Aarushi-Hemraj double murder - Court convicts Talwars

Ghaziabad, Nov 25 (IANS): Dentist couple Rajesh and Nupur Talwar were Monday held guilty of murdering their teenage daughter Aarushi and domestic help Hemraj five years ago in a case that grabbed the nation's attention with dramatic twists and turns.

As Special CBI Judge Shyam Lal pronounce them guilty, the Talwars -- who were well known doctors with a thriving practice -- broke down, lawyers later said. But the couple insisted that they were innocent and vowed to fight for justice.

The quantum of punishment would be pronounced Tuesday.

Soon after, police took away the doctors to the Dasna prison in Ghaziabad district.

Aarushi, 14, and domestic help Hemraj, 45 and from Nepal, were found murdered at the Talwars' plush residence in Noida bordering Delhi in May 2008.

Aarushi was found dead with her throat slit and the head battered May 16.

Police, who first believed that the missing Hemraj could be the killer, dramatically found his body from the terrace of the house a day later. He too had been killed in near similar fashion.

It marked the start of one of the most sensational crime cases India has known in recent times.

On Monday, the Talwars were booked under sections 302 (murder), 34 (acts done by several persons in futherance of common intention) and 201 (destruction of evidence) of the Indian Penal Code.

Rajesh Talwar was also booked under section 203 (misleading the probe).

As the media was not allowed inside the packed courtroom, it was Hemraj's lawyer Naresh Yadav who came out and announced the "guilty" verdict.

He said when he entered the courtroom, the judge wanted to know if the couple was present. When they were pointed out, the judge looked at them and pronounced the verdict.

Immediately after the judgment, the Talwars said in a statement released by their lawyer that they were "deeply disappointed".

"We are deeply disappointed, hurt and anguished for being convicted for a crime that has not been committed. We refuse to feel defeated and will continue to fight for justice," the statement said.

The case was a virtual whodunit as it took several twists and turns.

Initially, police in Noida arrested Rajesh Talwar for the double murder, with officials speculating it could be an act of "honour killing".

But as the police probe came under attack, then Uttar Pradesh chief minister Mayawati transferred it to the Central Bureau of Investigation (CBI).

The CBI first gave a clean chit to the Talwars and arrested the lab assistant of the Talwars and two others.

But they were released on bail after no concrete evidence was found against them.

Facing flak over the inept investigation, then CBI director Aswani Kumar formed a new team.

It was this team that again pointed the finger at the Talwars.

The latest trial got over Nov 12 - almost after 19 months - during which the CBI presented about 90 witnesses to prove that the parents were indeed guilty of the crime.

The Talwars maintain they did not kill their daughter or domestic help and that the CBI conclusions were based on presumptions, conjectures and surmises.

    I feel very sad and grieved.
    If Arushi was killed by her parents than
    parents made big mistake that they are keeping her with male servant
    ( Now may they repented grieved cannot bring back precious diamond what they lost.)
    Instead of blaming Arushi I will blame Hemaraj.He was the age of her father may his aged people become grandfathers too
    Arushi was a teenaged girl, in that age any children may do wrong things and really need correction, advise from parents and elders
    She was home alone in much time with male servant .
    If she is trying to do something wrong he has to try to correct her must advise her or tell her parents to advise her. because he was trusted by them . he was working earning daily bread from them is he was honest or he took advantage of that opportunity?.

    May be he miss leaded , misguided , took advantage of them. alone in home may he tried her to tempt her by showing blue films…and may teenage mind filled with lust not knowing whats will happen feature.

    And May when parents come and found the position and fit of anger father hit what weapon he got, and may went wrong place.
    9 month carried in stomach painfully delivered child, any mother will not let this happen, if her husband do like that than she will complaint police and stay from him because of child. I don’t know here what happened also.
    (No one parents like to kill their children.some may somewhere cruels selfish have )
    Here they had only one rose flower she is the joy,happiness and wealth for them, the only child and if they want to kill what they have in the world for them without her. I Don’t think they really want to kill.

    It is a very unfortunate episode.

    Unfortunate because none of us parents plan on being killers of our own children.

    Unfortunate because all of us parents have big dreams for our children which can be shattered in nano seconds.

    Unfortunate because in those nanoseconds we may not be able to restrain ourselves and could be led into committing the crime of passion.

    Unfortunate because we might thereafter need to lie to preserve the character of our child although deep down in our heart and soul we know that none existed.

    Unfortunate because at the end of it all it is only we parents who are to blame because we thought that we did we did it for our children.

    Are we really there for our children? Are we doing whatever we do for our children?

