Re-open case against Tytler, orders Delhi court


New Delhi, Apr 10 (IANS): In a setback to Congress leader Jagdish Tytler, a Delhi court Wednesday ordered the reopening of a case against him related to the 1984 anti-Sikh riots.

Additional Sessions Judge Anuradha Shukla Bajaj also set aside the Central Bureau of Investigation's (CBI) closure report which had given Tytler a clean chit, claiming there was no evidence against him.

The court's order came on a plea filed by a riot victim, who sought further probe in the killing of three people near Gurdwara Pul Bangash in central Delhi.

Tytler is accused of instigating a mob that led to the murder of three men who had taken shelter at the Pul Bangash Gurdwara in north Delhi Nov 1, 1984.

The mob attack was part of violence against Sikhs after the assassination of then prime minister Indira Gandhi Oct 31, 1984.

The court directed the CBI to examine eye-witnesses and people who claimed they have information about the riots.

The court, setting aside the magisterial court order that accepted the CBI's closure report, said: "The order of the trial court accepting the closure report is set aside. The CBI is directed to conduct the investigation and examine the claimants/eye witnesses in the case."

Opposing the victim's plea against the CBI closure report, the agency had sought its dismissal, saying the probe has made it clear that Tytler was not present on Nov 1, 1984, at Gurudwara Pul Bangash where three people were killed during the riots.

However, senior advocate H.S. Phoolka, appearing for petitioner Lakhwinder Kaur had said there was material which the CBI had ignored and evidence was also there before the trial court against Tytler.

Three men - Badal Singh, Thakur Singh and Gurcharan Singh - were killed near Gurudwara Pul Bangash, allegedly on Tytler's instigation.

His role in the killing of the three men was re-investigated by the CBI after a court in December 2007 refused to accept its closure report.

The CBI had claimed Tytler was at Teen Murti Bhavan, the residence of the then late prime minister Jawaharlal Nehru, where Indira Gandhi's body was laid, at the time of the Pul Bangash incident.

It added that the agency has already re-investigated the case on the order of trial court but there was no sufficient evidence against Tytler.

Tytler was given clean chit by the CBI April 2, 2009, which claimed that the agency had no evidence against him.

For Lakhvinder Kaur, the judgment has given hope of justice, though after more than 28 years.

"I died the day my husband was killed in the riots," said Lakhvinder Kaur.

"In our 28 years long fight for justice, we could not get any positive decision in our favour, but the district court's order to reopen the case is like a ray of hope and happiness for us," she said.

Her husband Badal Singh was killed in the riots.

Phoolka later told reporters that the prime witness in the riots case had died but three other witnesses are alive in the US, and that the court has directed the CBI to record their statements.

The conspiracy angle has not been probed at all, the counsel said, adding that the CBI should investigate the riots and the accused should be punished

Amid demands for Tytler's removal from the party, Congress spokesperson Renuka Chowdury said: "Once the court comes out with something conclusive, it will be examined and we will take a call on that."

    Being a sikh PM, MMS must either make CBI independent or must improve the judiciary system. In this case either CBI is wrong in giving clean chit or Court is wrong in reopening the case. But the fact is why no one brought to book? how 3000 sikhs died? by genocide or they died by natural death? When congress utterly failed to give justice to sikhs, what moral right they have to question the 2002 riots? Any sensible person will agree that 2002 riot investigation was carried out in much better than 1984 case. What moral right they have to question BJP on 2002? Be sharam Congress!

    For some biased argument of Congress and its supporters, Some facts:
    1. Allegation on Modi is that he failed to control the Riots in 2002, but no do direct involvement.
    Where as in 1984 Riots allegation is that some congress leaders actively involved, lead the mob and directly involved inthe riots.
    2. In 2002 Riots 30% Hindus and 70% minority were killed, but in 1984 all the people who were killed are from Sikh community only. So it is not a riot it is genocide.
    3.In 2002 riots case so many people got convicted, but in 1984 case no body got convicted (today 3 or 4 got convicted), no proper investigation was conducted, CBI is misuesd,CBI was in a hurry to give clean chit to political leaders. Again CBI lost its face and it is now cristal clear that CBI is misused by the govt.
    4. In 2002 riots case CBI, SIT appointed by SC conducted the investigation which is not controlled by state government. So many so called intellectuals, NGO's day and day out tried to implicate the state government. In 1984 case all these people are quite and ignorent. Only reason is for them sikhs are not human beings only minorities are human beings. Crime commited by congress is not a crime for them.
    5. Both state and central Delhi government totally failed to protect sikhs. No one really got punished. Justice denied to sikhs.How can this happen? According to CBI and congress one may feel that these 3000 sikhs commited suicide and not killed!
    6. Congress, its supporters, NGO, Tehelka, Mahesh Bhat, Katju,intelectuals all got exposed. Now it is very much clear that corrupt congress hand is soaked with the blood of innocent sikhs.
    7. When CBI can be misused to give clean chit to Tytler and others, one can definitely feel that CBI is misused in the case of Modi, Mayawati, Mulayam, Sadvi etc.
    8. India's judiciary system is in very bad state. In every case justice is delayed. All culprits must be punished within time frame irrespective of party.

