Petition by eminent personalities urges President to pardon Yakub


New Delhi, Jul 26 (PTI): Leaders of various parties including BJP MP Shatrughan Sinha and its expelled MP Ram Jethmalani, eminent jurists and persons from different walks of life today submitted a fresh petition to President Pranab Mukherjee requesting him to waive off the death sentence of Mumbai blasts convict Yakub Memon.

In the new petition urging stay against imminent execution of Yakub Abdul Razak Memon, the signatories claimed that there are "substantive and fresh grounds" that can be considered on merits.

Memon is scheduled to be executed on July 30 as per the execution warrant issued by TADA Court.

The petition has come at a time when there is a huge political controversy over Memon's hanging and the BJP has condemned the remarks by parties against the hanging of Memon saying such a defence is happening due to "petty politics".

BJP MP Sinha, who had a day before met and praised Bihar Chief Minister Nitish Kumar, has once again gone against the party's stand on the Memon issue.

In the 15-page petition, the signatories have cited varioius legal points and international committments to argue that Memon should not be hanged.

"We most humbly request your Excellency to consider the case of Yakub Abdul Razak Memon and spare him from the noose of death for a crime that was master-minded by someone else to communally divide the country.

"Grant of mercy in this case will send out a message that while this country will not tolerate acts of terrorism, as a nation we are committed to equal application of the power of mercy and values of forgiveness, and justice. Blood letting and human sacrifice will not make this country a safer place; it will, however, degrade us all," the signatories said.

Besides Sinha and Jethmalani, those, who have signed the petition include MPs like Mani Shankar Aiyar (Congress), Majeed Memon (NCP), Sitaram Yechury (CPI-M), D Raja (CPI), K T S Tulsi and H K Dua (nominated) and T Siva (DMK), former CPI(M) general secretary Prakash Karat, CPI(ML)-Liberation general secretary Dipankar Bhattacharya, Brinda Karat (CPI-M) and filmmakers and actors like Naseeruddin Shah and Mahesh Bhatt, M K Raina and Tushar Gandhi.

It also included various academicians, members of the legal fraternity, activists and retired judges - Justice Panachand Jain, Justice H S Bedi, Justice P B Sawant, Justice H Suresh, Justice K P Siva Subramaniam, Justice S N Bhargava, Justice (retd) K Chandru, and Justice Nagmohan Das, noted lawyer Indira Jaising.

Others include academicians like Irfan Habib, Arjun Dev, D N Jha, and social activists Aruna Roy, Jean Dreze and John Dayal.

They cited that India is a signatory to an international commitment to abolish death penalty and hence death penalty cannot be imposed in India.

"Yakub Memon was not given advance notice of the death warrant hearing and as a result of which he and his lawyers could not participate and contest the issuance of the death warrant. Lack of hearing makes the present death warrant void," they said, citing a Supreme Court decision in the May 2015 Shabnam versus Union of India and Others case.

They said that there are some very "disturbing" aspects of this case which make the award of death sentence to Yakub Memon as "grossly unfair, arbitrary and excessive".
"Yakub Memon has served more than 20 years in prison since his arrest. His trial took 14 years to complete. While the Supreme Court used this long period of incarceration as a mitigating circumstance to commute the death sentences of the other 10 co-accused persons, it applied a different yardstick to Yakub.

"The Supreme Court has repeatedly held that lengthy incarceration during pendency of appeal in death cases is a significant mitigating circumstance which ought to be considered in determination of sentence. In the interests of justice we request you to give due importance to this," they said.

They also argued that Memon is mentally unfit for execution as he has been suffering from schizophrenia for the last 20 years.

"His mental condition has been certified by jail doctors. Schizophrenia as a mental illness has been held by the Supreme Court to render a convict unfit for execution," they said.
They have also cited that commutation of death sentences of convicts in other terror cases like late Prime Minister Rajiv Gandhi assassination case.

"It is also worthwhile to note that death sentences imposed on the aides of Veerappan (convicted and sentenced to death under TADA), Rajiv Gandhi killers and Devender Pal Singh Bhullar have been commuted recently by Supreme Court.