    I personally feel that the " media hype " has sent the Talwar's to Jail / gallows. Today, it is the media which influence the Courts and which is very bad for justice. Today the media act as the Supreme Court Judge. Only when the same journalists family member is in this boat will they realise the gravity of the problem. It is a very sad thing.

    This trial is bizarre. In other instances the murderers even if have been seen killing someone in broad daylight get Scot free for lack of witness. But in this case there is no witness and yet court finds the accused guilty even after investigating agency asks for closure of the trial. The law should give the benefit of the doubt to the accused.

    You can convict anybody with circumstantial evidence in rare cases....here above phenomenon is responsible for this conviction.

    Only persons who could have done this as per evidence presented by "CBI" are the parents...with so much publicity perhaps judge has no other options...I feel this judgment would not stand scrutiny at higher Courts..

    The judgement is made, But the questions remain, 1, Was talwar's being doctors so stru*id to leave the body of Hemraj on the terrace and allow it to rot there? ,2. How was the pillow cover of arushi found in Krishna's house, 3.How the mobile of Arushi found in Nepal? 4. The naco analysis report indicates the servant had accepted to have murdered Arushi, so why the report was not submitted to court? 5. The fingerprints on the alcohol bottle having blood strains did not match with the talwar couple, then whose fingerprints are those?

    CBI Court upheld their investigating Agency & their version of circumstantial evidence based on a story to teach a lesson to Talwars who wanted to fight despite the closure report to get justice to their daughter.
    Higher Courts will not convict anybody on this evidence which is not proven beyond any doubt.
    Anybody can be framed & evidence can be concocted by our present system. Truth is a casualty here, but won't be so in future.

    Some Parents keep lot of expectations from Children!
    But when things go totally against their wishes, they lose heart and some LOOSE TOTAL CONTROL! VERY BAD!
    In such situations, the only option before them is to withdraw, and leave everything to fate!
    Ultimately parents don't give us life, God alone has the right to our life!

    Any parent in a similar situation could lose control. Lack of evidence and a lot of speculation cannot result in a conviction. Best is to leave them alone. The thought of the dead daughter itself is punishment enough and if they were indeed killers, the torture would be even more, they do not need any other punishment.

    I’m not happy with decision , this was not 100 right decision , we know that parents are involeved in the murder but this case lack o evidence , CBI closure report based on assumption and theory analysis , the motive was not clear and the way the case handled by UP police beginning not on the technical ground so CBI could’t get trigger point , as a criminal law student what I feel is they can appleal higher court and get relief easily , it’s sad most of cases influenced by media trail and people sentiment , law should not influence any case

    No one parents want to kill their children and her parents too. she was only loving child they had, they trusted. and what was going behind the curtain not knowing . when they came home looking front of their eyes cannot controlled, hot temper hit and may went wrong side, so bad, taught may she will not survive looking suffering may they killed and witness the one who was and he is the reason to this so may they kill him too.
    They cant face society, world so may they tried to hide. They cannot forget her or the crime, what happened, may until death. only God has to take out that from them. who experienced that kind pain, sorrow only understand. (not easy to come out loosing only child) They are already in emotional hell
    when she grow they has to keep maid instead of man, because she is girl, they may trusted this man, thinking he was like father want harm do any wrong, and their thinking went wrong,
    That man also being a trusted servant must think doing like that for employer child.
    In this busy world parents don’t have time for their children. If children left to care with someone else don’t know what is happening, this educated busy working people and lost or kill only child and now burning in (emotional ) hell fire .

    @Christine, your comment on a parent cannot kill his own offspring is generic!! Do you not read almost every day the number of honor killings and the likes taking place in the North!! Just last week I read a news report wherein a girl from a very rich and high society family got married to a poor boy from another caste!! Now, they are totally in hiding fearing for their lives from her parents!! The fear was so much that they appealed to the HC about this threat to life and pleaded for protection!!

Here probably the parents were not able to just digest what they had seen in the majority of cases, the matter is covered up within close family circles and life goes on!! But there are castes who believe in honor killing and such things!!

    You can not blame the parents all the time. Especially at Arushi's case, Hemraj was 49 years (He must be having a daughter who must be much bigger than Arushi). Arushi's parents never expected their daughter or servant doing such things. So with so much of anger they must have killed them.

    As far as I can remember the police had at the very beginning conveyed the same circumstances where Aarushi and hemraj were found by the parents in a compromising position and in a fit of rage the parents punished them but at that time the media on the basis of Aarushi schoolmates, teachers' comments, created a hue and cry over police action. The media again failed and took steps to influence verdict.Sad but true.
