Udupi, Feb 21: In an important decision against an appeal filed by the Yellur villagers, the Division Bench of High Court of Karnataka has ordered Status-quo against dispossession of the owners from their lands in connection with Nagarjuna power project at Nandikur near here.
The writ petition filed by Deju Shetty and six other villagers challenging the land acquisition was dismissed in November 2006 by the Single Judge on the basis of a “mahazar” produced in the Court by KIADB according to which 210 plots of lands were already in the possession of the KIADB from August 2005. Senior advocated S Naganand representing the petitioner along with Chandranath Ariga, argued that the mahazar is fabricated to mislead the Court and that the residents still are in possession of the lands. Justice Bennur Mutt and Justice Bopanna after hearing both the sides issued the Status-quo order.
