Suspend all trials against Italian marines: UN court to India


Hamburg, Aug 24 (PTI): A UN tribunal today asked both India and Italy to "suspend" all court proceedings involving two Italian marines charged with killing of two Indian fishermen in 2012 and also refrain from initiating new ones that might "aggravate or extend" the dispute.

Hearing Italy's appeal in the case, the President of the International Tribunal on Law of the Sea (ITLOS), Vladimir Golitsyn asked the two countries to submit the initial report in the entire incident by September 24.

The judge said pending a decision by the arbitral tribunal, "Italy and India shall both suspend all court proceedings and shall refrain from initiating new ones which might aggravate or extend the dispute submitted to the... arbitral tribunal or might jeopardise or prejudice the carrying out of any decision which the arbitral tribunal may render."

He further said, "Italy and India shall each submit to the Tribunal the initial report...not later than 24 September 2015, and authorises the President, after that date, to request such information from the Parties as he may consider appropriate."

The 21-member UN-mandated court located in this German city issued the order with 15 in favour and six against.

Unhappy over India's handling of the marine's issue, Italy took the matter to the ITLOS challenging Indian jurisdiction in the case.

It has pleaded that India must cease to exercise any form of jurisdiction over the Enrica Lexie Incident and the Italian Marines, including any measure of restraint with respect to Sergeant Latorre and Sergeant Girone.

The two marines, who were on board ship 'Enrica Lexie', are accused of killing two Indian fishermen on February 15, 2012 off the Kerala coast.

ITLOS is an independent judicial body established by the United Nations Convention on the Law of the Sea to adjudicate disputes arising out of the interpretation and application of the Convention.

    Only two things to be verified
    Whether this is deliberate
    Or is it accidental to protect
    From the reports it appears that no one will kill poor fishermen intentionally
    So please speak to family of deadays fishermen and let them decide whether they accept blood money as compensation and close the chapter
    If they insist that the ship crew or soldiers to be punished with death sentence then there should sound proof that they fired at fishermen intentionally
    A very straight forward and simple case could have solved in 3 months

    The kerala fishermen with their lungis, might have looked like somali pirates to the italians in the deep international waters, and that's why they were killed anticipating a threat to hijack the italian ship. There were rampant piracy a few years ago in the Arabian sea / Indian ocean

    It was only a case of mistaken identity by the italians. If the indian fishermen had fixed the indian flag on top of their fishing trawler, nothing would have happened and they would still been alive.

    U.N is always in favour of few countries preferably backing sentiments of white folks...Country like India should understand it always backs sentiments of two blocks one is Europe-U.S-Israel other is China-Russia...
    No matter how much grave criminal acts these two block does they are always safe...While these two blocks gives false sympathy towards India regarding joining UNSC...recently it is the same countries which opposed it...you must understand the double speak on how these countries thrive....While these are the countries which backs for equality while it is the same country which still opposes abolition of aristocratic "Veto"...which these countries want to limit it within them... Countries like Israel no matter how much grave crime they might have committed it is rescued by U.S...On other side there are country like Russia who recently vetoed Sebrenica massacre.....Poor are the countries which doesn't belong to either group they have no one to save....U.N has played major role in increase of terrorism by showing fake sympathy and only backing sentiments of few countries which hase Veto right...Criminal countries can live a respectable under U.N...and these are the countries which speaks on morality and equality...

    India was ruthless and used all force to get them back to India and face prosecution.

    Please do not blame the UPA here, because it is the UPA that brought that them back to India for facing prosecution and It is the UPA that forced the Italian Ambassador not to leave the Country unless the Marines return to India who were on bail.
    Since NDA came to power it has no power in UN council and It has no voice in UN but only creates bubbles in the air.
    Modi talks remains only talks and nothing practical, it sounds good on the TV and it is considered par with a stand-up comedy shows all over the world.
