HC asks centre to look into AAP's accounts


New Delhi, Oct 23 (IANS): The Delhi High Court Wednesday directed the central government to go through the accounts of the Aam Aadmi Party (AAP) to ascertain the source of its funds, and check if there was violation of law in the receipt of funding.

A division bench of Justice Pradeep Nandrajog and V.K. Rao asked the centre's counsel to file a status report on the issue after looking afresh into the accounts of the party. The court has posted the matter for hearing Dec 10.

The court said: "Go through the accounts again after the AAP was formed and in case you find anything in violation of FCRA (Foreign Contribution Regulation Act, 2010) take action, or inform the court about the status."

The court's direction came on a Public Interest Litigation (PIL) seeking registration of a criminal case against AAP leader Arvind Kejriwal and others for allegedly receiving foreign funds in violation of law.

The centre's standing counsel Richa Kapoor Wednesday also filed a report before the court, saying an evaluation of the accounts of the civil society team led by Anna Hazare was done in 2012, and a report was filed before another bench of this court in January this year in a similar PIL filed by the petitioner earlier.

Taking the centre's report on record, the bench asked the counsel to go through the details of funds given by donors to AAP since its inception Nov 26, 2012.

The court Oct 11 told the centre to submit the inquiry report prepared by it earlier on a similar complaint against the earlier civil society group.

The centre had told the bench that the issue raised in this PIL had already been investigated, and a report had been prepared by the government earlier.

The plea was filed by advocate M.L. Sharma, who also sought seizure of accounts and funds secured by members of AAP.

"A direction to be issued to register a criminal case against the respondents (AAP members) under the Foreign Contribution (Regulation) Act (FCRA) and conduct of day-to-day trial proceedings with the supervision of the court, in the interest of justice," sought the plea, naming Kejriwal, advocates Shanti Bhushan and Prashant Bhushan and party member Manish Sisodia.

The plea said the FCRA prohibits funding from foreign countries for a political party.

However, Prashant Bhushan, appearing for one of the respondents in the case, contended that "the petition is mala fide, and in the earlier report also, the government had not found anything against the civil society team".

    Arvind is wrong in taking on corrupt parties like bjp and congress. bjp mcd runs business of water tankers that is worth 200 crore, why should a business enterprise be wiped out? employees of MCD make few lakhs everyday in bribes, running a parallel economy of sorts, you cant just shut down this business. Common man is paying double the amount for electricity bills, so that reliance and tata can earn fat profits and fund BJP and Congress, why should we stop this? So many people are associated with these age-old parties, they have huge nexus and infrastructure to run this country and suck blood of people. That's really good for the country.

    It is good that court advised to enquire.Otherwise people will think it is Congress behind this.Who knows this party wins tomorrow and s Delhi as different country ? All parties may be getting black money but this particular partys source of income should be checked.Who knows some outside sources or outside intelegence group is funding this party to devide India.It is better to take care now only.

    This is absolute blackmail by ML Sharma,who I thought was an upright lawyer, by filing a PIL against a political party.
    I think a million PIL's could be filed against each and every political parties- wot about Mayawati's 1000 RE note garlands and the millions of unaccounted funds received by the Congress/BJP/SP/ others?
    And what about the millions given by businessmen without their names attached.
    Shame on the applicant and this particular lawyer.
    If all the state High Courts get involved in such cases then real litigants can say goodbye to their cases ever coming up.

    Now that AAP is going strong in Delhi, both BJP and Congress will do all they can, to stop them. Otherwise, if not in this election, then in the next couple of years, they will be a force to reckon with. If AAP does, even 50% of what they have told us as their intentions, this country will be a better place. And a lot of Congress and BJP leaders will be really unhappy about this.     Court was moved by a PIL from a Lawyer M.L.Sharma. Central Govt. had nothing to with it.
    Now the Delhi court has ordered central Govt. to look into AAP's accounts and file a report by Dec. 10, 2013.
    Your Kill The Voice \ Kill the Person is never done by Central Govt. May be some other political party that you know of.
    You are hallucinating and making wild allegations against the central Govt. without any basis.
    BJPians always have their knowledge of things "DOMPRA SAKKAIL" (below knee level)
