India in 'dereliction of duty' over rapes: UN watchdog


Geneva, Jun 20 (AFP): Indian law enforcement and justice authorities have shirked their responsibility to fight sex attacks, a UN child rights watchdog said thursday, amid uproar over the horrific gang-rape and lynching of two girls.

"There has been a dereliction of duty in relation to rape cases," said Benyam Mezmur, deputy chairman of the UN Committee on the Rights of the Child.

India has been struggling to overcome its reputation for sexual violence since the fatal gang-rape of a student in New Delhi in December 2012, which sparked mass protests and drew international condemnation of India's treatment of women.

Public outrage was reignited last month by the deaths of two girls, aged 12 and 14, who were gang-raped and lynched in their impoverished village in Uttar Pradesh.

A string of other headline-making cases have piled pressure on the authorities.

The UN committee is made of up 18 independent experts who monitor the implementation of international children's rights treaties. The panel held a hearing with Indian officials earlier this month.

In its conclusions on that session, released Thursday, it said it was alarmed by "widespread violence, abuse, including sexual abuse, and neglect of children".

It pointed to data showing that one in three rape victims in India is a minor and that half of the abusers were known to the child or in a position of trust and responsiblity.

"We're not only interested about those cases that attract international media attention," said Mezmur.

He said they were the tip of the iceberg.

"We're also very much concerned about those that do not benefit from the media attention, do not get to be reported to the authorities, do not command a protest in the streets of the cities or the villages where they have been committed."

A rape occurs every 22 minutes in India, according to government figures.

India brought in tougher laws last year against sexual offenders after the New Delhi gang-rape.

But the legislation, which was also designed to educate and sensitise police on rape cases, has failed to stem the tide of violence.

And the UN committee noted that the 2013 law failed to criminalise sexual abuse of girls over the age of 15, provided they were married -- in contradiction with legislation passed the previous year on child protection.

Mezmur said there were major concerns about the "implementation gap" between different federal and state laws, a lack of capacity to apply rules, and inadequate crime data.

The UN committee also criticised comments from political leaders who have played down the problem.

Among them have been state BJP ministers who have said that rapes happen "accidentally" or are "sometimes right, sometimes wrong".

The UN committee also urged India to take immediate measures to prevent female infanticide and abandonment of girls, and ensure implementation of rules against sex-selective abortions.

    Why should the UN watchdog only watch India ? Are they employed only for this ? Please go through the website : rape cases in the world for 2013 -14. You would be shocked finding that the rape cases in India is one of the lowest. A small state / country like England has far more rape cases than the whole of India.

    What happens when a woman outrages the modesty of a man ? Is that termed as rape in India ?

    Unlike other jurisdictions, such as Australia, much of the US, and many Western countries, 'rape' in the UK is not a gender neutral offense: it is an offense that can only be committed by a male against a person (female or male). Also the UK has not to date followed the trend in many Western countries of classifying acts other than penetration with a pen** (penetration with an object, finger) as rape. These must be prosecuted under other statutes (e.g. Sexual assault, Assault by penetration).

    In Scotland, rape is now more common than robbery following an explosion in reported cases. New figures show there were 1690 rapes between April 2013 and March 2014- a 23% rise on the previous year.

    Sexual crime also increased 11.8% over the period.

    In fact, it far less in India comparing the land mass.

    Unless we are unable to change the law system in India. Rape will never stop. Life Imprisonment till his death or Hang without making any delay is only the way to reduce Rape. I feel ashmed myself now to introduce as Indian with foreign countries. Sushma swaraj was raising her voice to make change in law say that they should be hanged. what happened now? why are they silent. please dont let people to loose hope on NDA govt as like UPA did.

    Our justice delivery system has a long que. MMS or Modi, Sonia or Sushma, Kurshid or Ravi shankar Prasad, Jaya or Mamta, ......nothing will change. This comment of dereliction of duty is a slap on every Indian's face. In India these crimes are committed or at least accused at highly placed people - Tehelka hero, Minister in Modi Government, Retired Justice holding human rights post, Bapuji in Ashram, Orissa senior Police Officer's son etc. Do you think any law can control? The lawyers supporting these highly placed accused will argue that they were innocent until proved guilty.

    this is funny to read .according to reports, the highest number of rapes that too in 13-18 years are occuring in usa.most number of abortions are occuring in usa.but un doeasnt want to talk to usa regar ding this bcoz they have been appointed byusa itself.but they are quick to point any lapses in country like india and china.there is a saying in india which goes "instead of pointing to some dead insects in somebody else's plate,first we should concentrate on dead rat in our own plate'

    In India most of the rapes are not even reported. Even if we have less rapes than USA we should be ashamed. We take so much pride in our culture. Even one rape should not be tolerated. So instead of telling UN to point their finger at USA let's clean the insects in our society.

    Just make an assessment of abortions and rape in our own country India and in Bharat Vasthapaharan.

    In the USA rapes and abortions are assessed and they don't hesitate to disclose to the law enforcement.

    Do we have such a true assessment or hidden assessment???!!!

    Check daily how many rape cases are a hidden fact and how many abortions are hidden fact.

    Here in India if disclosed rape cases the police will take opportunity to rape the accuser herself.

    This is published in many Indian papers and probably outside the country. We cannot do anything than weep for our country. The decline in morality of our people, insensitive police and careless politicians are responsible for this God save our country from these atrocities on women who are our mothers, sisters, wives and daughters.