For one week IND express published the full details of conversation between Sangh parivar criminals and Gujrath police control room. How Ind Express was able to get all these evidences, and how MODI can disclaim such things. What was the need for Vajpayee to advise RAJADHARMA to SARDAR MODIJI. What happened to the Ind Express records.Why Police control rooms were in contact with the Sangh Parivar ??????????

    The matter here is not about looking into the past. The matter here is about getting justice for the victims and punishing the guilty.

    If the past is to be forgotten in order to look to the future then every murderer would love to believe in this philosophy.

    The whole justice system is based on punishing the guilty for the crimes of the past !!!

    Even Pakistan keep telling India to forget 26/11 if relations are to move forward but relatiions can move forward and past can be forgotten only when justice for the victims and punishment for the guilty has been achieved !!!!!

    German Govt still pursuing Nazi era cases for crime against humanity. Many Nazi’s and its collaborator are hanged and jailed. German courts opened the case Nazi Concentration camp guards.
    It is not giving important to age of accused. The person may be 80 . But it has pressured US Govt and brought him for justice.

    Killing of more 4000 Sikhs ( officiall fig and unofficial fig 6000 ..8000) is not an joke.

    When Queen Elizabeth visited Punjab our so called nationalist demanded apology from her for British era Jalianwala Baag Massacre. But did Congress Govt given any written apology to victims and its family....????? Did they financially supported.....???????

    For eye washing Successive Govt appointed Commissions after 1984. But victims never got justice.....

    Remember their blood still asking jutice from the Almighty God and he will give Justice.....

    This is not what we majority of Congis wanted. They will now argue that CBI has already given him clean chit and by virtue of that report then CBI Chief was promoted to Governor of one of the State. As per Indian Constitution, A Head of the State can’t be prosecuted for his failure to report the justice, hence CBI can’t be ordered to reopen the case and therefore Honorable Jagadish Tytler was and is innocent. If possible UPA Government will appoint one more Commission to close the Anti-Sikh Riots Cases and they will come up with the story that, there was no Anti-Sikh Riots happened and there was no human loss caused by anybody, whereas CBI can proceed to harass Modi as far as possible, since they have doubt that Anti-Sikh Riots might have happened instigated by Modi whereby taking revenge in Gujarat Riots. Order has come out from 10 Janapth Street to Kapil, Khurshid, Moily, Tiwari and Oscar to draft such a class report to read out in Supreme Court that even SC Judge too get confused with the wording

    It is important that people who have instigated the riots against sikhs be tried, HKL Bhagat the architect of this riot is no more, but Tytler and Sajan Kumar are still there and should be tried.

    I hope the same happens in Gujarath, where Modi has wiggled to stay clear and is aspiring to me the PM be brought to justice for the Gujarath Massacre.

    Politicians threaten witnesses and try to get away, the court should provide complete protection to the witnesses.

    Intrestingly the then Director of the CBI from August 2008 to November 2010, i.e the CBI Director who headed this agency in 2009 when it gave clean chit to Tytler is now the Governor of Nagaland...Is this appointment any surprise....!!! only hard core congis in the forum may have some other answer..

    Mahedra Shetty, Mumbai, Mangalore. If I remember correctly Sonia and Manmohan Singh have apologized (separately) in the Parliament in 2009. But these apologies have no meaning isn't it? Even if Modi or BJP on behalf of Modi apologizes it doesn't mean anything to the victims. Crime of such huge magnitude cannot be brushed aside with a simple apology.

    Basically in india the worl "Secular" and "Communal" are being used by only unscrupulous poliiticians to cook their "Ganji" and live a lavish life out of it.These two wrords are used for deviding the people for vote bank purpose....our eleders (some 50 yrs ago) never used to utter these words because they were heartilty secular and against communalism.They never expected any political gains for that.