"While the mercy petitions of Verappan's aides, Rajiv Gandhi's three killers and Devender Pal Singh Bhullar were decided belatedly by the President, thereby giving them the claim of delay jurisprudence, the Home Ministry has moved swiftly to reject Yakub Abdul Razak Memon's mercy's petition," they alleged.

The petitioners said that it seemed that "subjective factors" were the basis of decisions which lead to arbitrary actions.

They also argued that the death sentence has been awarded under TADA which was repealed.

"Memon has been tried and sentenced to death under TADA, a special law which was repealed by Parliament on account of it having been used to target minorities," they said and referred to a Supreme Court judgement, which according to them doubted the legality of prosecutions pursued after the repeal of TADA.

"Given the highly compromised rule of law credentials of TADA, executing Yakub Memon will perpetuate the dark legacy of this law," they said.

    What a waste of everything. We don't need a Justice System, We don't Laws, we don’t need Police, we don't need Jails...........in fact we don't need anything. Let’s get rid of everything and let ALL, and I repeat ALL Indian people do what they want. Instead of all of the above, let’s have a voluntary surrender system for all those who wish to admit their guilt. The matter will be referred to these “eminent personalities” who will pardon them....and we all lived very, very Happily thereafter.

    The recommendations of Srikrishna commission after the Bombay riots (more than 900 people killed) were not enforced. Some of the findings of Srikrishna commission were
    (a) the demolition of Babri Masjid, (b) the aggravation of Muslim sentiments by the Hindus with their celebration rallies and (c) the insensitive and harsh approach of the police while handling the protesting mobs which initially were not violent.
    The immediate causes were listed as many scholars stated that the riots were pre-planned, and that the Hindu rioters were granted access to information about the locations of Muslim homes and businesses sources that were not public. The violence was widely reported as having been orchestrated by the Shivsena, a Hindu-nationalist political party in Maharashtra. A high-ranking member of the special branch later stated that the police were fully aware of the Shivsena's capabilities to commit acts of violence, and that they had incited hate against the minority communities. The main reason for the blast was the retaliation which too is not right.
    Let the government punish all the terrorists who were responsible for the killing of 900 people in Bombay riot, 2000 in Gujarat riot, massacre of sicks in 1984. Samjotha express blalst, Makkah masjid blast, Malegao blast, Ajmer Dargah Blast. No mercy should be shown to anybody irrespective of religion cast and creed. Let us collectively demand the execution of all people responsible for riots, killings and blasts including Yakub memon

    i strongly feel, if Apex Court has given the verdict to hang until death to any convicts, then there should not be clause for mercy petition. He/she should be hanged within a week's time from the verdict and should be announced only after the execution. Pls do not show any sympathy to such convicts as they have taken lots of people life and they strongly deserve such punishment. Jai Hind.

    Terrorists cannot be spared. They are threat to humanity. First and foremost requirement for having a terror free society is to remain harmonious with every fellow being and guard the rights of all the individuals. Unfortunately terror situation was first started by intimidating a section of people in our society by conducting postmortem of Babri Masjid which had eventually unfolded all kinds of revenge actions.

    My country has a rich heritage of UNITY IN DIVERSITY dating back to pre-independence era that includes many rulers and dynasties. Post-independence saw a big divide particularly in last 3 decades owing to political interests. We are GOD fearing country and this is symbolized by the presence of many churches, temples and masjids for centuries. Had it been not for the demolition of Babri Masjid, I think, you all will agree that our India would have been different.

    Yakub had voluntarily surrendered, was in jail for pretty long time and now he is paying price for his brothers mistake. There are many perpetrators like LK Advani responsible for instigating demolition, others involved in masterminding of 1984 sikh riots and staging of Gujarath killings. All responsible in these dreadful episodes are taken care by their reach and poor Yakub’s case stands separate. Let the law be same for everyone.

