Ottavio Quattrocchi dies of heart attack in Milan


New Delhi, Jul 13 (PTI): Controversial Italian businessman Ottavio Quattrocchi, who was a key figure in the Bofors payoffs scandal, has died in Milan following a stroke.

74-year-old Quattrocchi died peacefully yesterday and his funeral will take place on Monday, a member of the family told PTI on phone from the Italian city.

The Bofors chargesheet filed in 1999 by CBI had named Quattrocchi, who was close to the Gandhi family during his days in India as the representative of an Italian firm, as one of the accused in the case regarding the Rs 64 crore payoffs for supply of Swedish Howitzer guns to the Indian Army. The Rs 1,600 crore contract was clinched in 1986.

But on March 4, 2011, a Tis Hazari court here discharged Quattrocchi from the payoffs case after allowing the CBI to withdraw prosecution against him, bringing to an end a major chapter in the 25-year-old Bofors saga. An application for withdrawal of the case agains Quattrocchi was filed by the public prosecutor on October 3, 2009.

The CBI had unsuccessfully tried to extradite Quattrocchi to India but it lost two extradition appeals, first in Malaysia in 2002, and then in Argentina in 2007. Quattrochi left India in 1993 to avoid being arrested.

Defence minister A K Antony recently said the government does not plan to launch any fresh probe into the Bofors scandal and that Quattrocchi stands "discharged" as he could not be extradited even after 20 years of registration of the case.

Antony had told Parliament that Quattrocchi had left India on July 29-30, 1993, before CBI had "any material evidence warranting his arrest" in the Bofors case. The scandal had cost Rajiv Gandhi and the Congress the 1989 General Elections.

With the measures undertaken by the CBI failing to get Quattrocchi extradited from Malaysia and Argentina, he now "stands discharged from the case", he added.

Chief Metropolitan Magistrate Vinod Yadav, in his 73-page order, while discharging the Italian noted that the CBI, despite "spending through the nose for about 21 years, has not been able to put forward legally sustainable evidence with regard to conspiracy in the matter.

Further, in the case of Mr. Quattrocchi, as against the alleged kickback of Rs.64 crore he received, the CBI had by 2005 already spent around Rs.250 crore on the investigation, which is sheer wastage of public money."

The grounds stated by the CBI in 2009 for withdrawal of prosecution were: more than 19 years had passed since the first case was registered in 1990; all the other accused had died or proceedings against them had been quashed by the Delhi High Court; attempts to extradite Mr. Quattrocchi from Malaysia and Argentina had failed; and the Delhi High Court in 2004 had knocked out allegations of corruption or conspiracy with public servants.

Under the circumstances, the application seeking withdrawal of prosecution "appeared to be bona fide and in the larger public interest," Yadav had said.

In his order, Yadav also quoted from the February 4, 2004 High Court judgment, to indicate that the CBI had failed to prove that the money transferred by A.B. Bofors (Swedish arms company) to various agents including Quattrocchi was meant to be paid as a bribe to public servants in India.

He also cited the orders of Malaysian and Argentinean courts, which were unconvinced by the offences made out by the CBI against Mr. Quattrocchi.

    Within twenty hours they died, Qattrocchi and the actor Pran. Q behaved like a gentleman in his public life and was a villain. Pran acted in the roles of villains but was a thorough gentleman.

    The Political parties i.e. BJP/Congress/NCP/JD are not corrupt but some politicians of each and every party are corrupt. Indians got habit of blaming others , and showing that we are saints. All the readers must condemn the corrupt but some of our readers are just blaming some parties. Now this foreign national might have cheated India for about 70 cores but I know there are some Indians involved with this case. ( Mr. Chedda who is staying in Dubai) But since than all the ruling parties Congress /BJP are renewing his passport and We may be having so many politicians looted lot more than this but we are behind this foreign national, and spent lot more than to fight the case. We are behind Dawood who is staying in Pakistan but what punishment we have given to other underworld people who are in India. Just make strict rule and punish with in short period to teach them lesson the crime will come down. When in foreign country some crime happens with ladies our people will cry and say ATHITHI DEVOBHAVA. But I am watching, in India, Rikshaw drivers raped Medical student, 5 year old kidnapped and raped etc etc.
    Please wake of Indians, First correct yourself and than show finger to others. Just say No chance of Cheating, Corruption, Rapes, injustice etc.

    So, the Bofors case file buried forever in Quattrochi’s grave. What a relief for Congress Party of India and one particular person in Karnataka too breathing easily now. I think same thing will happens to 2G, CWG, Coalgate, Farmers Loan Waiver Scam, Railgate, etc too. People involved in these scams will be posted somewhere in the State as head of the State and we being common public keep on writing comments in forum like Daiji

    And takes along with him another election issue of the opposition...BJP's weapons are shrinking day-by-day. Bofors guns were maligned to the hilt and yet Kargil was won through them. BJP had at least two opportunities to bring the truth out in the Bofors scam, once immediately after the scam broke and Rajiv Gandhi had to resign. BJP was partner in VP Singh govt with Left parties. Yet nothing happened and again during NDA's regime of 5 years, not a single file moved. So much so that Q was let alone to go when he was almost apprehended in Malaysia. BJP was and is never serious about investigating any scams since most of the times skeletons lie in their own cupboards. Anyhow UPA can still announce a national mourning of 3 days and holidays of two days, just to celebrate 'Big Q's' demise! Bofors was always a 'No Ball' and Congress has now got 'Free Hit' too...double whammy!

    Why I should be ashamed for the acts of some individuals? Moreover even almost after 2 decades nothing is proved. Congress was and is corrupt. Agreed! Then why did not BJP cleanse the system?     What a pity! To find out about 64 crores, govt spent 250 crores in investigation! If there was some truth..they would have found some credible evidence! Opposition do not mind spending another 500 crores and no result in return! Looks like It was desperate attempt by opposition to gain power! Every business man make some money out of most deals!     There goes another Congress's biggest partner in crime of its times into history books. If NDA did atleast 10% work when they were ruling w.r.t the noise they do when they are in opposition today Congress core fly& its image would have been paraded naked all over India, but when it comes to coruuption/kickbacks/scams, there is not ruling oppositions in India.
    Perfect example for this you can see in Karnataka. Congress including our Urulu Seve Poojari said BJP Bad boys wile be behind bars if our party comes to power, but till now not even any action initiated. Together in loot, divided in development.
