Maggi noodles row: Case lodged against Nestle, 5 others

Barabanki, May 30 (PTI): A case was lodged on Saturday against Nestle India in a local court in Uttar Pradesh's Barabanki over safety standards of its Maggi product, while actors Amitabh Bachhan, Madhuri Dixit and Preity Zinta have also been separately dragged to the court for promoting the 'two-minute' noodles brand.

While the case against Nestle India and five others was filed by the UP food regulator FSDA (Food Safety and Drug Administration), a local advocate filed a separate case against the three Bollywood personalities.

"Following FSDA Commissioner PP Singh's permission to file a case against Nestle India, a case has been filed in the court of ACJM (Additional Chief Judicial Magistrate) here," Barabanki Food Safety Officer VK Pandey said.

The case has been lodged against the company's Nestle Nagal Kalan Industrial Area unit (Haroli, Una in HP), Delhi-based Nestle India Limited, an Easy Day outlet in Barabanki and the Delhi-based parent firm Easy Day, as also against and their FMCG (fast moving consumer goods) managers, Mohan Gupta and Shabab Alam, Pandey said.

The FSDA had found monosodium glutamate and lead in excess of the prescribed limit in Maggi samples tested by it.

The FSDA had collected the samples from the Easy Day store in Barabanki and had sent the consignment for testing, which showed that the quantum of lead present was 17 times more than the stipulated limit, which is considered hazardous.

The Union Consumer Affairs Ministry has also asked the Food Safety and Standards Authority of India to look into the matter while Union Minister Ram Vilas Paswan said on Friday that a class action suit can also be initiated in the matter if a complaint is lodged in this regard with the National Consumer Disputes Redressal Commission (NCDRC).

The second case has been lodged by a local advocate in Chief Judicial Magistrate (CJM) court against the Bollywood actors for promoting Maggi noodles, saying they have been found to be harmful for public health.

There were no comments from the company.

Talking to newspersons, the advocate said he has lodged the case in the court of CJM against the three film stars who have claimed the instant noodles as healthy in TV promotions under sections 420, 272, 273 and 109.

He said these film stars have earned hefty sums by terming Maggi noodles as healthy in advertisements and alleged "this wrong publicity amounts to malafide intentions and playing with the health of the kids and young people of the country".

We have a culture and each culture is associated with a variety of food culture. But people are accepting fast foods as hifi culture. If you give lime juice or coconut water to a educated youngster he will think its very cheap. For him coke pepsi dew is like heavens water. This is the mindset of our generation. They like Chinese fast food though it contains ajina moto. Its hifi culture. So nowadays obesity start at age of 10 or below and still people are with all these food. Because they dont know how to cook the traditional food or they want to cook. We are working so we dont have time. So we order from out and children like that . And these children get BP sugar at the age of 20. Who is on fault?? The parents who have lots of money to buy food. Thought you are HIFi, stick to your culture and traditions. You can see the children now and their health . Poor children are healthy and the rich ones are ????

Probably it's time to take a closer look at what's on your platter. Cypermethrin, heptachlor, quinalphos, aldrin, chlorodane, dichlorvas, cypermethrin — these banned pesticides could well be a part of your regular diet. Okras, leafy green cabbages and other vegetables, bananas or oranges and apples that you so relish may be overloaded with some of these harmful pesticides.

A study by the Food Safety and Standards Authority of India under the Union agriculture ministry threw up some unpalatable facts. Common food items contain banned pesticides in quantities a thousand times more than the permissible limits. The findings are based on random samples collected from across the country.

From the vegetable basket, brinjal tops the chart with the level of banned pesticide at 860% above legal limits, followed by cauliflower and cabbage. Wheat and rice too had these dangerous chemicals. While the level of aldrin in wheat is 21,890 times more than the permissible level, that of chlorfenvinfos in rice was measured at 1,324% above the allowed limit.

Now people, what do you want to ban next???

    Milan,

You are against Nestle because its MNC. The same goes for your stance against the two giant soft drink makers. If you say that the companies should be banned because you think they are selling poison then the first thing govt should start with Cigarette and alcohol. Please understand that we eat unhealthy because these days we dont have too much of free time left to go home and cook after a long day of work. If we could eat healthy then we would definitely prefer healthy foods. And also eating healthy food is also expensive. Organic vegetable are always more expensive than the vegetable that are sprayed by pesticide. nowadays you will find very difficult to buy vegetables that contain permissible amounts of pesticide content.

The Coca-Cola Company asserted it had identified only a single case of an Indian farmer who might have been using soft drinks for pest management and that its product would be "totally ineffective" for this purpose:
A spokesman for Coca-Cola in Atlanta said: "We are aware of one isolated case where a farmer may have used a soft drink as part of his crop management routine.

"Soft drinks do not act in a similar way to pesticides when applied to the ground or crops. There is no scientific basis for this and the use of soft drinks for this purpose would be totally ineffective".
The BBC reported similarly, noting that sugar products have long been used for pest control, that soft drinks such as Coca-Cola don't function the same way industrial pesticides do, and that the beverages are possibly effective in crop management simply because the carbohydrates and sugar they contain "boosts the plants' immunity":
Agricultural specialist Devendra Sharma says farmers are mistaken in thinking that the drinks are the same as pesticides.

He says the drinks are effectively sugar syrups and when they are poured on crops they attract ants which in turn feed on the larva of insects.

Mr Sharma says using sugar syrup for pest control is not a new practice.

"Jaggery made from sugar cane has been used commonly for pest control on many occasions. Pepsi and Coca-Cola are being used to achieve the same result," he says.

Fellow scientist, Sanket Thakur, has a different explanation: "All that is happening is that plants get a direct supply of carbohydrates and sugar which in turn boosts the plants' immunity and the plantation on the whole ends up yielding a better crop."

Vikas Kocchar, regional manager for public affairs and communications of Coca-Cola, says claims that the drink can be used as a pesticide have no scientific backing.

It is time that the people of India realise that the food and cream products that Indian Film personalities advertise are only marketing gimmicks for the company to sell and for them to earn more extra money. Even drink, wafers products are advertised too. I have seen educated parents promoting their children to drink and eat these products inspite of being aware of its after effects. India is a big market for these products and the company that sell these products care a damn to our life. Just think twice not more than that before people decide to buy these products.
