Madikeri, Aug 27: An accused, who assaulted another person and posed death threat, was sentenced to five years imprisonment by the district and sessions court here. It also imposed fine on the accused, holding him to be guilty of charges levelled against him.

The court, when sentencing T A Mahesh from Kaloor village, exonerated other four accused in the case.

A person named John Mascarenhas had visited a hotel here on July 27, 2007, for dinner, accompanied by friends, M V Lokesh, P G Harish, K V Subrahmani, K A Ayyappa, Jagadish and Naveen Rai. T A Mahesh, who confronted John Mascarenas, kicked up quarrel with him on trivial issues. It was said that he along with friends, K Harish, Bopanna, Ganesh Rai and K L Ravi, had assaulted Mascarenhas and posed death threat, before escaping.

The town station police, who registered the case, investigated it, and filed charge sheet in the court. Judge of district and sessions court, Master R K G M M Mahaswamiji, who heard the case, imposed fine of Rs 21,000 on T K Mahesh apart from sentencing him to five years imprisonment, finding that charges against him have been proved with the help of evidences and witnesses. Out of the fine, Rs 15,000 has been ordered to be disbursed to the injured defendant. As charges levelled against the other accused could not be conclusively proved with the help of evidences and witnesses, they were absolved of the charges.

Public prosecutor, A P Firoz Khan, appeared for the prosecution in the case.
