Delhi gang-rape accused gets tutor for IAF exam, now wants nutritious food

New Delhi, Apr 2 (PTI): One of the four accused in the December 16 gang-rape case on Monday sought a direction from a special court here for provision of nutritious food inside jail citing that he had to prepare for tests for recruitment of clerks in the Indian Air Force.

Vinay Sharma, the accused who, along with others, had allegedly gang-raped the 23-year-old girl in a moving bus here, moved the plea before Additional Sessions Judge Yogesh Khanna and pleaded that he be given milk, fruit and newspapers inside Tihar jail as he has to prepare for his written examinations on April 7.

The court sent the application to the jail authorities for their comments. Earlier, he had moved the court seeking a tutor as well as reading materials to help him prepare for the test. Subsequently, Tihar jail authorities had provided him a tutor to guide him in his studies.

The court, which has till date recorded the statements of 63 prosecution witnesses, told the lawyers that from Tuesday it will not adjourn the matter until unless anyone is ill.

Meanwhile, the judge also took a strong exception to the defence lawyers coming late to the proceedings and told them it was the last warning and they could be replaced. “I am observing that the defence counsels are coming as per their choice. They (defence counsels) should understand that they are dealing with a very serious case. They are taking the court for granted. I will write to Delhi Legal Services Authority (DLSA) to provide counsel to accused if in future also, the counsels reach late. It cannot go on like this. Please make sure that from tomorrow (Tuesday), you (defence counsels) are on time,” the judge said.

The proceedings on Monday got delayed by 45 minutes as counsel for accused Pawan Gupta and Vinay came late.

Later, a lawyer for accused Mukesh and Akshay Singh refused to cross-examine the witnesses and said he will start ON Tuesday.

The lawyer also said he has been given time till April 4 to file an appeal in the Delhi High Court against the order by which his application seeking documents in Hindi was rejected.

Initially, five accused in the case were facing trial for allegedly gang-raping and assaulting a girl on the night of December 16, 2012.

With the proceedings against the main accused Ram Singh having abated after his death on March 11, the remaining four adult accused—Mukesh, Vinay, Akshay and Pawan—are facing trial in the case for rape and murder of the girl. The sixth accused in the case, a juvenile, is facing proceedings before the Juvenile Justice Board here.

    The degree of civilization in a society can be judged by entering its prisons. A society cannot be recognized as a civilized society unless it treats the prisoners with sympathy and affection. This treatment is not possible till the society recognizes and accepts their basic human rights and the fundamental rights. A prisoner, be he a convict or under trial or a detenu, does not cease to be a human being. Even when lodged in jail, he continues to enjoy all his basic human rights and fundamental rights including the right to life guaranteed to him under the Constitution. On being convicted of crime and deprived of their liberty in accordance with the procedure established by law, prisoners shall retain the residue of the Constitutional rights. The Universal Declaration of Human Rights, 1948 stipulates that “ No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment”. Article 21 of the Constitution of India, which recognizes that the right to life includes a right to live with human dignity and not mere animal existence, strengthens this mandate. Thus, a prison atmosphere can be accepted as civilized only if it recognizes the basic human rights and the constitutional rights of the prisoners and makes efforts for the effective and meaningful enjoyment of the same by means of prison reforms.

    @ Jannet Prescillla , Mangalore , Punishment are given for two reasons 1. To stop from further commitment of crime , thus put him into custody 2. Reform or Rehabilitate : in custody . Apart from this every convicts has the right to basic amenities and education is on of them . One has to read the book written by prison reformist Kiran Bedi amidst the ordials in Tihar Jail . However heinous crimes is , indian constitution gives right to even dreaded criminals to place his defence in court and lead in human life in Jail . Its the beauty of Indian Judiciary and applauded world wide . Several NGO's like Amnesty International work in tandom with courts in such kind of cases.

I am sorry that you fail to distinguish between a criminal and an ordinary man when you suggest that every man has got the right for basic amenities. Next you will be suggesting that this gang rape culprit is released and allowed to commit many more similar crimes? Our judicial system is a farce and your comments are still worst. Again if this person is allowed to appear for IAF and God forbit he gets through and lands a clerical job in IAF for which he is aiming at, what guarantee is that he will not pose a threat to his lady colleagues? Added to that IAF which is supposed to protect the nation how can they allow a criminal accused of a worst crime rape and attempt to murder to appear for the exam. What does this fellow expect royal treatment for the great work done? Our Governement has thousand excuses when genuine cases come before them such as the dependent families of jawans / police personnel who lost their lives defending the nation / enforcing law and order but is willing to cater to the requests of these good for nothing scumbags. One rotten apple will spoil the entire basket of apples same way on unscruplous employee will result in deteriorating the morality of the entire work force at IAF office.

    Courts should respect prisoners rights and give them adequate assistance. One has to understand they are just under trial yet to be convicted by courts. Even after convictions , person has the right for proper food , sanitation , medications and even study materials. Law should not pay their heed to public outcry or democracy which often works against democracy.

    Roshan, true that they are undertrials. But they have committed a grave sin of raping and murdering. If this rapist wants to live, then why didn't he think that rape victim too wanted to live? Why this rapist didn't think the consequences before? Our laws against crime are very liberal and that is one of the reasons for increase in crime. Nowadays, rapes are common in India. Immediate ution is the best solution to curb crime. This rapist has no right to live in the society.

    In Madhya Pradesh a girl was forcibly married off by her parents at the age of 14. After marriage she continued her studies inspite of opposition from husband's family and completed her post graduation, and applied for a govt Job of MP. But the MP Public service commission did not allow her to appear for exam by stating that she is a culprit / Law breaker under Child Marriage act. She is fighting in the court since last 12 years (She lost her case in district Court & High Court too). Now it is in supreme court since last Two years, still pending, and even Supreme Court could not decide whether she is innocent or not, even though she was herself a victim and not a perpetrator of Child Marriage. She has even divorced her illiterate husband even before appearing for govt job exam.
    So when innocent Child Marriage Victim is categorized as culprit while giving govt job, how come a real culprit (Rapist) is allowed to appear for a govt job ??

    Great thamasha by Indian judiciary. Blood boils to see these crooks misuse our legal system. First of all, why we need to address this rapist as "rape accused"? Why don't we call him as "rapist" as it is proved that he was involved in rape and murder. Because of the liberal law against rapists, rapes in India are increasing and spread over to various states. Rapists are provided with good food and facilities at jail and many rapists are wandering freely and just looking to rape somebody again. India will be crime country if these kind of criminals are not punished. What our politicians are doing? It is a shame that Delhi is being ruled by a woman...Congress president is a woman..but cannot or don't want to do any justice for rape victim. Are these politicians want people to come to streets again? These crooked politicians are not fit to be in the parliament. They should be kicked out from parliament and should be sent to border areas and interior parts of India.
