Divorce Act to be amended to halve separation period: Govt


New Delhi, May 5 (PTI): The government today said a proposal is ready to amend the Divorce Act to halve the separation period for Christian couples seeking to file for divorce by mutual consent.

In a written reply in Lok Sabha, Law Minister D V Sadananda Gowda said the government plans to amend Section 10 A of the 1869 law to reduce the minimum mandatory period of separation from two years to one year to bring uniformity with other personal laws.

The move comes against the backdrop of a Supreme Court ruling and demands by the community.

The separation period under Hindu Marriage Act, Parsi Marriage and Divorce Act and the Special Marriage Act is one year.

Section 10A(1) of the Divorce Act, added through an amendment in 2001, says that a couple seeking divorce should be living separately for a period of "two years or more".

Against the backdrop of the Supreme Court order delivered in April last and demands by members of the community, the Law Ministry has decided to move the proposal to reduce the separation period.

Questioning the existing law, the Supreme Court had urged the Centre to make necessary amendments. "Should Christians stay separated for minimum two years when the period prescribed for others is one year? It does not make sense to us. It is a pure question of law and you (government) should have acted on your own," a bench of Justices Vikramjit Sen and A M Sapre had observed.

The bench was hearing a petition filed by a Delhi-based person while delivering the order.

Some High Courts have also struck down the provision of two-year separation.

Law Commission has on several occasions also recommended amendments to the Divorce Act to make it more women-friendly.

    Bringing uniformity among all citizens is the prime need as every religion has their own laws or none at all.
    Christian couples have to face civil as well as cannon law to get their marriage annulled, without which they are not permitted to remarry in a Church, while those who got their marriages annulled are breaking the law if they remarry without civil divorce.
    Its Time All Citizens share the same laws without discrimination.

    HUMANS ARE IN A MATERIALISTIC AND WORLDLY ENJOYMENTS.

    Is there any mention by Jesus about living together without marriage or pre-marital sex? Adultery takes place only when you cheat on your spouse.

    Well Mr NN, Mangalore-
    Find in the Bible he says-“You have heard that it was said, ‘Do not commit adultery.’ But I tell you that anyone who looks at a woman lustfully has already committed adultery with her in his heart. (NIV, Matthew 5:27-28)
    Now Mr NN those who do live in & commit the act without getting married, certainly are adulterers according to your Teacher Jesus too.

    You are right, but going through what you wrote divorcing to remarry is wrong or adultery, but getting a marriage annulled is like that knot didn't take place or null & void "ab initio", & its not adultery if they remarry or marry later, ain't it?
    When a marriage doesn't fulfill its aim or the purpose if all the conditions are not met, like a person is alcoholic, lunatic, incapable to consummate or a psycho who thinks he or she is cheating him with no reason & might try to get rid of her or him.

    Mr.Dev, once the Civil ( Family ) Court gives its verdict then it is easy to get a marriage annulment from the Church. In the 1950's & 60's it was just impossible to get your Church marriage annulled. As a Catholic Priest mentioned that the highest rate of divorces amongst Mangalorean Catholics ( 445 in 2015 ) is in Mumbai. Second ( 194 in 2015 ) is Mangalore. Goa State ( 337 in 2015 ) too has a very high rate of Catholic divorces / Church marriage annulments on file.

    2 of my friends said, they have divorce through civil court but Church is still not given the annulment even after 3-5 years.
    But I have seen some get it within a year too, Why?

    The Supreme Court is right in its judgement / observation. It is better to end a problematic marriage after good attempts of marriage counselling at the earliest. Even Pope Francis has accepted / admitted the problem ( in todays world ) and has made necessary changes in the Cannon ( Roman Catholic Church ) Law.
