Indian diplomat row: Rahul, Modi, Shinde refuse to meet US delegation


New Delhi, Dec 17 (Agencies) : In a major snub, Union home minister Sushilkumar Shinde, Congress vice-president Rahul Gandhi and Gujarat chief minister Narendra Modi refused to meet a senior US Congressional delegation in New Delhi on Tuesday as a mark of protest against the treatment meted out to India's deputy consul general in New York.

Modi tweeted on Tuesday: "Refused to meet the visiting USA delegation in solidarity with our nation, protesting ill-treatment meted to our lady diplomat in USA."

India has asked the US to return all ID cards issued to their consular officers posted in the country. The move may be a precursor to reviewing immunity and benefits enjoyed by US consular officers in India, according to PTI reports.
Earlier on Monday, Lok Sabha Speaker Meira Kumar had also cancelled her meeting with the visiting US delegation.

Kumar had cancelled the meeting as she felt it was not "appropriate" to meet the Parliamentarians of the US Congress, which has badly treated one of India's senior diplomats, according to sources.

Significantly, national security advisor (NSA) Shiv Shankar Menon, who also had a scheduled meeting with the five-member US team, did not meet them, apparently for the same reason.

39-year-old Khobragade, a 1999-batch IFS officer, was taken into custody last week on a street in New York as she was dropping her daughter to school and handcuffed in public on visa fraud charges before being released on a $250,000 bond after pleading not guilty in court.

The delegations comprised of Congressmen George Holding (Republican - North Carolina), Pete Olson (Republican - Texas) David Schweikert (Republican - Arizona), Robert Woodall (Republican - Arizona), Madeleine Bordallo (Democrat - Guam).

US hides behind 'standard procedures'

As media reports that Khobragade was "strip-searched" after her arrest in New York threatened to escalate a diplomatic row between the two countries, the US suggested it had merely followed "standard procedures."

While "no comment" was forthcoming from the Indian side about these reports, attributed to unnamed sources about Khobragade, India's deputy consul general in New York, the US state department sought to pass the buck to the justice department and the local police.

"The state department's diplomatic security followed standard procedures during the arrest," spokesperson Marie Harf told reporters Monday when asked why the US was not respecting basic courtesies to a diplomat as it expected others to respect its own diplomats.

"After her arrest, she was passed on to the US marshals for intake and processing. So for any additional questions on her treatment, obviously, this would be the US Marshals and not us. I would refer you there," she said.

According to media reports, Khobragade, who was arrested in New York last week over alleged visa fraud and exploiting her housekeeper and babysitter, was not only handcuffed, but was later strip-searched in custody and made to stand with common criminals, drug addicts and sex workers by the New York Police.

On the question of Indian Lok Sabha Speaker Meira Kumar and national security advisor Shivshankar Menon canceling their meetings with a visiting congressional delegation to show India's displeasure, the State Department spokesperson again sought to pass the buck.

"I think I'd probably point you to the congressional delegation to comment on that. I'm happy to look into what happened exactly further. I just don't know the details," she said.

Harf also made a distinction between "diplomatic immunity" and "consular immunity."

"Under the Vienna Convention on Consular Relations, the Indian deputy consul general enjoys immunity from the jurisdiction of US courts only with respect to acts performed in the exercise of consular functions," she said.

"This isn't just in the US; it's all around the world. So in this case, she fell under that specific kind of immunity, and would be liable to arrest pending trial pursuant a felony arrest warrant," Harf said.

Asked about the US reaction to its Ambassador in New Delhi, Nancy Powell being  summoned by the Indian Foreign Secretary Sujatha Singh to protest about the treatment meted out  to Khobragade, the spokesperson had no update.

Harf said that after the arrest the US assistant secretary had discussed the matter with the Ministry of External Affairs and the Indian Embassy, while "Powell has had discussions on the ground. I just don't have an update."

    Indian diplomat has not only violated US immigration laws, she treated her maid very badly, First she brought a girl from India under tourist visa only the purpose of working as nanny( housemaid ) in her home. This is illegal she is well aware about US laws. Secondly she paid less than $7.25 per hour(Remember $7.25 per hour is the minimum salary in US, If anyone pays less than this minimum will be punished as per the law) Also she made her to work all through day and night with the same Indian form of salary. This matter also comes under harassment and there is a separate department for harassment
    Regarding handcuff in the public area is common in US for any offender whether the culprit is poor or any dignified person including ministers , if he/she found guilty
    If this Indian diplomat really a dignitary person, then she should have known the depth of crime she is doing She might be thinking that for her crime as if in India as VIP car will come and take her to Police station with salute. It’s a national shame being a high dignitary person, govt look this matter seriously and sack this corrupted diplomat immediately and bring her to India instead of supporting her and stooping down to ill level.

