Mangalore: Homestay case - Bail for minor after five months

Mangalore, Apr 11: The additional district and sessions court here, on Wednesday April 10, granted bail to one of the accused in the homestay attack case. The accused was granted bail on the basis of the fact that he is still a minor.

Ranjeet (name changed) was granted bail after the court examined his bail plea. His sister had approached Dakshina Kannada district Children’s Welfare Committee (CWC) president, Asha Nayak, with a request to release her brother.

Documentary proof was also provided about his age. Asha Nayak then had requested the district court, seeking the release of the minor.

The additional district and sessions judge, acting under the directions of the district judge, conducted hearing of the plea and ordered release of the boy on bail.

Asha Nayak said that no one had noticed the fact that the above accused was a minor, all these days. She said that the police too had not verified his age. She added that the sister of the accused had provided age proof of the boy about six weeks back, and that CWC had done what was expected of it thereafter.

    don't worry. by the time trial completes, this "minor" will become major and he will join his "friends" in jail. "Sister" what will you do then?. appeal to whom?
    Whether act done during minority is not a crime as per IPC?
    He should have been remanded to Juvenile home instead of granting bail. It appears that our "learned" PP has not presented the case properly ....?

    My comment is to the SISTER of this 'minor' lad.
    If your brother was a minor then how did he get into this 'sanga' that attacked the home stay? Why didn't he think that he is still a minor before he went on a bashing spree with the other thugs???
    Secondly, wasn't the family aware of his involvement with the 'sanga'?? What did you'll do? Encourage him?? If you people were decent enough with a clean conscience then you'll would have stopped him. Dont tell me "what can we do if he decides to join them?" "We were helpless..." Cos he is a minor, isnt he? which makes you people, the family members, responsible for his actions. If he is not to be blamed then you (family) are the ones to blamed.
    I really hope your brother is brought to justice for what he has done.

    In this conversation, there is no blame for the family! Why do you bring their family in between, it might be his friend circle with which he committed this crime! Again, regarding his sister requested for bail, is it wrong what she did? In case if you commit any of the mistake, wont your family member come to release you atleast?

    THESE DAYS MINORS ARE INVOLVED IN ALL SORTS ANTI SOCIAL ACTIVITIES LIKE ATTACKS, RAPES AND MOLESTATIONS AND GET AWAY SCOTFREE UNDER THE PRETEXT OF BEING MINORS. IN THE DELHI GANG RAPE CASE THE MINOR WAS THE WORST OFFENDER OF ALL. THIS NEEDS TO DEALT WITH SEVERELY SO THAT THE MINOR STATUS IS NOT MISUSED BY LOOPHOLES IN CURRENT LEGAL SYSTEM.

    If person is pleaded guilty, he/she has to be punishable with NO MERCY attitude under fullest extent of LAW for these type of case. Age limit should be considered only for petty crimes like stealing foodstuff to fill stomach..etc

    The moral for anybody wanting to join these organisation, it will be only your family and never the organisation which will rescue you from your troubles and bad days. Godfathers will continue to shine in the limelight, while the lower rung people will languish in the dark corners of jail, for the deeds what they think were acts of bravery.     M/s. Asha Nayak if you are reading this, make sure your brother does not get involved in criminal activities again. It is your responsibility just like how you fought for his bail. Being a minor does not absolve him from the crime he committed. Those girls they attacked also were some ones
    daughters and sisters. Hope he has learnt a lesson after being in jail for 5 months.

    If I am not wrong, this very accused had appeared for PUC exam recently. Well, he may have done a wrong on being influenced by wrong company. Hope he has learnt a lesson after being in detention for so long and that he will get good marks in his exams which will be a all new path to tread on.
