Government acted unilaterally in keeping out Subramanium: CJI


New Delhi, Jul 1 (IANS): In an assertion that may pitch the government and the top judiciary head-on, Chief Justice of India R.M.Lodha Tuesday said that the government acted unilaterally in segregating the name of former solicitor general Gopal Subramanium from the panel of four names recommended by the collegium for appointment as apex court judges.

Chief Justice Lodha made this disclosure at a function organised to bid farewell to Justice B.S.Chauhan upon his retirement Tuesday.

"The segregation (of Subramanium's name) was unilaterally done by the executive (government) without my knowledge and consent," Chief Justice Lodha said at the function.

The apex court collegium had recommended four names including that of another former solicitor general Rohinton Nariman for appointment as judges of the Supreme Court but the government, while clearing three names, returned the name of Subramanium for reconsideration by the collegium.

While Chief Justice Lodha expressed his dismay with the government segregating Subramanium's name and returning his recommendation, he also expressed regret over Subramanium jumping the gun and releasing to the media a letter written to him while he was abroad.

He said that he had asked Subramanium to wait for him to return and deal with the matter.

Chief Justice Lodha said that soon after reaching Delhi, he had a 75 minute meeting with Subramanium and asked him to reconsider his letter withdrawing his consent to be a judge of the top court.

"Subramanium told me that he would get back the next day but instead he sent a brief letter expressing his inability to revisit his decision to withdraw the consent" he said.

"Independence of judiciary will never be compromised," Chief Justice Lodha assured the members of the bar present at the function as he referred to the excerpts of Subramanium's letter wherein the latter had said: "I am, however, unable to dispel the sense of unease that the judiciary has failed to assert its independence by respecting the likes and dislikes of the executive."

Describing as "shocking" the allegation of independence of the judiciary being compromised, Chief Justice Lodha said that he will not sit on the chair of CJI even for a minute if the independence of the judiciary was compromised.

Saying that he was a fierce upholder of the independence of the judiciary, he said that he had worked for the institution first as a judge of a high court, then of the apex court and now as the Chief Justice of India.

    ..Subramanian is educated fool..watched his NDTV interview, this guy is full of ego..MODI Govt clearly said that, actually president received complaint & president returned his file to Govt to take a decision..now Govt is duty bound to refer it to collegium..Its not end of the world..collegium didnt took any decission yet and CJI is out of country but SUBRAMANIAN gone public with media,blasted Govt,blasted CJI/SC & withdraw his candidature..now whose fault it is..SUBRAMANIAN is preoccupied by Sha incident, otherwise there is another Judge who also faught against gUJRAT Govt on MODI/SHAH but MODI Govt didnt object for his elevation..For Congress supporter information, this not first time in History..Congress rule always had this type of action, even in UPA1 & UPA2 it happened..only news trader making hue & cry..

    modi style of functioning.the day when modi became pm, the supreme court opined heavily about handling akshardham case n acquitted the innosent muslims.now gopal subramanyam paid price for being truthful and just in fake encounter cases.Destruction of truth not surprising under this central govt.

    But when same courts acquitted MODI & his aid you wont believe..Congress leader Pappu says judgement is premature!!! For you info, during Congress rule even supreme court judges are appointed by Govt..but some one filed PIL in supreme court, Congress Govt faught against it but SC said Govt cant appoint but can have a opinion in appointments..

    Thank God we have people of the caliber of Chief Justice of India R.M.Lodha, people of integrity who have enabled the independence of the Judiciary "so far" - there should be no political influence in this sector. Modi Government has erred by rejecting the name of Mr. Gopal Subramnium - simply because it felt uncomfortable given his no nonsense and blunt approach. I am glad the CJI has expressed his views so that in future dictatorial tendencies will be curbed .. we do not want India to be under a "veiled Emergency Situ" just because the party in power (who I totally support) has a full mandate to Govern, besides there is NO opposition worth its salt to put the breaks. Congress is a spent force and I must say will be relegated to the History Books,.

    If we see this unfortunate episode in a apolitical angle,perhaps this one is very very unfortunate and unprecedented.The Judge was ed by colloquium consisting of judges of SC.But inexperienced in National affairs (because Modi fought tooth and nail in Guj and almost spent 25 crore of treasury money of Guj to avoid LOKAYUKTA institution(constitutional institution)in Guj but SC slapped in his face and LOKAYUKTA was instituted. This totalitarian and one man show in democracy came in his blood and for this certainly we are not proud of...
