Mangaluru: Proprietor of cab service arrested for tax evasion of Rs one crore

Mangaluru, Aug 6: Officers of the Commissionerate of Central Excise and Service Tax, Mangaluru, have arrested the proprietor of a rent-a-cab service for evasion of service tax of about Rs one crore, states a press release from the Commissionerate.

However, the Commissionerate has not revealed the name of the arrested person, nor the name of the firm.

The firm provides vehicles on rent to several major companies of Mangaluru, states the press release.

Based on credible intelligence, the officers had initiated investigation against the firm. "The service provider had filed nil tax returns for the last two-and-a-half years, although he had received consideration to the tune of several crores towards provision of services," the release states.

"The invoices raised by them had an endorsement to the effect that the service receiver had to pay service tax of 40 percent of the total value of the service. The relevant notification also stipulates that the service provider has to discharge service liability on the balance 60 percent of value. The service provider has admitted to the contravention that he failed to discharge tax liability thereby knowingly evading the payment of service tax," the Commissionerate stated in the release.

The investigation conducted so far prima facie revealed that the service provider has committed an offence punishable under Sec 89(1)(a)(i) of the Finance Act, 1994 by knowingly evading payment of service tax. Accordingly, the proprietor was arrested under Sec 91 of the Act, said the Commissionerate.

As the offence is non-cognizable and bailable, he was released on furnishing bail bond and surety, and also subject to conditions including payment of duty evaded in specific time frame.

Further investigation is under progress.

    Donot come into conclusion before you know the fact.rent a cab service has abatement of 60%.please refer notification no 30/2012 read with notification 26/2012 which clearly says the abatement rule. Never comment on issues out of knowledge.gove
    Govt officials are money hungry.if you dont satisfy them then this is the impact.violation of human rights has taken place in this case.will 0964

    Has anyone thought of their statutory commitments before expansion of their business. What we got from the English learning system is yearning and zeal to excel in life. But many of us never think of the aftereffects of this. As you expand and grow, new opportunities appear and then the same repeats in a bigger way. Then starts the next step of exhibiting the wealth and status.
    BUT REMEMBER. anything you do, earn and prosper, the government is supporting you just because it needs a good citizen, who can fill its coffers seamless and continuously.
    So all aspiring businessmen and young generation. Do business, only if you are ready to share your profits with the government. If not, please be employees and lead a happy life.

    Doing business is also problem... there's no support at all from the Govt.. if u don't do business and sit quite u will get all facilities like free rice, Sala manna, there are many more... but after taking so much headache in business there a headache of TAX,, that means earning more is a SIN..

    If the Taxes are High, tax compliance is Low, vice versa is the norm.
    The government needs to cut the taxes & get more in taxes through 100% compliance.

    Its not 40 % its 14% from June 2015 onward. Earlier its 12.36%. The rate applicable on 40 % of total receipts not on 100% receipts from transport business.

    Public as well as the Companies are all hiding their income and not paying income tax to the government.


    THE GOVERNMENT IS SPENDING THE TAX PAYERS MONEY FOR THEIR SECURITY, FOR THEIR SUIT-BOOT, LUXURY BMW CAR AND FOR FOREIGN PICK-NICKS.
