Government plans to give legal teeth to 'Swachh Bharat Abhiyan'


New Delhi, Jun 28 (PTI): Seeking to provide legal backing to Prime Minister Narendra Modi’s pet ‘Swachh Bharat Abhiyan’, the government is drafting a law under which municipalities can punish those found spitting, urinating and throwing garbage in public places.

The Legislative Department of the Law Ministry is finalising a ‘model’ law which can be adopted by states as per their local requirements.

The decision to draft a model bill was taken after the Legal Affairs Department of the Law Ministry said a central law on the subject would be difficult to implement.

“The Constitution has put sanitation and related issues in the state list. Therefore, there cannot be a central law.

But cleanliness goes beyond a state’s boundary. Thus, government plans a model law which can be adopted by states and modified as per their requirements,” said a senior official.

Government is of the view that self-regulation is not sufficient and a law to enforce the cleanliness drive will help the purpose.

Issues like punishment, fine and enforcement of the law are being worked out on the lines of traffic challan s so that the violators can be booked on the spot.

To avoid overlapping, the new law will be interwoven with existing rules in related sectors to make judicial approach to check practice of creating unhygienic atmosphere comprehensive and effective.

The official pointed out that swine flu outbreak in a particular area affects the entire country; therefore, cleanliness cannot be termed as a local issue.

At a review meeting recently, the PMO had expressed desire that laws governing cleanliness be examined so a comprehensive Act can be brought.

In the past, various Central ministries have framed model bills for states to follow. These included a bill on flood zone planning.

The Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 was notified in March last year. It provides for protection of livelihoods right, social security of street vendors and regulation of urban street vending in the country.

To implement the law at the grassroots level, setting up town vending committees in each local authority was proposed.

Though street vending is a local issue, Parliament had enacted the law in the interest of street vendors and people at large, the official pointed out.

Prime Minister Modi had picked a broom and swept the streets of the capital on October 2, launching a nationwide campaign to raise awareness about cleanliness and better sanitation.

The Swachh Bharat Abhiyan was launched on Mahatma Gandhi’s birth anniversary to inform people about the link between sanitation and public health.

    In Singapore you can get heavy fines if you spit on the road or throw cigarette butts and go to jail if you do not flush public toilets never mind if you urinate what they can do.This is why it is the cleanest city in the world.In India a fine of 100 Rs will not mean much. If it is 1000 Rs or more who knows which pocket it will go to?

    Dear Friends, It is very sad that most of the commentators calls our Hon. Prime Minister as 'FEKU' even if PM had been elected by the people as per the republican system. I can even understand that most of the commentators are Mangalorean youngsters (Anti BJP)but, a minimum decency should be maintained when you criticize. Suppose, any outsiders read the comments here posted, surely they will underestimate the whole Indians are disrespect to the PM or Nation etc. Please stop abusive like language to any one even it for Sri Siddharamayya or any other Political, Religious Leaders. We should not forget that, they also like us Human Beings. This is my humble request to the matured and educated Mangalorean commentators.

    Please give your noble advice to the PM first then normal citizens will follow.He still shows his uneducated background by criticizing his opponents abroad even after becoming PM.When he was in election mode he has used all possible names to call his opponents , where were you then?

    For above law to be effective, Municipalities first need to place enough garbage bins around the cities and then also make necessary arrangement to clear those garbage bins periodically.

    In many of the public places like airports, railway station etc., generally one can find boards suggesting fines and prosecution against people who litter and spit.
    This implies there is a law already.

    But why laws only to punish common people? Because they are poor unlike chota modi, sushma, raje and munde?

    If this swachh Bharat Abhiyan is undertaken with right sense to keep up country swachh like any other developed country it is welcome move. But we may have to wait and watch since any movement of achhe din of present govt has reversed the action by giving a highest noble thought to each topic and doing exactly opposite. The common public of this country are fooled and at this juncture with dictatorship at the centre its a pity if corrective steps are not taken.

    Swachh Bharat should include Industrial Pollution clean-up otherwise this whole campaign would be meaningless, ineffective and a mere eyewash.

    Govt is eager to punish and make avenue for making making money out of Swatch Bharat Abhiyan.
    But not even having wisdom and vision that FIRST they should construct adequate toilets, dustbins, drainage, roads, water etc. commensurate to the size of the population.
    People should first have right options before them.

    ..its even citizens responsibility to keep the city & Govt facilities clean..we fear in Gulf country or western country to throw pepsi can or food packets in road or while driving..but look what we do in INDIA..look at public toilets, its not less than a por# site or magazine..there are many instance, particularly in mumbai when Govt gives flats to slum dwellers, they rent it & once again build new slum colony..swatch bharat may look simple, but its a vast effect in controlling public health..
