2002 hit-and-run case: Bombay HC acquits Salman Khan


Mumbai, Dec 10 (PTI): The Bombay High Court today acquitted Bollywood star Salman Khan of all charges in the 2002 hit-and-run case in which he was convicted and sentenced to five years imprisonment by a sessions court.

While acquitting the 49-year-old actor in a jampacked courtroom, Justice A R Joshi said, "The appeal is allowed. The trial court's verdict is quashed and set aside. Salman is acquitted of all charges."

On hearing the verdict, Salman broke down.

The actor, who wore a blue-white check shirt, arrived in the court at 1.30 PM even as the police made a tight bandobast around the high court premises.

He was accompanied by his bodyguard Shera, brother-in-law Ayush, sister Alvira and his manager.

Justice Joshi, who started dictating the verdict on Monday, said the prosecution failed to establish its case against the appellant accused (Salman) on all charges.

On September 28, 2002, Salman's car had rammed into a bakery shop in suburban Bandra. One person was killed and four others were injured in the mishap.

Lawyers, litigants and many others had gathered in and around the court to have a glimpse of Salman as he came rushing from a studio in Karjat on the outskirts of Mumbai where he was shooting.

The judge said the burden is on the prosecution to establish the guilt of the accused and this needs to be done beyond reasonable doubt.

There are various shortcomings by the prosecution like not recording evidence of necessary and important witnesses and omissions and contradictions in the evidence of injured witnesses, which definitely create a doubt about the involvement of Salman for offences for which he has been charged, the court said.

On the basis of such evidence, Salman cannot be convicted, it said.

The judge further said that the investigation was conducted in a faulty manner with many loose ends and as such benefit of this had to be given in favour of the accused.

It is the duty of the court to analyse the evidence submitted to it and to see that the offence is proved beyond reasonable doubt, Justice Joshi said.

He said he is of the considered view that the appreciation of evidence done by the trial court while convicting the appellant was not proper and legal, as per the principles of criminal jurisprudence.

Consequently it must be said that this is not a case where the prosecution has successfully established its charges, he observed, adding that the entire evidence of the prosecution was circumstantial in nature.

On the main aspects as to driving and drunkenness, the prosecution has not brought any material evidence which spells out the offence of the accused, the court said.

The trial court erred in accepting bills (of Rain Bar and Restaurant where Salman had gone before the mishap) without a panchnama, the judge said while dictating the verdict.

    Every one should understand that people can live without Khans, but not without manual labourers.

    Salman Khan's body guard Ravindra Patil gave witness against Salman and stuck to it till last. He was kidnapped, but arrested by the Police. He became a TB patient and lost his job. His family did not accept him. He died by omitting blood while begging on the streets.

    From the beginning itself I am against these Khans as I have an insight into their poisonous mind set.
    At least now, people should wake up and boycott Salman Khan and thereby give him punishment which he escaped from the law of the land.

    This is nothing but, Money & the Mighty speak and they survive. But justice delayed is justice denied for Common man and poor people. This case sure sends doubts on our Judiciary systems. If case is delayed by 13 long years, am sure evidences, samples of blood, witnesses every thing that was important for this case has been tampered, has been changed, has been influenced - for sure.
    Does this mean, the deceased & wounded have no justice in this case, unbelievable how influence of money, power and might work in our country's Judiciary Systems. Lucky Lawyers , who dealt with this case, who would have been richer by few lakhs or crores after this case..
    So ultimately may we know who was driving the car that night? Unless it is like a Movie " Tarzan the Car" which went without a driver??

    No doubt the law states the benefit of doubt is always in favour of the accused and the prosecution should prove beyond reasonable doubt about the role of the accused in the crime. Nevertheless "Just should not only be done but also seen to be done" to the victims. Hope Mr Salman who is blessed with wealth will help out the victims without waiting for further evidence of proof of dependents since his car was involved in the accident.

    Taking 13 long years to deliver verdict, in between death of a key witness, couldn't prove whether he was actually drunk at the time this unfortunate incident, lawyer arguing one need not visit a bar just for the sole purpose of drinking, nobody saw him driving the vehicle at the time, etc. Obviously judgment in favour of the accused was expected. But truth will always remain truth. It can never be falsified.

    Any how good judgement by the Bombay High court. He was mentally tortured for last 13 years due to this case. Since there is no enough proof, why the people were blaming him for this accident. People have to take care while sleeping on the footpaths in the nights. Everything is not visible for the drivers during the night. Some reckless drivers hit and ran in the night by accident, Police might have registered false case against him. Govt have to give good compensation to the victims or their families. Good luck to our Super star Salman Khan, enjoy his rest of the life.
    Hope Delhi High court also will aquitt Gandhi family & other Congress leaders in the National Herald case.

    Out of all the Bollywood Khans only Salman Khan has not said anything directly or indirectly against BJP/Modi or Intolerance etc.etc. Moreover, his father Salim Khan has also shown a friendly face to them (BJP). Even when Salman Khan spoke in favour of Yakub Memon against the Death sentence he quickly retracted his words and his father too had criticized him for that. Then there is also the kite flying episode pre LS elections 2014.

    He is reaping the rewards now just like Jaya Amma ?

    So relax guys don't blame Congi or Scamgress or whatever. This guy is a BJP supporter at least outwardly for his personal benefit and film career.
