Gang-rape case: Accused say they were not in bus

New Delhi, Apr 11 (IANS):
Vinay Sharma and Pawan Gupta, two of the accused in the Dec 16, 2012, gang-rape case, Thursday told a Delhi court that they were not present in the bus in which the sexual assault took place.

Advocate A.P. Singh, appearing for Sharma, moved an application before Additional Sessions Judge Yogesh Khanna that he and Gupta went to a music function in south Delhi on the night of incident.

Sharma had made a video-clip and clicked photographs which show that the two went to a music function, said Singh.

The application said that "accused Vinay's mobile contains a video recording and photos which can establish that he and Pawan were not in the bus on the night of incident."

Sharma and Gupta went along with their friend to the music function at district park near R.K. Khanna Tennis Stadium in south Delhi, counsel said, adding that a friend of the two accused could be a crucial witness to prove their innocence.

The advocate sought permission to make a CD of the video of the music event recorded on Sharma's mobile.

The court said that they can make a CD out of the video recording as the matter was between counsel and the accused. But, at present, the matter had nothing to do with the case, said court.

Counsel said that the recording was important evidence which could prove innocence of Sharma.

Singh submitted: "It is very important defence for the accused, as the mobile contains some exclusive information, which can prove the innocence of my client."

A 23-year-old trainee physio-therapist was brutally gang-raped and tortured by the six men on a moving bus Dec 16, 2012. She died in a Singapore hospital Dec 29, 2012. One of the accused was a minor who is facing proceedings before a Juvenile Justice Board.

Of the five accused, bus driver Ram Singh is now dead. Other four, than the juvenile who cannot be named for legal reasons, are: driver Ram Singh's brother Mukesh, fruit seller Gupta, gym instructor Sharma, and bus cleaner Akshay Thakur. All accused are in judicial custody.

    YES ACCUSED WAS NOT IN THE BUS HE WAS IN DUBAI.THERE MAY BE SOME FOREIGN HAND IN THIS RAPE. FIRST ARREST THAT LAWYER AND PUT HIM BEHIND THE BAR..AND GIVE HIM 50 LASHES FOR TELLING LIES..

    Add 'Perjury' to the long list of crimes committed by these no good scumbags!Lawyers too should be held responsible for theories that they use in a clients defence. If the arguments cannot be sustained and are determined to be false the lawyer should get the same or an equivalent sentence as the accused. This will make lawyers more careful about ascertaining the facts and keep lies and sensationalism out of the courts.

    Is it going to prove sharma is innocent ? Court has become a childs play. when the eye witness of the victims boy friend was present in the bus, wat else is needed more than that. later it might even come to a conclusion that the boy friend of the victim was not present in the bus and everyone r innocent. The lawyers r twisting and yes the Indian Court is Blind.

    Why did it take so long to dawn upon the accused that they were not in the bus during the incident? One thing is certain, despite the initial furore, this case will drag on for years, and finally reach nowhere. No wonder if the accused are proved innocent for want of proof.

    Well im not sure how to get this message across to the court. There are two things that need to be ascertained here
    1) If the phone belongs to the accused
    2) If the recording have not been transmitted to the phone or been recorded by the same on that fateful day .

    The second can be easily proved by technology , first by police investigation.
    The nation owes the girl justice ..

    In this story we can understand that,the video clip and photos of the musical function is actually captured by the accused's friend who is present on the function,in his own mobile.Now this dirty lawyer made a gimmic by transfering that memory card to those accused's mobile.And trying to prove that they are in musical function that time.If it is true,then lawyer should be arrested immediately.

    LUCKILY THE LAWYER'S DAUGHTER WAS NOT RAPED THAT IS WHY HE HAS COME OUT WITH A NEW STORY OF A RECORDED CD TO SAVE THE CULPRITS.WHERE WAS THIS CD OR RECORDING ALL THESE DAYS(MONTHS) AND HAS NOW SUDDENLY APPEARED.THE LAWYER HAS TO BE FIRST ARRESTED AND KEPT INSIDE THE JAIL FOR SUCH CRIME OF DUPLICATE CD.
