Rajiv assassination case convicts to be set free


Chennai, Feb 19 (IANS): The convicts in the Rajiv Gandhi assassination case would be freed, Tamil Nadu Chief Minister J. Jayalalithaa said Wednesday.

Announcing the government's decision in the assembly, Jayalalithaa said the government would release V.Sriharan alias Murugan, A.G. Perarivalan alias Arivu, T. Suthendraraja alias Santhan, Nalini, Robert Payas, Jayakumar and Ravichandran.

All the seven are convicts in the former prime minister Rajiv Gandhi assassination case.

The Supreme Court Tuesday commuted the death sentence to Murugan, Perarivalan, and Santhan citing the inordinate delay in deciding their mercy petitions.

The decision was taken in the cabinet meeting held Wednesday.

She said the state government's decision will be sent to the centre. If it does not respond within three days, the state government would release all the seven convicts.

Gandhi was killed in May 1991. The conspirators were convicted by a TADA court in January 1998 and were awarded death sentence, which was confirmed by the apex court May 11, 1999.

    There can be no doubt, capital punishment should never have any place in a democratic society therefore the verdict should be appreciated.
    The only moral justification for killing a person is in direct self-defense. When a criminal is defined in prison, he does not threaten society, so killing him is not justified by self-defense. And even if capital punishment deters others from committing similar crimes, this would be an indirect defense against murder rather
    than directly from the criminal being killed. Direct self-defense implies killing someone who, himself, at that time, is a threat to other persons, and this precludes taking human life just for punishment.
    Some studies have concluded that capital punishment is not a greater deterrent
    than imprisonment. Even if the death penalty deters crime, deterrence alone does not justify the penalty. Deterrence has to be balanced with the human rights that even criminals have.
    I am of the opinion, capital punishment is morally wrong, then to deliberately kill someone, who has already been captured and no longer a direct threat to society, is murder.
    Capital punishment gives the government the legal right to commit first-degree
    murder. What kind or moral message does that send? That murder can be proper.
    We might debate over the circumstances of when murder is proper, but having
    established the principle that murder is not absolutely wrong, the state is brought down to the level of the criminal: both are murderers. But society and government should be nobler and more righteous than a murderer. There cannot be any place for capital punishment in a democratic society.
    There are four morally justified purposes for punishment. First is the protection of
    society. The second morally proper reason for punishment is to reform and
    rehabilitate the criminal. The third legitimate reason for punishment is deterrence.
    The fourth reason for proper punishment is the restitution of the damage.None of
    these four morally legitimate reasons for punishment includes revenge. Vindictive
    killing and infliction of pain might make the victim or his relatives feel better, but
    this goes beyond what is morally justified for restitution and protection. Two
    wrongs do not make a right.

    Supreme Court has exempted them only from death punishment and insisted for life imprisonment. How a govt being administrative wing can take the law & an order into their hand by releeasiing the culprits?

    It makes sense to release convicts who have spent many years in jails....Now we have to send the politicians into jail for the way they behave and we need lots n lots of places for them....may be there wont be terrorism as well as we citizens will have lots of peace and can live well......

    ..i really not able to understand the whole issue..Death penalty commuted to life sentences by SC but state Govt going to release the killers!! Is state Govt above the Law or whether the killers already spent life sentence (say 15-20 years) in jail?..If decision taken in haste then this will have bad impact considering the Afzal Guru case..somebody please throw some light..

    This is the darkest reality of Indian Politics. even the Apex Court has played politics this time by giving the right to state Govt. to release these killers of innocent people, including the former prime minister. This is nothing but a shame on a country where regional governments and parties are able to release killers scot-free for the sake of winning elections.what may be going through the families of those who lost their lives in this bombing. are they also not the natives of Tamilnad? has Jayalalitha or Karunanidhi thought of the people who were killed before they demand the release of their killers?
