Delhi gang rape: Sentencing on Friday


New Delhi, Sep 11 (IANS): A Delhi court Wednesday reserved the order on sentencing the four convicted in the Dec 16 gang rape case to Friday.

The four already convicted in the case are: Pawan Gupta, Vinay Sharma, Akshay Thakur and Mukesh.
 
Death penalty was sought Wednesday by the prosecution for the four men who were convicted for the crime.

Additional Public Prosecutor Dayan Krishnan sought death penalty for the attackers, saying they only deserve "death sentence" for the brutal crime.

Defence counsel, however, vehemently opposed the death penalty, saying "the factors outside the court room have effected the trial of the case".

The court Tuesday while convicting the four men, called the crime "premeditated" and "brutal".

It convicted the four men for gang raping the 23-year-old woman,  inflicting grave injuries on her, and leaving her to die by a roadside on a cold Dec 16, 2012, night in an abhoring case that jolted the nation and made global headlines.

Additional Session Judge Yogesh Tuesday said the injuries on the victim, including "18 injuries" to her internal organs, inflicted by the accused were "dangerous" and "sufficient...to cause death".

The court said the convicts' act of inserting a rod into the body of the victim was done "intentionally" to kill her.

The gang rape occurred after the woman and her male companion boarded the bus in Munirka in south Delhi to return home after watching a movie.

The six attackers in the bus threw both the woman and her male companion out of the vehicle -- without clothes -- on the street in the cold December night after committing the crime, police said.

The woman died of her injuries Dec 29 at Singapore's Mount Elizabeth Hospital.

One of the six accused was found dead in a cell in Delhi's Tihar Jail while a juvenile involved in the crime was Aug 31 sent by the Juvenile Justice Board to a reform home for three years.

The incident sparked nationwide protests and nudged the central government into enacting a stringent anti-rape law.


Defence pleads mercy for Pawan, citing young age

Defence counsel appearing for Pawan Gupta, one of the convicted in the Dec 16 gang rape and murder case, Wednesday pleaded for mercy citing his young age. Gupta, a fruit vendor, is 19 years old.

Defence counsel also said the crime was committed on the spur of the moment and was not premeditated.

Counsel opposed the prosecution's demand for death penalty for the convicted, and said life imprisonment may be given to Pawan instead of death.

Pawan is "just 19 years old and there are chances of his reform", the advocate said.

Arguing on the quantum of sentence in the case, the prosecution sought death penalty for the four men accused who were convicted for the gang rape and murder of the physiotherapist intern.

The court Tuesday called the crime "premeditated" and "brutal". The case shook the nation, and raised a howl of protests.

    I suggest they should be skinned first and then be given an hours time free(compulsory) swimming on the beaches, the same iron rods through all the openings and suffocate them to death.

    Death penalty is also less for such rapists.Unfortunately the juvenile escaped the punishment who is real devil so cruel ed rod into victims private parts which resulted in internal organ damage and infections cause of death.If he comes out of the jail after 3 years sure somebody will kill him.

    Mr. George William, with due respect to you, your conscience, your religious affinity and considering everything else could I ask you your relationship with the victim.
    After reading your preaching I fail to understand your one sided logic your miniscule aprehension of the mental and physical torture, agony, and suffering finally culminating into death of the victim which the victim and all her near and dear ones went through for 13 never ending days Thank God i am not the judge or else the death sentence for the 5 (including the damned juvenile who will never improve)would be to the same rod into their stuff and let it slowly cause their death one by one so that they experience the same pain and agony. Death by hanging or by firing squad is a very easy let-off.

    Sir, George William, your thoughts are really beautiful but only on papers.
    Your thoughts are certainly applicable to those nomadic tribes who commit crimes like stealing, robbing, even murder for petty gains just because they were born & brought up in a group of people who do this to earn their living. We can teach them the civilized culture & show them a new way to earn their living in a civilized manner. This is called reforming.
    But these criminals knew the law of land very well & the consequences of committing such a brutal crime.
    The death penalty is not cited as violation of human rights by the constitution.
    In this case this is the least punishment any judiciary can give. Serving justice is nothing but compensating the losses incurred by the culprit to the victim. In this case the loss is irreversible.
    In my humble opinion, even the juveniles must not be spared from severe punishments just because of their age, if the crime falls under the rarest of the rare category.
    Also the victim in this case was in no way related to the criminals to call it as a crime of passion.
    When they were out on their loose they were literally hunting for a female to sate their lustful thirst & someone, certainly a female had to suffer all that brutality.
    I'm afraid no judge walking across the planet in flesh & blood enjoys to condemn someone to death.
    Finally, I want to know, if you would still preaching the same, God forbid, if ever some female member of your family had to come across such kind of brutality, even by the aforesaid tribes?
    The only thing you want to see, the criminal dead.

    Defense council should have his wife and daughter be treated same way by the same 5 living accused. Then Defense council will think what he is doing. Right or wrong.
    Only after his wife and daughter are treated same way, he has a moral right to take up the case.

    I request Delhi court to before giving "death sentence".
    Pls. Give at least 50 lashes for all rapist including minor, from victims parents hand.

