No case for Congress to claim LoP in LS: Attorney General


New Delhi, Jul 25 (PTI) : In bad news for Congress, Attorney General Mukul Rohatgi has opined that the party has no case for claiming the Leader of Opposition (LoP) post, saying there is no precedent since the days of the first Lok Sabha when Jawaharlal Nehru was the Prime Minister.

Rohatgi has conveyed this to Lok Sabha Speaker Sumitra Mahajan who had sought his opinion in view of the dilemma she is facing over the issue, sources said.

The AG has said Congress is not eligible as it does not have the required 10 per cent (55 seats) in the 543-member Lok Sabha, the sources said. Congress has only 44 seats.

To back his opinion, the AG has said there is no precedence where a party was given the LoP position -- the status of a Cabinet Minister -- without meeting the criteria of 10 per cent seats since the days of first Lok Sabha when G V Mavlankar was the Speaker, they said.

Even during the time of Rajiv Gandhi, Congress with over 400 seats had refused to grant LoP status to TDP for the same reason, the AG has told the Speaker.

The AG is also learnt to have rejected the contention that LoP status could be given to the leader of Congress-led UPA coalition as there is no such precedence. UPA has 60 members in the House.

Lok Sabha Secretariat officials refused to make any comment, saying a decision in the matter was yet to be taken.

Mahajan, who has been facing the tough situation on taking a call on the tricky issue, has said that she would consult legal and constitutional experts besides experienced persons in firming up a decision.

Reacting to the development, Congress, which has recently upped the ante over the issue, hoped that the Speaker will "not be misguided" by the opinion of the AG.

"Attorney General represents the government's opinion. He articulates the government's viewpoint. Government has nothing to do with it (LoP issue). It is the domain of the Speaker. We will react after the ruling of the Speaker," Congress General Secretary Shakeel Ahmed.

Congress and Government have been trading barbs over the LoP issue with the main opposition even bringing the Speaker in its line of fire on the issue.

Asserting that the post of Leader of Opposition is its "right", the Congress party has accused the government of playing "petty politics" over the issue and hoped Speaker Sumitra Mahajan will not allow her judgement to be "coloured" by various shades of politics.

Congress has been peeved over the delay in deciding on the issue and suggested that the Speaker might be consulting the government.

"This (delay) means a decision will be taken in consultation with the government. This means whatever the government will want will happen," Amarinder Singh said.

The government side reacted angrily saying the Congress' views reflected its "desperation" while Mahajan declined to wade into the LoP controversy.

Singh, the Congress' Deputy Leader in the House, has said the party has written to the Speaker to formally demand the LoP post.

    I would suggest a via media since they could not get 10 pct of the seats I suggest that the Speaker that she will agree that every four members agreeing to have the post given to the INC she would count them as one vote to make up for the shortfall to 10pct strength, so they must get the OK from 44 Mp's and these Mp's will have to (a) sit with the INC benches (b) vote as per the whip of the INC (c)have the written authorization from their own parties that this commitment stands till the next elections (they will for all practical purposes be INC members but not get debarred by the anti defection laws.
    I understand that LOP in Lok Sabha has all the frills & thrills as a Cabinet Minister so maybe the INC is looking for at least this "position".

    Kuldesh, i dont want to offend religious feelings..but i saw RAHUL many time with topis,namaz,ifthar prayer so on..but never saw any picture of him in church or temple, or in pooja..this is the case of almost all congressmen...either they are fooling some community or they think, to be secular you have loose your religious identity & appease a particular community..

    Vincent whose fault it is any away..in schools there is % rule for pass,say 45%..if a student didnt got 45% he is failed, school cant change the rule..why congress didnt thought in 60 years to change the rule & seat with more numbers as opposition party..why largest party cant form Govt..why Nehru ruled INDIA nearly 16 years without opposition party..why INDIA/RAJIV didnt took pain to give opposition leadership..for everything there is bench mark..loosers are loosers..they have to face humiliation for witch hunt/wrong doing..anyways if they prove they are better than BJP, can beat BJP in next election..its democracy..

    Whoever is eligible to be LoP, but the question still tingling to me, this "thumping"victory of BJP and "dumping" of Congress in 2014 election, is it real or manipulated. I suspect either malfunction or manipulation in the balloting machine all over India and EC may be involved in this, because there cannot be such a vast margin of difference in the result comparing to previous elections.

    Ms. Savitha, As per my views goes, it makes no difference whether BJP/Congress/any other party's WIN, BUT the vast margin of seats win and defeat AND vast margin of votes difference pertaining to so many candidates won, are the points that make me to reflect the authenticity of the election/ballot machines. Kuldesh's comments are really appreciative and it is his opinion, but Indian politics is really VERY DIRTY.

    Long ago Congress started divide & rule policy in all sectors which paved way for regional parties to thrive and here they are today! With BJP 282, Congress 44, all other parties are simply regional parties with about 145 seats belongs are OTHERS (non NDA, non UPA).

    My mother always voted for GOP because Indira Gandhi ordered land reforms and all petty farmers got ownership of the land they were tilling in DK. That was in 70s after that Congress has not passed a single legislature to the benefit of minorities. they could have passed proper laws to strengthen the institution like lokpal, police reforms, legal reforms, reforms in education and taxation etc. They don't deserve to be sitting in LOP chair give that to AAP which has 4 MPs they will do a better job.

    former pm mms told once before "minorities have the first right to countries resources".this was told just for votebank purposes and nothing else.in my view or public view neither minorities nor majorities ,but the countries poor people have the first right to natural resources.upa govt during thier 10 year rule particularly last 5 years(upa2) have thought that thay can do anything with majority population or give any statement against majority and survive(and flourish) and the majority vote can be divided on the basis of caste,color,region etc.no congress govt from 1947 to 2004 have played with majority and miority card.thier slogans were all inclusive and pro poor.these type of arrogance led to thier recent humiliating defeat such that they dont even have the number to secure
    lop post.i hope atleast now better sense has prevailed.

    Congress should stop its effort because
    (a) It does not have number
    (b) It did not give LoP to TDP before
    (c) It should follow constituional requirement
    (d) If it argues UPA has number above required 55, then third front (Jaya, Mamata, Biju etc..) may say, it has above 100
    (e) It should try to accommodate all the opposition parties in thier effort
    (f) Congress should understand why third front members do not want to sit with it in Parliament
