Is Italy taking 'advantage' of India's decency?


New Delhi, Mar 13 (IANS): Italy is not the first country to have taken advantage of the Indian government's "decency" in refusing to return its accused men for trial, and the plea to allow the two marines to fly back to Rome to vote could have been a ploy being hatched for some time, say two former envoys to that country.

Italy has refused to send back its marines, Massimiliano Latorre and Salvatore Girone, to India to face trial for killing two fishermen off the Kerala coast last year, mistaking them to be pirates.

This is not the first case. In 1998, two French nationals had been arrested off the Kerala coast on suspicion of ocean survey espionage. The two men were put on trial and were allowed to go back to visit their homes after the French government gave an undertaking in court that they would return.

"They never returned... Take the case of Kim Davy (the Purulia arms drop case prime accused from Denmark)," said former diplomat Rajiv Dogra, who retired as the country's ambassador to Italy.

"They (countries) are taking advantage of the decency of the Indian government," Dogra told IANS.

"Last year, a US warship killed an Indian off the coast of Dubai and injured two-three Indians seriously. Nothing happened in the case," he reminded.

"It is for India to act strongly for only then they will stop taking advantage," said he.

He suggested two options that India could pursue. "India could declare them (marines) offenders and could scale down diplomatic contact with Italy… It is for the government of India to decide."

According to another former envoy K.P. Fabian, it was wrong of Italy to go back on its personal word to India and the Supreme Court that the marines would be sent back.

He said with Rome set to have a new government in the next few days the current government probably wanted to bring the affair "to a conclusion before it leaves office".

He also suggested that the Italian government could have made up its mind not to return the two marines when it filed a plea in the Supreme Court to allow them to fly back to Rome to vote in the elections.

"It seems they had made up their minds to do it..There is no real reason to ask India for permission to allow them to be taken to Italy for voting," Fabian told IANS.

"The request indicates planning was going on for some time," added Fabian.

He said it was difficult to say what the implications of the diplomatic stand off would be. "India has responded in fairly strong terms… Lets see what Italy has to say."

He said India might have to wait for a new government to come in Rome to get a "real response" to the situation.

"And it will be difficult for the new government to change course due to domestic and emotional issues involved," he said.

    This is not the first incident the Congis facilitated fugitives to escape from India but the reason they gave this was silly - to cast a vote in a country where postal ballet is allowed. Some of the earlier incidents are:

    Italian govt decision is very unfortunate. Definitely they are taking advantage of the Indian government's "decency". However such incident is not new for us. When Indian Airlines IC-814 landed in Amritsar the govt acted dumb by allowing the flight to leave India. Our govt forced to release dreaded terrorist Azar Mazood and Ummar Shekh. Both the cases can be called as “Ubhaya sankata paristhithi”.

    Forget Italy,even Sri Lanka and Bangladesh don't care India.Our soldiers fought agaisnt Pakistan and gave independence to Bangladeshis in 1971 war.Same Bangla soldiers kidnapped ,tortured and killed our soldiers and sent their bodies to Indian Military like how people carry pigs,tying its legs to bamboo sticks. But Govt of India didn't do anything and didn't utter a word.
    It is a routine work for Sri Lankan Navy either to fire at Indian fishermen or seize their boats. Anybody can do anything and our PM says "We have Zero Tolerance"....

    In the Marine firing many things are not clear, but Sad Part is poor Indian fishermen are died and SMT. DORA has become widow at young age.
    Italian Marines were seems over cautious so fired presuming the fishermen are pirates.
    But, whether they were in International waters or Indian waters? if International waters how could our fishermen go so far?
    But they settled with quick compensation. If Italy not returning them back for fair trial, then it is not fair.
    Italy may be thinking India takes very long time for trial and doubting fair trial.
    But Italy should take example of ABU SALEM & Monica whom SPAIN returned to India for fair trial.

    Yes, Everyone knows that India is a Soft state. They can arrest the Italian ambassador as he is the one who gave an assurance to the Supreme court- the Vienna convention does not protect his Diplomatic Immunity because he has already submitted to the Indian Court -or he can be d as Persona Non Grata (to leave India). Cut all the defence orders given to Italian companies ( given the current state of their economy-they will fall at India's feet).Recall our Ambassador. Issue red alert notice through Interpol to the 2 marines , Italian PM &FM - this will embarrass them to a great extent.

    First of all since the incident took place in international waters does the Indian govt have the legal jurisdiction to try the Italian marines? Moreover the compensation amount of Rs 1 core too has been paid.Besides there are more than 1 lakh Indians living illegally in Italy. If the rule of law is to be followed then all these 1 lakh Indians need to be deported back to India immediately. Italy did no wrong by refusing to send back it's marines as the decision of the Indian govt to arrest and try the marines was in violation of International law.

    Are u saying what Italy has done is right? Killing is killing, doesn't matter where they do it! We should always stand by with our people... Especially when outsiders have acted injusticely.... As for the one lakh people, India didn't ask Italy not to deport them, it's upto Italy to decide whether to deport them or not...

    Even if the ship is travelling via Somalia if Pirates try to approach a Ship the instruction is Never try to become hero by attacking them You have to take off the ship fast .These Fishermen were totally Unarmed -Innocent and shooting them was not called for .This is a cold blooded murder

    criminals should face the court and funishment. why the italians acting like that? they should respect the court, india let them go to italy on condition that they will return back. let the indian cobra jump on the italian govt. how they can foul india, shameless italians.on the other hand the marines admitted their mistake and they are ready to pay the blood money to the families of the indian fishermen. the court should finish the judgement fast and finish the case. the marines misundertsood by pirate and fired the shots. sorry for that,give the money to the fishermens family and finish the case. on thing i will remind the italian govt to repect the word when the marines granted release hoping they will return. dont do monkey business with indian govt. amigo chav...

    As far issue is concerned Govt of India summoned Ambassador of ITALIANO asked to explain why further action should not be taken against ITALIANO?On the other hand India is mulling to Intl Court of Justice if Italiano not responds positively.India kept it's option open to punish ITALY if diplomatic channels fails to bring any required minimum result.I think under achiever certainly fits good to BJP govt of Karnataka as they did get a surprised drubbing beyond any critics BJP anticipated!NIGHT WATCH MAN SHETTAR MAY CONCLUDE HIS SESSION SHORTLY,IN FACT,BJP DID SEND TWO NIGHT WATCH MEN(DVS)WHO WAS MADE TO RETIRE DUE TO BOUNCER FROM SHETTAR & BSY!!!

    One set of night watchmen were kicked out last week, another batch will be kicked out in May and finally the Dongi development howler and comedy star will be finally done with next year. India shining failed in 2004, Iron man failed in 2009 and the dongi development man will again fail in 2014.The problem is that people never seem to realise and accept the fact that they are beaten again and again.
