Delhi court frees man after complainant found missing


New Delhi, April 11 (IANS): A court here has let off an accused charged with theft and trespass after the complainant in the case could not be traced.

Metropolitan Magistrate Ashok Kumar, in an order delivered last week, acquitted Faisal Khan, who was facing charges of house trespass and motorcycle theft.

The order was made available Friday.

The court observed that complainant Taushir Ahmad and witness Kamar Ali are untraceable. "Summons issued to material witnesses namely Taushir Ahmed and Kamar Ali through all modes, including through concerned deputy commissioner of police (DCP), were received back unserved with the report that there is no person by the names residing at the given address."

"In my view there is no use continuing with the trial," the judge said.

The court closed the case and ordered that the accused is acquitted of all the charges levelled against him.
