SC declines PIL on uniform civil code


New Delhi, Dec 7 (IANS): The Supreme Court on Monday declined to entertain a public interest petition seeking direction to parliament to enact a uniform civil code to put an end to alleged discrimination being faced by Muslim women.

An apex court bench headed by Chief Justice T.S. Thakur said that it is for parliament to take a call on the issue and it was not in the realm of the apex court to issue a direction on this.

Chief Justice Thakur, in a disapproving note, told senior counsel Gopal Subramaniam that if such petitions were filed without regard to the law, the court will come down very heavily.
The court asked why none of those who are being allegedly discriminated against have come forward for redressal.

Advocate Ashwini Kumar Upadhyay had filed the PIL.

    SC is just in its observation that aggrieved muslim women should file the PIL...Here its filed by a non muslim man who doesn't know the teachings of islam..its a political move by sanghis..please google out hindu voice n u ll find whats th advice to our PM n how its implemented...The hindu voice calls for uniform civil code, scraping of article 370 of J&K, ban on cow slaughter, renaming of cities that hv muslim names to hindu names, compulsory singing of vande mataram, anti conversion laws, introduction of sanskrit in schools, teaching of geetha in schools, redesigning national education policy, banning burkha in schools, no reservations, etc etc n the list is long...its no doubt bjp is implementing it step by step as hindu voice says India shoukd be called as Bharath n declared as hindu nation n advocates for removal of the word "secular" from our constitution...please read it n u ll know the hidden agenda..Seeking PIL for uniform civil code is nothing but a step towards implementing the hidden agenda of "Hindu voice".

    Before going for common Civil code, think whether we have a common Criminal code in our country! Criminal laws all over India are not same for everyone. The answer is a Big "No".

    What is allowed in one state is illegal in other state. What is legal in one part of the state is illegal in another part of the state. A Sikh can drive a two wheeler without helmet but the same act by non-Sikh amounts to a crime. A Sikh is allowed wear a turban in our army. But a Muslim is not allowed to wear a skull cap. A Sikh is allowed to carry a "kirpan" in public. But non-Sikh cannot do that.

    Ban on diesel vehicles more than 10 years’ old in Delhi has been upheld by SC while this law is not yet applicable in other state. This ban covers only New Delhi. A person raping a minor gets death sentence by one Judge whereas another person committing same crime escapes with 10 years’ imprisonment. A murderer is awarded life sentence in one instance whereas in other court, a similar crime gets only 7 years’ imprisonment. A peon caught accepting bribe is dismissed from the govt service while department head caught accepting bribe is crores escapes with 3 months’ suspension or transfer.
    Flesh trade is allowed in Mumbai but banned in Pune. Alcohol is not only allowed but also sold by government of Tamil Nadu but banned in Kerala. Selling lottery ticket is allowed in Kerala but banned in Tamil Nadu. Eating beef is banned in Maharashtra but allowed in Karnataka.

    Helmet is compulsory both for rider and the pillion rider in some states whereas wearing helmet even by the rider is not mandatory elsewhere.

    So where is the ‘common Criminal Law too? Why there isn’t a demand for that?
    In this scenario where is the question of ‘One country One Law? Our politicians are just fooling and playing around with gullible voters. And even the most learned ones are falling prey to these dirty, cheap games of politicians.

    Very Good decision by Honourable supreme court . Feminism is evil and its good that sharia is oppressing it . So far Muslim personal laws are the only one stuck to originality by resisting feminist advancement and pseudo women empowerment . Now the government trying to bring MARITAL RAPE , its time men stand up and oppose such vague and hatred concept destroying the sanctity of marriage . Marital rape is a word directly from feminist dictionary and its their fantasy too. So wake up before its too late .

    I think a very good decision by the SC. In Islam, we follow the Sharia Law and follow what is mentioned in Quran and taught by Prophet Muhammad (PBUH).

    Well, what I have said above may not be acceptable or easy to digest for many readers here! But, this is the fact and if one reads Quran & the teachings of Prophet Muhammad (PBUH) then it will be very clear if there is any discrimination for Muslim women while practicing & following the right path in Islam! Being a Muslim, I know very well that there is no discrimination for Muslim Woman and our women are very much happy while working both as a working woman as well as taking care of the family as a very good wife, daughter and as a mother.

    Hahaha...BJP fooled the entire nation and even they cheated their own voters (31%). Modi promised BJP Bhakths about implement the Uniform Civil code, Cancellation 370, Building Ram Mandir, Beef ban across the country etc. Now their voters chasing behind them for implementation of the poll promises.     When it comes to other issues, they want uniformity in all matters but when we insist for uniform civil code, they don’t want to comply. Even SC too hesitant to pass the order? I dare all Political Parties except BJP & Shiv Sena will never insist for the same too.

    No Ahmed Bhai….. This is not a good decision…. Because we need to treat women equally in our society… No doubt we Men do most of the hard & manual works but they take all pain for giving birth to a male child too who becomes Men later on!!!! This is called really intolerance
