Bangalore, Nov 21: A citizens’ group has challenged the amendment to the Town and Country Planning Act regularizing up to 50 per cent of violations in residential buildings and up to 25 per cent of violations in commercial structures.
A division bench comprising chief Justice Cyriac Joseph and Justice Ashok B Hinchigeri adjourned further hearing on the Public Interest Litigation (PIL) petition by citizen's forum for Mangalore development.
When the matter came up, the bench recalled having passed an order on a similar petition on violations of building by laws in Mangalore. Advocate Jayna Kothari, who appeared for the petitioners in both the cases, said the same bench had stayed till further orders, regularization of violation of building by laws and also violation of the National Building Code (NBC) by high-rise buildings in Mangalore.
She said while the earlier petition pertains only to violations in Mangalore, the current petition is against amendment of the Act.
The bench posted further hearing on the case to Monday November 26.