    In world history, INDIA never looted any other counrty's wealth or attacked. Yes India helped TWO neighboring NATION without harming their CITIZEN or to their wealth. Anyone asks, they'll say" Don't ask us, an Indian American did this" She was arrested by one agency, handed over to one agency, investigation is done by one agency. And the state department is making statements based on assumptions and is passing the buck on every question asked to them. Diplomatic Immunity and Consular Immunity? Why did this clause surface all of a sudden when the US is in trouble? Domestic violence case, but treated as a criminal and stricp searched, and DNA swab? are you kidding me? who does that before an investigation is initiated?

    Most of the people do not read or try to understand reason behind ill treatment meted out to the Diplomat. From what I read from Local New York Newspapers, she paid a wage of $ 3.00 per hour to her maid/babysitter whereas the minimum wage is $ 7.25
    per hour what I know. This is extremely strict law. People underpay their workers probably even Diplomats from many countries do so, but if you are caught,the law is strict, you suffer consequences. The treatment given to our Diplomat is extreme, Law Enforcement personnel did not treat her according to treatment provided to a Diplomat, that is true. Diplomatic immunity is not provided to her. There is something more to it which we don't know. All I can say, she should have been treated with dignity which is due to her.

    Yes Harold, the charges are serious, but where they proven in a court, they acted on complaint of an absconding maid who got their Visa after a case was filed 2 months back, a court order from our country is sent to them to trace her, which was ignored.
    They could've approached the Embassy & got her statement first then they could've prosecuted her if charges are proved by evidence collected.
    Violation of Immunity & Norm are far too serious to be condoned by any Civilized Nation or State which itself transgressed Human Rights of Many all over the world in the name of Weapons of Mass Destruction or any other pretext to Usurp the Oil Wealth.

    Jossy and Dinesh, I do not understand why we proud Indians try for USA visa and many apply for Green card & citizenship in USA.

    Because of our own attitude, USA always shows their superiority and Uncle Sam character. Today,17th Dec 2013, first time in the history of India, the present Home Minister has showed some guts.

    Daiji has not published what action HM has taken. They have even down sized all the privileges given to US consular members in India. Glad that the present govt. showed their guts to USA in counter attacking them. I am real proud the way HM handled the situation and given a tough reply in action. Jai Hind.

    Dear Harold, are you not aware who the media are pandering to these days as we approach elections ? Even the softest BJP fart is hyped up and portrayed as some great achievement/feat. On the other hand even significant Congress achievements or any reputed personality/celebrity speaking for the Congress or against BJP hardly gets any mention or coverage.

    Wah bhai wah..Everybody wants to take political advantage of the situation. Why don't these clowns understand that in US, law treats you same even if you are president or common man. Indian diplomat has committed mistake and definitely she deserves punishment. US authorities don't have to treat this influencial lady differently. It is only in India, influencial people can do anything and they are the one's who find out loopholes in every law and avoid punishment. US law authorities are strict and it doesn't spare even the president. Nothing wrong in showing solidarity with Indian diplomat. But when she has done wrong, no need to show any solidarity or support. By supporting this lady, we are showing the world that we support criminals.

    According US claim not enjoying immunity in this case, at the most they could've deported her as they cannot try her as a common citizen or visitor to their country.
    Soviets always retaliated by arresting their counterparts under espionage charges & only let out once their own diplomats or staff was released first.
    It seems US is heading towards Dictatorship on all, including its own citizens as per their claims of Freedom falling flat in many cases like Julian Assange & Snowden.

    Read the Vienna accord for diplomatic immunity IT IS NOT FOR CRIMES COMMITED IN FOREIGN SOIL- SHE COMMITED A CRIME . Is that ok with you- taking a person and paying subpar wages and keeping them with out their will - Slavery- it is a crime in the US may be a daily occurance in India. The diplomat is a diagrace to India.

    The in charge of her case is an Indian too!!!

    BOB, do you know personally that she was paid subpar wages. If you read the Maid's statement, she said that she was promised $4300 per month as wages. The salary of that diplomat is $4000. How will she pay the maid more than her salary? And this isn't the first case. Our ex president, defence ministers have been detained and strip searched at the airport? Is this procedure or has the US gone bananas?
