u don't like comments , you can just ignore it.

    There shouldn't be any leniency in granting a lifetime jail, if not a death sentence to all the six criminals.

    I guess, jail is the safe place for them because even if they come out on bail, public will handle them properly.

    what kind of justice the culprit is expecting from the court??? What the hell is going on??? No need of any hearing...straight come to the conclusion and announce the final judgement. These creatures are spreaded everywhere...and after doing such a cruel act..he is hoping for life? If the court leaves him...will his conscious allow him to live a normal life???     Amnesty International & Human Rights are made for human beings. Not for the stray dogs and animals. But these rapist are worse than animals. They are not qualified for any mercy. Kill this b****s mercilessly as well the lawyers too who defend them. There must be high level political hand working behind them. Otherwise how they know legal points and lope wholes?

    What a big joke? You do a crime and yet expect a fair trial. There came this baby into this world, grew up and blossomed into a beautiful and intelligent girl only to become the toy for some guys on the street to play with and finally met with a painful death and was cremated. She is gone, gone days ago, but these guys are still alive and our people are still thinking about what should be done to these boys? How disgusting?
