Bhargav had challenged the magisterial court order that had jailed him while holding him guilty of the offences of driving under the influence of alcohol.

A person driving under heavy intoxication is like a “suicidal human bomb” who can take the lives of many others, a Delhi court has observed while upholding the three-day jail term of a man convicted of riding a scooter in an inebriated state.

Additional Sessions Judge Lokesh Kumar Sharma said appellant Rohit Bhargav is not entitled to any leniency and dismissed his appeal against the trial court order last month sentencing him to three days in jail.

“In my opinion the appellant while riding the two wheeler scooter under such heavy intoxication, was just acting like a suicidal human bomb, who could have taken the lives of others while driving the vehicle in such a state of mind and it could have also proved fatal for him due to a slightest mistake committed by him on road.

“Hence, in the given set of facts and circumstances, the appellant is not entitled to any leniency of this court... no ground warranting an interference of this court in the exercise of its appellate powers and jurisdiction is made out. Accordingly, appeal is dismissed,” the judge said.

Bhargav had challenged the May 5 order of a magisterial court that had jailed him while holding him guilty of the offences of driving under the influence of alcohol and without a licence and insurance under the Motor Vehicles Act.

The trial court had also slapped a fine of Rs. 3,600 on Bhargav, a resident of Gulabi Bagh in north Delhi.

    Very true. Drunken people must stay at home or some other confined place instead of killing and wounding innocent people on the road. The State of Kerala is a solid proof due to the high rate of road accidents caused by the drunken drivers. The rubber and oil money diverted to the dangerous pleasure of high level liquor consumption, thus destroying their own families, fighting, and killing in the roads.

    They are reckless murderers. Now the law in the U.S. is getting harder towards the drunken drivers.
    But I do remember four decades back living at an apartment at the corner of a four way road and woke up many nights due to the terrible voice of accidents. Those accidents were caused by the drunken drivers repeatedly.

    "drunken driver is like suicide bomber and strictly punishable, provided the driver is not a celebrity,not a politician or his relative, not a big business man or his son and some other influential person riding on a 4x4 or luxury vehicle.

    "Drunk Driver" is who can take the lives of many others, is well explained.
    That's not enough. Shouldn't stop there. Should take preventive measure to solve the problem.
    Driver also is normal mortal human with all weakness and is working in a bit harsh conditions or terrain.
    Road traffic, heat, obstruction, abusive language, objects or persons diverting attention etc. are some work related hazards they face.
    They should also have stipulated working hours, suitable pay, week end leave for rest, leisure and to live with family etc.

    Tis Hazari Additional Sessions Judge Lokesh Kumar Sharma decision is 100% correct. Due to heavy intoxication of Capt. Glusica pilot of IX 812- 158 innocent passengers lost their life at Mangalore. Unfortunate fact is still under carpet.

    "Spirited time bomb", very precise definition.

    The liquor when got inside will be turning as a deadly spirit, the real nature of the drunkard would be revealed very openly. With great pain I have watched while studying at college in India, some prominent people of our town in Kerala, when they got drunk, acted far worse than totally illiterate street people.

    Liquor consumption if not fully controlled to limited quantity, it will destroy them, their families and the society as a whole.

    Since Mr. Khan is a big movie star, he can be used as a deterrent to the liquor addiction epidemic in the society.

    Let the Government and civic as well as religious organizations may arrange speaking tours for him to tell his own story and the danger of liquor consumption.

    The liquor and drug problem is a national problem affecting the followers of all political parties and religions. Let us all push back religion and politics in this critical issue and be united to fight the danger.
