Child rapists must be castrated: Madras HC to Centre


Chennai, Oct 26 (Agencies): In an interesting order, Madras High Court has suggested castration as punishment for child rapists.


While passing the order, Justice N Kirubakaran said, "The court cannot be a silent spectator, unmoved and oblivious of the horrible blood curdling gang-rapes of children in various parts of India."

While recommending the Central government to make castration a punishment for child sexual abuse, Justice N Kirubakaran said, the court is sure the castration of child rapists will fetch magical results.

The HC pointed out that countries like US, Poland and Russia have already enforced castration for sex offences against children.

“This court could foresee that the suggestion of ‘castration’ would be surely condemned, censured and criticised as barbaric, punitive, draconian, cruel, etc. Inspite of many penal laws and the recent POCSO Act, 2012, prescribing severe punishment for crimes against children, the number of such cases has increased from 38,172 in 2012 to 58,224 in 2013 and to 89,423 in 2014,” the HC order said.

The judge noted that between 2012 and 2014 the number of these crimes had increased from 38,172 to 89,423. “Those activists should first exhibit sympathy with, and support to, the victims of such crimes by visiting and consoling them at the hour of crisis instead of having misplaced sympathy with the perpetrators under the usual banner of ‘human rights violation’. They must remember that ‘human rights’ is not a term restricted to, and reserved only, for offenders, the order read.”

The court passed the order on October 16 while hearing a petition of a youth hailing from Tamil Nadu. The 18-year-old boy alleged that a British national sexually abused him in 2011 after promising his mother that he would take care of his education.

    @Antonio and other , the way you people defend barbaric practices despite being K(c)hristian where forgiveness has to be one of the traits is truly shocking !.     Please ponder for a moment the immense sufferings of the children and that of the parents who have to soothe the mutilated bodies of their children resulting from the rapes by the monsters.

    Castration is a very easy way out,,,,, If it were to me I would have them hung by their evil un-castrated things and left there to die slow agonizing deaths.

    Very good move by justice N Kirubakaran. Let us not show any sort of leniency towards rapists. Hoping for the endorsement of such law by the government soon. Fear of law is the only solution to minimize the crimes. Democracy is not meant for committing heinous crimes.

    that will be a simple end for them for the crime they have done. let them realize and feel the pain the innocent child passing or passed through while raped. These kind of people would be the once similar to the people to view public utions conducted by inhumane groups like ISIS. Please always check whether what you are suggesting is the exact same thing what the inhumane groups would do.

    Yes we sometimes feel the need to torch there perpetrators of heinous crimes, but we must act in a civilised manner, and bring laws that are appropriate for a civilised society and should have these laws implemented in a proper way.

    wow. what a daring step. Trust the central govt which has taken many such bold initiatives will accept the proposal and implement this law. It will bring down this child rape to almost 0 % with in no time. Who ever objects this move need to be taken under custody with the complaint as "indirect support for the crimes like child rape".     There are some things that you will never understand. Yes we can have outlandish punishments to the culprits, but we cant do that is a democracy. Because such punishments would transgress on the what the duties are of a govt. This is the reason why even capital punishments are opposed in many democratic countries.
