Subramanian Swamy's book promotes religious hatred, Govt tells court


New Delhi, Nov 3 (NDTV): The government today argued in the Supreme Court against a leader of the ruling BJP, Subramanian Swamy, saying that a book written by him "promotes hatred between Hindus and Muslims in India."

In its strongly-worded affidavit, the home ministry said that Swamy's book "Terrorism in India" released in 2006 violates rules on hate speeches.

In the book, Swamy "has made hate speech against the community of India...its theme, language, its innuendoes, the similes it employs ....it falls within the provision of hate speech."

Swamy, a strong defender of the Modi government, said he would go to the Prime Minister and also speak to Home Minister Rajnath Singh.

"I am surprised. Even the UPA government didn't say anything about my book. It seems there is a conspiracy against me because of my popularity," he told NDTV.

Swamy alleged that "someone from the party" might have got hold of an under-secretary to file the affidavit.

In June, the BJP leader had challenged the laws on hate speech, saying they violate the fundamental right to freedom of speech. Even today, he asserted that he would continue to challenge it in the apex court.

The home ministry's affidavit opposed that petition and asked the Supreme Court to dismiss it.

This is not the first time the government has opposed Mr Swamy in the Supreme Court. Earlier, it asked the court to dismiss Swamy's petition challenging defamation laws.

    Once upon a time there used to be a couple of hardcore devotees of Swamy in this forum, to whom whatever Swamy uttered used to be Vedavakyam. These morons even took his prophesies such as 1$ = 40 INR seriously! Wonder how do they react to this development.

    Dr. Swamy is cranky politician. He is an intellectual but uses it for destructive activities especially in creating tension between different Communities. prior to joining BJP he was a bit sensible person May be he is against Muslims due to his daughter suhashini married son of Former foreign secretary salman Hyder .

    Political opinions aside.
    A person can be deemed to be 'truthful' only when they speak/write the 'whole' truth or the 'complete' truth. Telling 'part' truth and leaving some details untold is equivalent to telling a lie.
    Also telling truths only se-lec-tiv-ely when it suits our interest is also not being entirely truthful.

    Modi's Home Ministry has not filed this affidavit on its own. In fact SC had issued notice to govt in July 2015 itself and now after three months Home Ministry is forced to file affidavit regarding Swamy's book or else Modi Govt would have faced strictures from SC for not replying to its notice.
    Earlier Swamy in his petition had contended that under the present law, a person couldn't attempt to initiate a public debate to modify people's perception as the person was "chilled or gagged" under the present law.

    So, SC gave notice to Govt in July because Swamy himself had challenged the validy of some provisions in the Law as regards Hate Speech. Then SC agreed to decide constitutional validity of penal provision in respect of hate speech, and SC issued notice in July to Centre and sought its response.

    Now it seems Swamy has axed his own legs with his own hands.

    This is stunt by BJP government to blame someone else for hatred they are spreading. Everyone knows that Swamy hates muslims after his daughter went with one . If the book was published in 2006 what is the point now?