    First we the public need to shed out the image of Majority and minority, this is the tool used by the politicians and even so called eminent personalities to divide and rule us.

    BJP/RSS is not quiet on Rajiv killers recently when the TN Govt placed commutted their death sentence to life imprisonment. Central government came down strongly on the TN Government and asked the Supreme Court not to show any mercy to them.

    Thirdly in the blast its not the majority people or minority people are killed. BLasts kills human being irrespective of their cast creed sex religion region etc, and so do the damages to the public property.

    Death Sentence to Yakub Memon is justifiable.
    But Two customs officers namely Jayanth Gaurav & S S Talvadekar cooperated in unloading RDX from ships and transporting the same from Raigad-Shrivardhan jetty to Diggi Jetty near Mumbai. This RDX loaded Truck was driven by Custom officer Jayant Gaurav himself so that no police or other custom officer on the road should stop it and check it. They knew it very well that the consignment is RDX and brought to India for mass destructive criminal activity. Even then they cooperated with Memon gang. Their crime was proved in the court and they were awarded just 8 years of Jail Term and allowed to go Scot free and they are now allegedly employed in Gulf by D-company. The gravity of the crime of these two Hindu custom officers was as grave as that of Yakub Memon. These custom officers knew months in advance about the plot but they never informed it to police. Hence even these two Custom officers also deserved death sentence for treason. So, Why they were allowed to go with light punishment? Whether Owaisi is correct in his claim about religious discrimination?

    But the Cases of those two Custom Officers did not go to Supreme Court at all. The TADA court pronounced judgement and gave punishment and it is surprising that no one went to higher Courts to increase the Punishment. Crime of Yakub Memon & Custom officers is of Treason (conspiracy against the motherland) and helping in bomb blast and killing 257 innocent people and destruction of public & private property. So all should have got same quantum of punishment, may be death sentence.
    It should be noted that Customs officers knew right from the beginning as to why RDX is being smuggled into Maharashtra Coast. RDX is never used for Mining or industrial purpose unlike other explosives.

    Did he give advance notice to the 257 people before they died? It is time that all criminals get treated the same way they treated others. Showing clemency emboldens them and is a slap in the face of those whom he killed in cold blood.

    Nobody will say to pardon yakub but proving the equal treatment by the law for all criminals are big concern.Hang the mumbai rioters,babri masjid demolishers,gujrat rioters,anti sikh rioters first and must confirm law is equal to all.Just yesterday a chaddi supporter lawyer said yesterday national channel that gujrat riotes or mumbai riotes are not comes under terrorism but mumbai blast comes under terrorism .So the value of life lost in the communal clash is lesser than the blast victims.These kind of double standard policy is just proving the impact of majoritarean communalism.

    If the hanging of Kasab and Afzal Guru was made public by the then UPA government before their execution, I am sure both of them would have been alive today because of the terrorist sympathizer politicians and human right groups we have like above in India.     Before I start typing my comment I swear to holy god that my stand would have still been the same had his name was Yatish menon instead of Yaqub memon. I hope you all got my point! |Now, Look at this case from an intellectual point of view folks. Here is a criminal who assisted a deadly attack and the nature of his assistance as per the surfaced story is that he took care of some logistics, had a brief idea of arms and of course he is no kid to have not known of the attack he did knew it. He is a criminal of first grade who shouldn't be spared at all. No mercy, no sympathy at all.

    BUT

    The planning and execution of blast had so many deep layers. It was a high profile edgy planning by a bunch of extremists and they form the core conspirators of this whole episode and each one of those should be paraded naked, tortured and then hanged. Yaqub's crime compared to that of his contemporaries is secondary in nature. His logistic and monetary assistance and knowledge of the crime deserves perhaps a severe punishment like life imprisonment but definitely not hanging.

    Come to think of it, If Yaqub's story of voluntary surrender is to be believed then by hanging him we are simply blocking the road for future voluntary confessions.

    Also hang those who demolished Babri Masjid named in Liberhan commission report and those who killed thousands of innocent In Mumbai riots according to SriKrishna Committee report.
