Black money: NDA moves to make names public, top politicians said to be on list


New Delhi, Oct 23 (TOI): The NDA government has started filing charges against individuals having illicit accounts in overseas banks, clearing the way for disclosure of names of those who have stashed black money abroad, and triggering speculation that some prominent politicians may figure on the much-awaited list.

Sources said that prosecution has been initiated against one foreign account holder, and will soon be extended to another 15-20 who are on the 'HSBC Geneva list'. Swiss authorities have confirmed the identities of the persons on the list. Launch of prosecution in these cases will meet the condition laid down by Swiss authorities that names of account holders can only be shared with courts after charges are framed.

Prosecution proceedings by the income tax department triggered speculation about the identity of the foreign account holders, with political circles discussing names of a former Union minister and the son of another, a former MP with family links to a leading business house, and the scion of a political dynasty which is currently passing through a lean patch.

Significantly, finance minister Arun Jaitley did not deny the possibility of a former UPA minister being on the list. "I am neither confirming, nor denying. I am only smiling," he told Times Now, attracting a hostile response from Congress. When pressed, Jaitley said, "If my opponent's name is there, I will be very enthusiastic in declaring it."

Sources also said a fresh list of 19 persons having illegal accounts with Liechtenstein Bank will be shared with Supreme Court after Diwali. This will be followed by another 20-odd names from the HSBC list.

Launch of prosecution come amid resumed fight between BJP and Congress over black money. Congress latched on to the government's stand in SC last week that it could not disclose the names of foreign account holders against whom charges were not framed to say that the Modi government had done a U-turn on the issue. BJP hit back, with Jaitley saying they were hamstrung by treaties signed by the UPA which forbade the government from disclosing names of those not facing charges.

On Tuesday, Jaitley scaled up the retaliatory strike by saying that Congress would be embarrassed when the names came out. The two sides traded fire again on Wednesday, with Jaitley saying, "In case charges are proved against some politician and he or she happens to be a member of a political party, the names will be made public."

TOI spoke independently to investigators and learnt that the list shared by France of Indians having accounts in HSBC Bank, Geneva featured a few Congressmen and their scions with huge deposits at the time the list was leaked.

Interestingly, a former UPA-2 minister, who was sent a notice to appear for questioning to explain his deposits, is believed to also have bank accounts in the UAE and later claimed that he had closed his Swiss accounts long ago.

The government has so far recovered Rs 200 crore by way of tax and penalty from the names shared by Germany and France that included account holders in LGT Bank in Liechtenstein and HSBC Bank, Geneva. The total assessed income in the two cases has gone over Rs 600 crore so far. While prosecution is being launched against many account holders in the HSBC case, the income tax department had filed cases against 18 persons in the LGT Bank case.

After the French government shared the HSBC Bank list having names of 700 Indians in 2011, the finance ministry had asked the Directorate of Criminal Investigation (DCI) to probe the case. DCI had questioned some top industrialists over deposits estimated to be upwards of Rs 800 crore. A few leading politicians, including the son of a former minister in UPA-2 and the son of an influential Maharashtra minister who faced a humiliating defeat in the recently-concluded assembly polls, were put on notice after their names figured on the list.

The total tax and penalty in the LGT Bank case was estimated to go up to Rs 40-45 crore, almost equivalent to the amount that had been spirited away by 19 Indians whose income has now been reassessed to Rs 40 crore, sources said.

    This subject has been going on for the last 4-5 years with both the NDA and UPA. By now 90% of the black money must have changed names or hands or got diluted into various other accounts. The list may reveal high profile names whose balance will be in the thousands or lacs. The crores would have vanished into other safe havens. Will not be surprised if each citizen will have to pay to the govt. ONLY INR 15 for service charges by way of tax or increase in petrol/diesel/gas prices.

    I have accounts in Citi, icici, hdfc, sbi, karnataka banks. Minimum balance maintained in all. No need of zero balance Jan-Dhan accounts.

    For celebrating Deewali, I got unused patakis from local congress office. They had stocks since May 16th. Sound was not so good, but otherwise it was OK, not bad.

    Modi never claimed that he/his Govt. or any political parties/politicians are responsible for the success of the above mentioned achievements. He categorically stated the credit of these successful missions should go to all Indians.

    The central government’s move raises the following key questions:

    Why only these 136 names ?
    People of the country believe that the previous Congress-led UPA government had things to hide and blocked the disclosure of names. Now, with BJP government’s similar reluctance in sharing the names gives rise to a reasonable apprehension about its real intentions.

    By cherry-picking a set of names and concealing others, it has further confirmed the belief that the BJP is hell-bent on saving some of the influential people appearing in those lists.
    The truth is - there is no law in India or treaty with any country that stops the Indian government from taking action against the possessors of illicit money.

    BJP playing politics on the issue ?
    Two recent developments have confirmed that the BJP wants to play politics over the issue of black money, rather than solving it. First, is the central government’s turnaround on the non-disclosure of some names and second is the cherry-picking of names to score political points.

    Anyone who possesses illicit money, irrespective of his/her affiliation with any political party, must be brought to book. Politics should not be played, rather the promise made by Mr Rajnath Singh of bringing back every penny of black money sitting abroad within 150 days of coming to power, and that of Mr Modi of attributing such money to every citizen to the tune of Rs.15-20 Lakh per person, should be worked towards.

    Double Tax Avoidance Treaty is not the issue-A matter already settled by the Supreme Court :
    The Supreme Court in its judgement on 4th July 2011 after perusing the double Tax Avoidance Agreement between India and Germany emphatically conveyed that there provision or hindrance in the agreement that limits the disclosure of information. The SC also pointed, such a plea is untenable as no agreement can limit infringe upon the principles laid down in our constitution.

    Till date i have never seen a single congressmen or its left parties ever protested to bring black money. It was only BJP and Anna team started the protest to reveal and bring back the black money. Why ? Can any of the Khangress supporter in this forum Jossey, Joseph, Ajith, Peter, Roshan, Declan, Ismail and others can reply never wanted the black money coming to India. As per them there is no black money what a hypocrisy..When our PM has promised to bring these thugs are challenging his statement and making false allegations. I know you people will never grow up and want India to be developed. Feel like laughing when people here waiting for that money to be credited to their account, which shows their personality what they are...For your kind information it was not promised by MODI to distribute to everyone, it was just to make people understand the amount of money stashed in banks..as a common man like us dont know the amount how big it was..it was made simple by saying each person might get if it was distributed among the citizens based on the population count. Please wake up from your deep congress sleep atleast now.

    BJP claimed of black money way back in 80s, the claim then was bofors. It came to power and did nothing. By the way, it was Bofors guns played vital part in winning kargil war.

    So, barking black money and corruption gets BJP power each time. What they do after getting power, is actually matters. Till date all that happening is gossip and drama. BJP knows very well, they can not prove anything against congress. That is exactly the reason they are using media to create a perception congress is involved. If there was concrete evidences, BJP would have rushed to courts within 1st week. It would have dealt a death blow to congress, if BJP proved right.

    They know for sure cases will collapse in court. They are therefore, trying to bail themselves out. It will be like, we know it is congress, but we can't prove to court it is congress. And therefore, we are not at fault, on failure to bring back black money. This is as simple as that.
