Congress says UCC can't be implemented, BJP calls its progressive


New Delhi, Oct 13 (PTI): In the face of strong opposition to Uniform Civil Code by Muslim outfits, Congress today said its implementation would be impossible while BJP asserted that the move is aimed at moving towards a progressive society.

Other opposition parties like JD(U) accused the BJP-led central government of trying to polarise the people ahead of Assembly polls in several states, with leader of Majlis Ittehadul Muslimeen (MIM) Asaduddin Owaisi saying that bringing the Uniform Civil Code (UCC) will "kill" the diversity and plurality of India.

Earlier in the day, the All Indian Muslim Personal Law Board and some other outfits opposed the Law Commission's questionnaire on Uniform Civil Code, including abolition of 'triple talaq' and announced their boycott of the move, accusing the government of waging a "war" against the community.

"If you enforce something in the name of Uniform Civil Code, then it will kill the diversity and plurality of the country. It's not right to look at it from a Muslim perspective because Indian diversity also comprises of Dalits and Tribals. There are different traditions in Hinduism as well," he said.

Owaisi said the government's "real agenda" was to focus on Muslims and polarise the society.

Reacting to the issue, former Law Minister and Congress leader Veerappa Moily said it will be difficult to implement UCC in a country like India where various communities and groups are governed by personal laws.

"In a country of this nature, implementation of Uniform Civil Code is next to impossible," he said adding no one should take it as a communal agenda or a Hindu versus Muslim issue. He said 200-300 personal laws exist in India covering various communities.

BJP national secretary Sidharth Nath Singh said the Law Commission is taking opinion of all the stakeholders on the issue following which it will form a "considered opinion" and give it to the Supreme Court.

"Now it is for the Muslim Personal Law Board to consider whether they want to be part of the stakeholders or they want to be an individual identity... if Personal Law Board people are misinformed, I cannot do much about it," he said.

Singh also referred to some international declarations and countries like Turkey, Iran and Indonesia saying they changed law to ensure gender equality. He said it was a move towards building a progressive society.

JD(U) MP Ali Anwar asked the government why it was only focusing on Muslims and said it is not the time to start such a debate. "They want to polarise the society."
Shiv Sena's Sanjay Raut said "for how long the Muslims will stay away from the national mainstream. The Muslim Law Board should support the UCC as it will help the community, especially the women to come out of misery.

"Our party's stand is 'one code, one law' and it should be viewed as a national issue rather than religious one."

In his reaction, Owaisi said those pushing for UCC were not aware of India's pluralism and diversity.

"They are not understanding India's beauty where there is a different culture every 200-300 kms. If you make one culture to all, then its not going to work. MIM will certainly respond to the questionnaire," he said.

He said, "We have given cultural rights to people of Mizoram and Nagaland. Are you going to end that?"

Making perhaps the first such move, the Law Commission had on October 7 sought feedback from public on whether the practice of triple talaq be abolished and whether a uniform civil code should be optional.

    Minorities do not trust the RSS/BJP with their anti-Muslim and anti-Christian agendas to codify a civil code that protects minorities’ interests. The BJP legislated the Freedom of religion bill in Gujarat which nullified the constitutional liberties of Christians in Gujarat and has passed laws punishing Muslims in Haryana and Madhya Pradesh for cow slaughter and the possession of beef. The BJP government lacks the trust of minorities and the moral authority to preside over an uniform civil code for all Indians.

    Then why discriminate & do appeasement? Uniform Civil Code is the need of the hour! We are one, Secular INDIA for INDIANS! Rise above caste & creed!

    Congress will never allow such advances or progress in this country. Their only vote bank is caste, religion, divide and rule. So, they will not allow any kind of uniformity in this country. Or else it's simple, one country, one law... nobody can object it. It's a major progressive step. Trust central govt will be able to overcome this hurdle by Congress and implement the same. Next step should be again on the reservation... nothing should be caste or religion based. Everything else will fall in place.

    One country, one law, that is good. Govt is quoting advanced countries, true, then remove religion, caste from education and employment reservations. Let the reservation be for BPL and handicapped only. No, govt has no guts to remove reservation. Then, what one country ,one law are they talking about ?

    If anyone has issues with Islamic dissolution act ( sharia ) 1939 , use special marriage act 1954 .The TRIPLE TALAQ is necessary as it faster and authentic separation process . Instead of wasting courts time , the head of the family MALE can exercise his right . POYGAMY gives more rights to women as a legal wife rather than concubine

    Islam disapproves of divorce immensely, and in this connection it has cautioned its followers to be very careful, and has pointed out the steps that the spouses have to take for reconciliation in the event of disagreement between them. It has also laid down the correct procedure of giving divorce if it becomes inevitable to do so.
    If a dispute has arisen between the husband and the wife and their living together as husband and wife is becoming difficult, in such a situation the direction of Islam is that the decision to give divorce should not be taken, but all efforts should be made for reconciliation between the two disputants.
    If all reconciliation efforts proves to be ineffective, and there appears to be no sign of reconciliation, then the husband can use his right of giving divorce Similarly Islam has given the right of ‘Khula’ to woman and also to approach a court of law for dissolving her nikah.
    Divorce cannot be given during menstrual period. First divorce to be given in presence of two just witnesses. They have to wait for three menstrual periods before giving the second talaq. If she becomes pregnant during this period, then they need to wait till delivery. During this waiting period husband can return to her and take her back as wife. But in spite of efforts smooth relations did not prevail, then he can give the second divorce. Again during this period of waiting, the husband can, if he wishes, return to his wife, i.e. take her back as wife. And if the period of waiting is over, then he can re-marry her with her willingness.
    The commands concerning this third divorce are very Strict, The third divorce is not only separator but also irrevocable but is so absolute that the man and the woman cannot remarry even with mutual agreement unless the woman is married to another man and this other man divorces her by his own free will.
    Divorce is Halal (permissible) but most disliked Halal.

    Its The Right time for the UCC so all Indians are equal in all the law.
    So all my brothers and sisters from the different community's can feel the equal between them so no one will have a right to call someone on the basis of their religion what so ever .
    every minority people will get the same opportunity and facility which at the moment enjoyed by the majority.
    This should have been done long time a go .
    specially this is better for my sister's in minority community so they have full access to the civil law not the religion law which does not allow them some facility .
    when the people of Australia or other country can go with a UCC why not us.

    BJP government, please go ahead with the Uniform Civil Code. This is a must for the Country and specially for the rights of the women, who have been exploited for centuries in the hands of draconian men and the religious leaders.

    In this issue of Uniform Civil Code, All Indians should support the Government.

    When we get the passport, we receive as 'Indian Passport" irrespective of state, religion, caste, creed, area etc. Similarly, we should have One Civil Code for all.
