Coal scam: Manmohan Singh, KM Birla, 4 others summoned as accused


New Delhi, Mar 11 (PTI): Former Prime Minister Manmohan Singh, industrialist Kumar Mangalam Birla, ex-coal secretary P C Parakh and three others were today summoned as accused by a special court in a coal scam case pertaining to allocation of Talabira-II coal block in Odisha in 2005 and asked to appear before it on April 8.

Special CBI Judge Bharat Parashar summoned the six accused on April 8 for the alleged offences punishable under Sections 120B (criminal conspiracy) and 409 (criminal breach of trust by public servant, or by banker, merchant or agent) of the IPC and under the provisions of the Prevention of Corruption Act (PCA).

Besides these three, the court also summoned M/s Hindalco, its officials Shubhendu Amitabh and D Bhattacharya as accused in the case.

If convicted, the accused are liable to be sentenced for a maximum of life imprisonment.

The case pertains to allocation of Talabira II coal block in Odisha to M/s Hindalco in 2005, when the then Prime Minister Singh was holding the coal portfolio.

CBI, in its FIR, had named Parakh, Birla, M/s Hindalco Industries Ltd and other unknown persons for alleged offences under Section 120-B (criminal conspiracy) of the IPC and under provisions of the PCA.

However, the agency had later on filed a closure report in the court, which had refused to accept it.

The court, in its December 16 last year order, had directed CBI to examine former Prime Minister Singh and some top officials of then Prime Minister Office (PMO), including Singh's then Principal Secretary T K A Nair and then private secretary B V R Subramanyam.

Parakh and Hindalco have denied any wrongdoing.

Pronouncing the order, the judge said, "I am taking cognisance of offences under Sections 120B, 409 of the IPC and under Sections 13(1)(c) and 13(1)(d)(3) of PCA against six accused, M/s Hindalco, Shubhendu Amitabh, D Bhattacharya, Kumar Mangalam Birla, P C Parakh and Dr Manmohan Singh."

Section 13(1)(c) of PCA relates to a public servant dishonestly misappropriating property entrusted to him or allowing any other person to do so.

Section 13(1)(d)(3) relates to a public servant obtaining any pecuniary advantage for any person without any public interest.

    Its not not unfortunate for MMS, but for UPA and whole of India as well. Though we may have sympathy with MMS, but have to believe in our Judicial system also. The Judge serving the Summon on MMS, is indeed a brave and highly law abiding person.
    It is also a great example of Democracy, and proving that, in India, no one is above the law, irrespective of the post held. We wish MMS proves innocent, but we all would like to know the truth also, in such high level and huge valued scam.

    Congress is worried and its unity at this occasion, is understandable, and it appears that, more than MMS, the leaders are worried about their own fate in this case. The outcome of this case is likely to raise many new questions. We wish that, the fairest trial shall take place and all Indians, shall know the facts.

    There is nothing against Ex PM MMS even now. The only accusation that is against him is he favored Hindalco. Where in there is enough evidence to suggest the entire process is done transperantly and with deliberation of all stake holders. To confirm the same all file notings are there. This summons is nothing but a high drama to keep the coal scam story alive for media. The matter may come up to SC, who will ultimately squash it. End of the day these kind of high profile cases could elavate a judge easily.

    Well Said Rajesh Shetty. He was the best economist ever. In 1991 if it was not for MMS India would have been in worst crisis. He was brought in by Narasimha Rao who was then appointed as Prime Minister. MMS handled the situation so well and brought Indian currency under control. So I never blame him and yes he became a scape goat for sure in the hands of the ruling party. His only mistake was he kept quiet even when so many things were going wrong in the country just bcoz he could not use his power. I feel sorry for him. He was absolutely in the wrong place. Hope all goes well for him since he is really done so much good but still some things which he kept silent for is the reason for the present situation.

    No doubt MMS is clean and no politician has a integrity to accuse Singh of hand in glove with Scamsters.

    His only mistake is His salience when he knew that his team members were grazing the forbidden grass, due to coalition compulsions, 10 Janpath instructions and finally he was made a scapegoat by his same party and left to go to court for hearing at this stage of life while the people who made money re honeymooning in Italy or Greece introspecting their party’s poll debacles. Right person in a wrong party. He will come out clean one day, no doubt.

    I know how many politicians who are accused got the punishment in Indian history other than political grudge. In Karnataka there are many such culprits roaming around and talking about welfare of the citizen.
    Manmohan singh may be the PM, but may be some of his office bearers got their cake for which you accuse him as corrupt?. Bid allocation is done on the basis of merits and the paper work before the PM might have altered to get his signature.