    If Delhi court gives this judgement then I feel 99.5% rape will stop.

    People are talking about giving them mercy!!! Oh forget it…Even THE ALMIGHTY GOD must have shaken up when he saw this brutal act towards that innocent girl.
    I have commented earlier also…though we are no body to judge anybody…yet yet…I am saying YET…even demons will not go to that extend may be!!!
    She suffered and she is no more…but even after this incident… how many more rapes have occurred. DID THIS ACT STOPPED BEING RAPED? Even small toddlers are raped by MENS!!! Bloody hell with them YAAR…what’s going on I MEAN…
    SENTENCING THEM is nothing infront of the pain what the victim goes through. I CANNOT EVEN IMAGINE a proper punishment for those accused, which can give a little bit of soothing for those who become victims and to those of victims family members. And YET THE DEFENCER is pleading MERCY!!!!

    THEY should get such a death…that death should fear about it!!!

    Death penalty is the only solution for this kind of cases. But the question will arise when they will really put in to gallows? After 11 Years when almost all Vedike, Human Rights Association or Few NGOs’ start showing sympathy towards these cowards? Or may be some other Government will come into power and they abolish death penalty with retrospective effect? I think our people got too much democracy in their hands and never fear for Law & Order in India. There is shocking revelation by Gulf News yesterday that as per new survey conducted by one of the News Agency in Asia, one in out of ten committed rape cases.

    It took nearly 11 months for the judicial system to condemn the criminals. Death penalty is the least penalty that could be meted out to them who snuffed out a young life without any hesitation. The defence counsel says it is not premeditated crime then what was it throwing the victims out of the vehicle without clothing to die in the bitter cold. Injuring the internal organs of the girl by ing a iron rod. Well if you do not want to kill them then give them the same treatment every day that they gave to their victims, so that they also suffer the same pain an anguish those two suffered. Would the defence counsel pleaded for mercy if the victim involved was a close relative. Because of the undue delay in coming to a conclusion and punishing the culprits, how many more similar crimes have been committed all over the country. There is no respect for human life, especially if it is a female. Either foetus, a girl child, young student, wife or a mother even grand old ladies are not spared now-a-days. Please do not spare them and don't show pity they do not deserve it.

    Florene dotn defend for the culprits. What do you mean by if police would be there . How on earth can these men torture this girl and u already know to what extent they have done it.     Most cops are asked to give protection to VIPs. The very next day after the Mumbai rape case, there was a statistics shown on the number of police on VIP protection and how many aam janta is left with.

    Plus the police are clear victims of politics. They do their best in India amidst all the corruption. They are paid peanuts. They need to be respected second to army.

    For Indian lawayers money matters and not the crime or its effect on the society or on the victim. For moneys sake, these lawyers are ready to represent terrorists and anti nationals....Kasab was too defended by the Indian lawyers.. Are these lawyers too anti Indian. Manipal rape..no lawyer came forward to fight the case. If lawyers across the state, refuse to fight for rapists (not accused)
    as evident from prime facie, then I would say, rape shall die down and no one is ready to rape as they know no lawyer would fight for them. Now the rapists know, they can prolong the case as lawyers are with them...Lawyers too have lost morality and social responsibility.. only money speaks.

    I was repeatedly raped by six men.I was hit on head,bitten all over the body and iron road was ed into my secret part and pulled out..I became unconscious 3-4 times.They used to slap me hard to gain my consciousness..It went on for one hour..finally i was dragged by pulling my hair and thrown out from the bus..

    Dear Lawyer..what punishment do you give if same persons rape your daughter/sister/wife ?..I still believe Indian judicial system is alive..We come to know on Friday..Me along with millions are eagerly waiting for that historical judgement...Yesss.DEATH SENTENCE..!!

Dear Defence Cousel, can you just imagine the agony these filthy animals gave to our beloved, innocent girl ? How on earth can you imagine these evil creatures deserve mercy ? Do they know what is mercy ? Can you just imagine how much our beloved little girl must have pleaded for mercy with these beasts ? They do not deserve to breath the air of this earth. Even death sentence is not sufficient. They should suffer the same way our poor girl suffered and now her family suffers. They should be cut in to pieces on daily basis. HAVING SAID THAT, SENTENCING SOMEONE EITHER MALE OR FEMALE FOR THIS HEINOUS ACT STILL MORE ALARMING AS THOSE WHO SENTENCE THEM TO DEATH ARE NOT OBVIOUSLY ANGELS. AT ANY POINT OF TIME DEATH SENTENCE OR HANGING A CRIMINAL IS A SHAMEFUL ACT WHICH REST OF THE HUMAN THINK IS CORRECT. WHICH ISN'T. IT IS ALWAYS RIGHTLY SAID: "KILL THE OFFENCES. BUT, NOT THE OFFENDERS". EVERY CRIME THEREFORE EITHER PRE-DETERMINED OR ON SPOT IS COMMITTED WITH LACK OF KNOWLEDGE, IGNORE OR LACK OF FEAR OF LAW AND REGULATIONS.
